Silverio at Nicolas tutol sa Right of Reply Bill NI DINO BALABO BULAKAN, Bulacan — Dalawa sa anim na kongresista mula sa lalawigan ng Bulacan ang tutol sa isinusulong na right of reply bill na umani naman ng pagkondena mula sa hanay ng mga mamamahayag sa bansa at maging sa ibayong dagat. Pinag-aaralan pa ng isang kongresista mula sa Bulacan ang nasabing panukalang batas, samantalang ang dalawa ay hindi pa nakapanayam ng Mabuhay. Ang isa naman sa anim na Bulakenyong mambabatas ay lumagda sa ulat ng Committee on Public Information ng Mababang Kapulungan ng Kongreso na nagsuri sa Right of Reply bill. Busal kay Plaridel ISANG malinaw na pagbubusal sa malayang pamamahayag ang layunin ng panukalang batas na “right of reply” na isinusulong sa Kongreso ni Kint. Monico Puentevella ng Bacolod at ni Senador Aquilino Pimentel Jr. sa Senado. Isinasaad ng panukalang batas na kailangang ilathala ng mga pahayagan o isahimpapawid ng mga istasyon ng radyo at telebisyon ang sagot ng sinumang taong naakusahan o nabatikos nila ng di tama sa lalong madaling panahon, patas na espasyo o haba o tagal ng sinasagot na ulat, pahayag o komentaryo. Kung hindi ito matutupad, magbabayad ng multa hanggang P200,000 o kaya’y maaaring makulong ng hanggang 30 araw ang mga patnugot ng pahayagan o station manager ng himpilan ng radyo at telebisyon. Bukod sa mga bantang ito laban sa mga bumubuo ng mga pahayagan at kompanya ng radyo’t telebisyon, maaari ding isuspinde sa loob ng 30 araw ang pahayagan o himpilan, kung hindi man ay ipasasara. Ayon sa mga mambabatas na nagsusulong ng panukalang right of reply bill, ang nais lamang nila ay maging patas ang pamamahayag at mabigyan ng “equal time and space” o patas na oras at espasyo ang mga taong naakusahan o nabatikos para tumugon sa mga balitang hindi pumasa sa kanilang panlasa. Ngunit para sa mga mamamahayag na inapo ng Bulakenyong si Gat Marcelo H. Del Pilar na mas kilala sa taguring “Plaridel” at itinuturing na ama ng malayang pamamamahayag sa bansa, ang panukalang batas sa “right of reply” ay istupido at labag sa itinatakda ng Saligang Batas ng Pilipinas. Malinaw ang itinakdang garantiya sa Artikulo III, Seksyon 4 ng umiiral na Saligang Batas ng bansa na “walang batas na dapat ipasa na susupil sa kalayaang magpahayag at malayang pamamahayag.” Malinaw din na hindi na kailangan pang magpatibay ng batas para mabigyan ng patas na oras at espasyo ang mga nababatikos dahil sa ang bawat pahayagan at himpilan ng radyo at telebisyon ay laging bukas para sa opinyon at pananaw ng sambayanan lalong higit sa mga nabatikos. Bukod dito, ang mga mamamahayag ay may sinusunod na code of ethics o patakaran para sa balanse o patas na pamamahayag. Kung hindi naman nabigyang pagkakataon na malathala o maisahimpapawid ang tugon ng mga nabatikos, bukas din ang pintuan ng mga Citizens Press Council kung saan ay maaari silang maghain ng reklamo laban sa mga mamamahayag, pahayagan o himpilang umabuso sa kanilang pagkatao sa pamamagitan ng di makatarungang pagbabalita. Mahigit 100 taon na ang nakakaraan mula nang ipalabas ni Plaridel ang satirikong babala na “Caiigat cayo” na sinundan pa niya ng pahayag na “hindi nabubusalan ang katotohanan.” Ang mga babala at pahayag na ito ni Plaridel ay binibigyang buhay at higit na kahulugan ngayon ng panukalang batas sa “right of reply” na kapag natuluyang napagtibay ay magsisilbing busal sa malayang pamamahayag sa bansang ang kalayaan ay utang sa mapagmulat na panulat na inilathala ng mga mamamahayag na katulad ni Plaridel. Pagpaparehistro sa bagong botante MAAARI nang magparehistro ang mga bagong botante na sasapit sa kanilang ika-18 taong gulang bago dumating ang halalan sa Mayo ng susunod na taon. Ito ay batay sa Resolution No. 8514 ng Commission on Election na ipinahayag noong Nobyembre 12, 2008. Ginawa ang pagbabago ng nasabing resolusyon upang mabigyan ng malaking pagkakataon ang mga magpaparehistro, lalo na ang mga mag-aaral at mga namamasukan. Magkagayon man, hindi kabilang ang mga araw ng Sabado de Gloria at, siyempre, Huwebes at Biyernes Santo sa mga araw ng pagpaparehistro. Niliwanag na ang pagpaparehistro ay gagawin sa lahat ng rehiyon, maliban sa Autonomous Region ng Mindanao. Subalit ang mga hindi pa sasapit sa takdang gulang sa pagboto sa kasalukuyan, ngunit sasapit sa legal na panahon ng pagboto sa Mayo 10 ng kasalukuyang

