local news Potholes are ‘unacceptable’ MP Ben Chapman has criticised the state of the roads in Heswall. The Wirral South MP says that the number of potholes and poor road surfacing is creating loads of problems for motorists. He said: “I drive to my office in New Ferry, from my home in Heswall, via Baskervyle Road, Well Lane and Brimstage Road. Their condition is of an unacceptable standard and, of course, they are only examples and everyone will have their own. “My constituents regularly inform me about potholes and tyre and suspension damaging surfaces. These hazards also cause dangerous driving as motorists swerve to avoid them. People in Wirral South are also concerned about temporary repairs which prove only too temporary and probably lead to greater expense in the longer term. They are also bothered about the practice of skimming of surfaces which gives the appearance of repair but is only palliative.” Wirral Council insists that the state of the roads is ‘very good’. Teens visit Africa A GROUP of 25 teenagers from the Church of the Good Shepherd, in Heswall, flew out to Uganda to help communities with their building work. The group, along with 16 adults, visited communities in the rural South West of the African country to do decorating and helping to provide clean water. The scheme has also been supported by St Peter’s CE Primary School, who raised cash to pay for an adventure playground.

Have your say on neighbourhood spending PEOPLE in Heswall will have another opportunity to decide how the council should spend money in their neighbourhood. Following the success of the ‘You Decide’ scheme in 2008, Wirral Council has allocated an additional £220,000 to the borough’s 11 area forums. Each area forum has £20,000 to spend on extra council services, which can include environmental improvements, security measures and youth and community activities. The Leader of Wirral Council, Cllr Steve Foulkes said: “The money is already making a real difference in lots of ways.” All Wirral residents are encouraged to complete the You Decide suggestion forms, which can be completed on-line at www.wirral.gov.uk/youdecide and are also available from libraries, One Stop Shops and a number of health and community centres.

A tasty new arrival for your pet… For many years as a vet I have recommended the use of high quality complete dry foods for healthy pet patients, naming leading top quality brands. So, in recent months, I have set about creating an alternative! We must rid ourselves of this unfair tunnel tax “In addition to the cost pressures they share alongside other motorists, the Heswall motorist pays up to an additional £658 in tunnel tax”. Jeff explained that the cost for hardworking Heswall residents who need to use their vehicle for work, driving through one of the tunnels into Liverpool, pays an additional £658 in fees during a 47 week working year. “This is a significant and unfair burden they should not have to bear”, said Jeff. Jeff in setting out a personal commitment, should he be elected the next MP for Wirral South, accepted that the Conservatives could not at this time simply promise to lift the tolls on the Mersey tunnels “we know that the public finances are extremely tight, and we will not know the true extent of the position until we have access to the books after a General Election”. “That said, we need to have a strategy, and it seems entirely reasonable and realistic first step to stop any future rises in the toll fee”.

AND COMPROMISE AGREEMENTS

‘I HAVE recently been selected for redundancy. I have been offered a redundancy payment but my employer has told me that I must sign a Compromise Agreement in order to get the full amount. What is a Compromise Agreement and will I benefit from signing it?’ The ‘Credit Crunch’ and the downturn in the economy has forced many businesses within our region to reduce or restructure their workforces and, in some extreme cases, businesses have had to cease trading altogether. A Compromise Agreement is a legally binding agreement between you and your employer. Such agreements are used, in a variety of circumstances, to set out the terms and conditions reached when a contract of employment is terminated. As well as redundancy, these agreements can also be used to settle employment disputes and tribunal claims, and even when individuals leave their job by mutual agreement. The agreement you have been offered should provide a full breakdown of the payments that you are going to receive from your employer. It should indicate whether the payment offered takes into account money in lieu of your notice period, and any holidays that may be owed to you. It should also give you an indication as to whether any tax or national insurance is payable on the sum being offered to you. In return for the payment, your employer will be attempting to exclude you from being able to bring claims against them as a result of the termination of your employment, in a court or in the Employment Tribunal. It is crucially important for you to know that by entering into the agreement you will be signing away your right to bring a claim against your employer. It is normal for the agreement to also include a number of other specific clauses. Your employer may look to include such things as a confidentiality clause, a clause that you will not make any derogatory statements about them and possibly certain other restrictive covenants. If these clauses are included then you will not be able to discuss the terms of your package or your employer’s business affairs with any other party, you will not be allowed to make any derogatory comments about your employer and there may be restrictions on your future employment. As the Compromise Agreement has the effect of turning your redundancy package into a ‘full and final’ settlement of any claims that you may have against your employer, it is crucial that you take legal advice on the contents of the it and whether it offers you sufficient compensation for losing your job. The agreement should confirm that your employer will pay your legal advisor’s fees for providing the advice. The Employment Rights Act 1996 states that you must receive advice from someone who is professionally qualified to advise you on the contents of the agreement and that whoever advises you must sign the agreement confirming that you have received the necessary advice. We will advise you upon the terms of the agreement and consider whether the payment you are being offered is higher or lower than what you are entitled to under the law. It is often the case that an employer will offer a higher redundancy payment in return for an employee entering into an agreement, as the protection offered by the agreement to the employer is extremely valuable to them. CONGRATULATIONS to Heswall Primary School for staging their amazing Edwardian Day last month. Children and staff dressed up in traditional costumes for a memorable day which included a street party and children’s entertainment with an Edwardian theme. There was also a fantastic beehive celebration cake to match the school emblem. Organised by the Home School Association to celebrate the school’s 100th birthday, everything ran smoothly - right up to the moment when the heavens opened as the children began their lunch outdoors! However, the downpour certainly didn’t dampen spirits.

ON Sunday 6th September, Marie Curie Cancer Care will be holding its annual Thurstaston Walk for Hope. This popular circular walk will be led from Thurstaston Visitor Centre at 11am, with music provided by the Wirral Pipe Band. This scenic route takes you along the Wirral Way through Heswall, The Dales, The Dungeon and back along the Wirral Way. Marie Curie fundraiser Colette Byrne said: ‘This really is a beautiful walk, and the money raised makes such a difference to the patients and their families. Our wonderful nurses simply couldn’t continue to provide the care they do without the kindness of the people taking part in this type of event’. This promises to be a great family day out and is the perfect opportunity to remember loved ones. So pull on your walking boots and help raise much needed funds to support the Marie Curie Wirral Home Nursing service and the Marie Curie Hospice, Liverpool! The hospice provides specialist medical and nursing care, with the expert help of multi-disciplined healthcare professionals, to over 1,120 local cancer patients each year.
