“I have now been to the public meetings in Heswall Hall and Victoria Hall in Higher Bebington. It is clear that whilst a long lease may be contemplated by Wirral Council, they are not intending to transfer the legal ownership to any community body. The only things that will be transferred will be all the risk and all the liabilities”.

The administration at the Town Hall is seeking to avoid as much expenditure as possible. The result is that they are denying the opportunity for any interested party to reach informed decisions by failing to provide full disclosure of important financial information up front. This approach could jeopardise the future of these facilities and ultimately lead to the permanent closure and disposal of these valuable community assets” Jeff Clarke’s view is supported by Heswall Councillor Les Rowlands who is calling for full disclosure of all relevant financial and structural information as soon as possible. “In order that community groups can assess the viability of their local facility and draw up a business plan they need information now. If the Lib – Lab administration are serious about making this process a success, they would commission up to date structural surveys to be provided together with all relevant financial information to all community groups who express an interest in taking on the running of these facilities. It is still however our preference that this flawed project should be scrapped and we will continue to fight for this outcome”

local news l A FORMER Heswall clergywoman has been appointed to one of the most senior positions within the Church of England. The Rev Canon Dr Judy Hunt is to become an Archdeacon in Suffolk and will take up her new appointment in the autumn. Canon Hunt began as a deacon in Heswall back in 1991 before moving on to rural parts of Cheshire and later taking up more senior roles within the Diocese of Chester. She said: “I leave the Diocese of Chester with many happy memories of fellowship and hard work, as well as fun. The area and its Christian communities have given me great strength and support over the past 24 years as both a lay and ordained person.” The Bishop of Chester, the Rt Revd Dr Peter Forster, said: “Judy has been an outstanding minister in our diocese in a variety of roles.” l PAUL Hanks, from Heswall, went on a 900 mile bike ride to support an armed forces charity. Paul and his future brother in law David Pye cycled around the perimeter of Wales for the Help for Heroes charity, which supports the troops who have been injured in battle. Sweet reward for lollipop lady Janet

LOLLIPOP lady Janet Dean is set to meet the Queen after being awarded an MBE. But the 70-year-old reckons she also deserves some recognition from the sweet manufacturers. Because every child who she safely escorts over Pensby Road gets a Chewitt sweet to send them on their way home. Said Janet: “I think I’ve made a fortune for them over the years. I get through four packets of sweets every day!” Janet has been the lollipop lady in the same spot at the junction with Whitfield Lane for the last 33 years. She began when her children attended Heswall

Primary School when it opened in 1976. She has done the job for so long that she is now crossing her grandchildren at the same place. Despite reaching 70 Janet has no plans to stop, saying that she loves the job, meeting the children and parents and getting to know many of the motorists on the busy road. “I just hope to carry on for as long as I can,” she said. “It’s a lovely school and it’s a nice job to have, particularly when the weather is nice.” Janet says she can’t wait to see the Queen to pick up her award and even joked that she might wear her luminous crossing

outfit at Buckingham Palace. Janet, who lives on Poll Hill, has noticed a big increase in the volume of traffic over the years but proudly boasts that there have been no accidents on her ‘watch’. “It’s a lot busier than it used to be and because it’s a busy junction they can’t put a pelican crossing in,” she added. “Most of the drivers are really good and I’ve got to know many of them over the years.” Controversially, she added: “But there are a few, usually women drivers and people using their mobile phones, who you have to be wary of.”

local news Oldest business breathes new life into the high street

FRESH life has been injected into the high street with a familiar name taking over the old Woolworths store. Heswall’s longest established business, Gould’s the Stationers, had been based at the Castle Buildings since 1937 but last month they took the plunge and moved out. Owner Anne Gould, who started work at the shop as a Saturday girl at the age of 14, said they had outgrown their former premises. She explained that they had been looking to move since January but it had taken nearly five months to secure the lease. The new premises are twice as big, which means that they have been able to expand their range to fill the void left by Woolies with sweets, toys and musical instruments - as well as stationery! The business was started by her great-grandparents in 1904, initially as a printers in West Kirby, before moving to Heswall, and has passed through the generations. Anne said: ““If we hadn’t moved into this store it could have been a competitor. “When I heard it was becoming vacant, I really took to the idea, mainly because of the level of goodwill left by the previous business. It was too good an opportunity to miss.” l Meanwhile, Corks Out opened a new store at 53 Telegraph Road.

Police keep tabs on troublemakers

POLICE have put on extra patrols around the bus station, Puddydale and Tesco to keep an eye on anti-social behaviour. People had reported trouble in the area and asked for action from the police who have since identified 10 young people who gather at the weekends. A spokesman said that at this time of year there is an influx of young people from out of the area coming into Heswall. The Merseyside force have also promised to support the new community centre on Fishers Lane with a drop-in night for young people once a week. It’s a fact: The average lifespan of taste buds is about 10 days.

Wintry weather at summer fair

ST Peter’s CE Primary School had no luck with the weather on the day of their summer fair last month. It bucketed down for most of the day which meant that most of the activities took place indoors or under the cover of a marquee. Nevertheless, there were no shortage of visitors to the event.

LEGAL ADVICE WITH MAXWELL HODGE SOLICITORS

BICYCLE HELMETS: TO WEAR OR NOT TO WEAR: THAT IS THE QUESTION! A RECENTLY decided case in the High Court made important observations upon the merits or otherwise of the wearing of a cycle helmet. In that case, the bicycle rider sued (via his wife since he sustained serious head injuries) the rider of a motorbike who he alleged drove at speed into collision with him whilst he was waiting to turn right off a major road, causing him very serious injuries, not least to his head. He suffered brain injuries. He had not been wearing a helmet at the time of the accident.

There was an issue about who caused the accident and conflicting accounts in this regard but the important issue was that, despite finding the motorcyclist 100% responsible for the accident, the Judge went on to say that, even though there is no legal requirement for the wearing of a cycle helmet nevertheless, if the guilty driver (or rider in this case) could prove that the cyclist’s injuries would have been less severe than they turned out to be had the he been wearing a helmet, then there may be a decision that he was partly responsible for his own accident. In other words, the cyclists’s compensation may be radically reduced by virtue of not having worn a helmet at the time of the accident.

The principle is already applied in road traffic accidents where the injured party had not been wearing his seat belt at the time of the accident. Normally the deduction from compensation will be 25% although the percentage will vary dependant upon the circumstances. However, the difference here is that the wearing of seat belts is a legal requirement for the driver and, since September 2006, all passengers. The wearing of cycle helmets is entirely voluntary.

As it happened, in the case mentioned above, the Judge decided that, as the impact for the cyclist had been at greater than 12 miles per hour, in fact, whether or not the he had worn a helmet, it would have made no difference whatsoever to the injuries sustained. In other cases, on different facts, the position may be different. It must still be a matter for individuals as to whether or not they should wear a helmet but the safe approach, one would have thought, is to do so since in anything other than a major crash the helmet will afford some, albeit limited, protection. Lambanana needs a good home THE family of a seriously ill man want to find a good home for their Beatles lambanana. The sculpture has been in Maria and Paul Challis’s Wirral garden for quite some time but the couple are anxious to find it a permanent home. Paul is gravely ill and Maria is keen to carry out his last request. She said: “We are looking for a more permanent home for our John Lennon lambanana.