Pamana ng EDSA Revolution HINDI na raw tatanggapin ng mundo o bibigyang-halaga ang isa pang EDSA Revolution, pahayag ni Pangulong Macapagal-Arroyo, sa pag-aalay ng korona sa Libingan ng mga Bayani sa pagsisimula ng taunang paggunita sa napabantog na Edsa People Power Revolt noong Pebrero 22. Sa pagsusuri, ang pahayag ni GMA ay tanda pa rin ng pagkatakot ng Administrasyong Arroyo sa aali-aligid na banta ng isang tahimik na pag-aalsa ng mamamayan — tulad ng nagpabagsak, una, sa rehimeng diktadurya ni Marcos at, ikalawa, sa pamamahala ni Erap Estrada. P’wede bang hindi alam, hindi man inaamin, nina Gng. Nagsimula ang krisis natin nang sirain ni Aling Gloria ang kanyang salitang hindi na siya kakandidato sa pagka-Pangulo, “yamang alam kong ako ang magiging dahilan” aniya, “ng pagka-

Ang Expanded Value Added Tax (E-VAT), kasama ng may $17-bilyong remittance na tinumbasan ng mga OFW ng pagtitiis na malayo sa mga mahal sa buhay, pagtatrabahong parang kalabaw, pagkabulid ng mga Pinay sa prostitusyon, pagmamalupit at panggahasa sa kanila ng mga banyagang employer, pagkabilanggo o pagkabitay — ito ang ipinagyayabang ng Administrasyong Arroyo hangga ngayon na nagpatatag daw sa ekonomya ng Pilipinas. Dahil din dito kaya hindi tayo masyadong naapektuhan ng pandaigdig na krisis sa pananalapi. Ang propaganda ng panlilinlang ay hindi nakatakip sa pagsasamantala at pagkunsinti sundan sa pahina 7

A deficit of decency SMUDGED truth smothers the controversy triggered by World Bank’s blacklisting of seven Filipino and Chinese firms. They rigged bids for road projects, the Bank’s Department of Institutional Integrity found. Over two years, bank investigators questioned 60 witnesses. They found over $45 million had been skimmed by a cartel. (Ombudsman Merceditas Gutierrez didn’t even get beyond “preliminary enquiries.) Blacklisted were: E.C. de Luna Construction Corp; Cavite Ideal International Co. Ltd; and CM Pancho Construction Inc. “Public officials took a managing role” as a Department of Public Works “corrupted to the core … arranged contracts be awarded in exchange for bribes,” the report said. The cartel enjoyed “support at the highest level of the Philippines … even reaching the President’s husband,” wire agencies reported. Reps. Roger Mercado, Milagros Magsaysay, Elpidio Barzaga and other House public works committee members protested. In a rushed-one day hearing, they

ignored excerpts of the World Bank report, then available. They endorsed testimony by public works officials implicated in the scam. The committee “absolved” the firms of collusion. Not content, they insisted the blackballed firms continue to land contracts. Nor did they craft remedial legislation. That jettisoned the role of hearings as “aid to legislation”. The committee turned “laundromat”, an Inquirer editorial said. These tax-funded circuses have near-zero credibility. Goodhousekeeping seals of approval, by thieves, is ignored by international agencies. The World Bank, in this case, refused to sign more checks. This farce, the acerbic columnist Solita Monsod wrote, is “surreal”. That’s inevitable with hollow men who no longer blush since they can’t differentiate lies from truth. Such people act as if “Ignorance is strength. Freedom is slavery. And war is peace”, George Orwell wrote in his novel, 1984. Yet, congressional hearings were, “once upon a time,” a valu-

able tool. That required legislators of integrity. But where we had a Lorenzo Tañada, today there’s Miriam Santiago. Besides an Emmanuel Pelaez, Jinggoy Estrada shrivels to pygmy statute. Bong Revilla couldn’t hold a candle to a Jovito Salonga. So, why do these tax-funded circuses still run despite almostzero credibility? They don’t aid legislation. Nor do they seek truth, let alone justice. Welcome to a post-graduate tutorial in Propaganda 401. Behind parliamentary immunity’s skirts, ill-;prepared legislators browbeat witnesses. They smear recklessly as they preen before cameras. They hew to the Alice in Wonderland rule: “What I tell you three times is true.” Don’t our honorable legislators hear decent citizens retching? Recall the witch-hunting Senator Joseph McCarthy at the June 1954 Senate Army hearings. “Have you no sense of decency, sir, at long last?” Joseph Welch asked McCarthy. “Have you no sense of decency left?” continued on page 7

A dangerous moralism IN one of the books he wrote before becoming Pope, Benedict XVI warned us about what he called “political moralism.” It’s not something that is altogether wrong. There are a lot of good things in it. But it misses one essential element. These are his words: “A new moralism exists today. Its key words are justice, peace, and the conservation of creation, and these are words that recall essential moral values, of which we genuinely stand in need.” We can not deny that these big words glut most slogans, catchwords and battle cries these days. If you’re supposed to be socially concerned, it’s de rigueur and politically correct to shout these words. Here’s the catch: “But this moralism,” the Pope continued, “remains vague and almost inevitably remains confined to the sphere of party politics, where it is primarily a claim addressed to others, rather than a personal duty in our own daily life.” In other words, these beautiful concepts tend to be uprooted

from God, their source and origin, and pirated by self-appointed prophets and ideologues who cleverly mask their ideas as God’s will, and hardly apply the implications of these words on themselves first before applying them on others. Benedict’s observation reflects a spreading and disturbing phenomenon of people who are good in the art of rhetoric and persuasion but miserably fail in consistency and integrity. Two danger signals can be noted here. One, the good intention is hardly rooted on God’s will. It’s more on one’s or a group’s designs, projected as God’s designs. And two, the requirements and changes involved are to be expected more from the others than from oneself. Again the words of the Holy Father: “The political moralism we have experienced, and still witness today, is far from opening the path to a real regeneration. Instead, it blocks the way. “Consequently, the same is true of a Christianity and a the-

ology that reduce the core of the message of Jesus, that is, the ‘kingdom of God’, to the ‘values of the kingdom’, identifying these values with the great slogans of political moralism while at the same time proclaiming that these slogans are the synthesis of the religions. “In this way, they forget God, although it is precisely he who is both the subject and cause of the kingdom. All that remains in the place of God are the big words and values that are open to any kind of abuse.” The combination leads to an anomalous situation that, in spite of one’s or a group’s best efforts, can only produce more tension, division and conflict. Relevant to this, the Pope has this point to say: “Our greatest need in the present historical moment is people who make God credible in this world by means of the enlightened faith they live. ‘Whatever ...’ “HEY, Dylan!” I called out to the student crossing from the other side of the street. “Hi, Father!” he waved back and started coming towards me. “Your exams have finally ended! With a long weekend ahead of you, dude, what are you planning to do?” I asked. “Whatever, Father,” he shrugged his shoulders and rolled his eyes to show he was totally uncertain about how to spend his weekend. “Whatever, what?” I asked even though I understood he was still quite dazed from lack of sleep preparing for his comprehensive exams. “I really dunno, Father. Whatever, whatever …,” he gave me a zombie-like stare. “Hey, dude! I know you’re tired, but I believe you can say something better than ‘what-

ever’.” “Like what, Father?” “What about completing the sentence by saying, Whatever God wants?” He smirked and said, “In that case, Father, I’ll go play Frisbee with my barkada.” *** AMONG the many things that intrigue me, — and perhaps, continue to make me feel young — is my exposure to the idealism of the youth. As they mature out of the delicate shell of adolescence, they are motivated to improve the negative elements within the social and cultural fabric they grew from. This ideal is common among those who have been fortunate to experience virtue and good example in their family and other social engagements. Today, however, more young people are born into families that

no longer nurture the values they need in order to mature in virtues. Moreover, the world’s technical and socio-economic wave is drowning them to think within very limited and virtual confines. This is perhaps one reason that it’s hard for them to make choices even in their spiritual life and commitments. But this is not the end of their spiritual itinerary! St. Josemaría Escrivá, who was a priest who always maintained a youthful outlook taught: “It is not true that everyone today — in general — is closed or indifferent to what our Christian faith teaches about man’s being and destiny. It is not true that men in our time are turned only toward the things of this earth and have forgotten to look up to heaven.” (Christ is Passing By, 132) We, therefore, must not be discontinued on page 7

Defy old age: Live longer THE Bible recorded the oldest living man through these words: “When Methuselah had lived 187 years, he became the father of Lamech. And after he became the father of Lamech, Methuselah lived 872 years and had other sons and daughters. Altogether, Methuselah lived 969 years, and then he died.” (Genesis 5:25-27) Through the years, people have been trying to figure out how to live longer, just like Methuselah. In fact, many people in different parts of the globe at different times in history made it their life’s obsession. Ponce de Leon’s quest for the mysterious fountain of youth led him to discover Florida. With its sunny weather, beautiful beaches, and palm trees, Florida in itself is a kind of fountain of youth. Many Americans today who retire to Florida do seem to recover their youthful energy and vigor. In 1808, Johann Wolfgang von Goethe wrote of a 14th century alchemist, Faust, who sold his soul to the devil in exchange for a youth-restoring potion. As expected, Faust came to an unpleasant end. No one lives forever, for sure. But this fact doesn’t stop doctors and scientists to search for ways how to live longer. “Aging is the progressive accumulation of changes with time associated with or responsible for the everincreasing likelihood of disease and death which accompanies advancing age.” That statement comes from Denham Harmon, one of the leading experts in the field of anti-aging research. In recent years, people have been living longer — thanks to science. But, on second thought, merely living longer isn’t good enough. What people want these days is not just living longer, but also living healthier lives. Who

wants to live longer if it means just existing, unable to enjoy life? “A wise man should consider that health is the greatest of human blessings, and learn how by his own thought to derive benefit from his illnesses,” wrote Hippocrates, the father of modern medicine, centuries ago. Dr. Steven G. Aldana of Brigham Young University recently revealed that a person may be able to add 20 years or more to his or her life by making several health changes. “People don’t have to completely turn their lives around to get significant benefits,” Dr. Aldana said. Example: Someone who exercises for 30 minutes six times a week can gain 2.4 years of life, even if that person doesn’t adequately control his blood pressure. But not smoking is probably the most important change. “Men who smoke a pack a day lose an average of 13 years of life, while women lose 14 years,” he commented. Every year, there are about 20,000 smoking-related deaths in the Philippines, where about 60 percent of men smoke. Excess weight greatly increases the risk of cancer, diabetes and hypertension. A person who is 20 pounds over his/her ideal weight is 50% more likely to develop heart disease — and the risk increases as weight increases. In simpler terms, shed those extra pounds by doing regular exercise. People who engage in moderate exercise at least three to five times a week can reduce their blood pressure by an average of 10 points and dramatically lower their risk of diabetes. A study at the Cooper Institute for Aerobics Research in Dallas, Texas showed that men who ran, walked briskly, swam, jogged, or continued on page 7

ACCORDING to the surveys, the three most important human needs or concerns of Filipinos nowadays are livelihood, peace and order and standard of living. To that, I will add food security, which I think is also important. There is a new interpretation of “wellness” that is emerging nowadays. This interpretation expands the original scope of “wellness” to cover not just “physical wellness”, but also “spiritual wellness”, “financial wellness” and “environmental wellness”. The Human Development Index (HDI) of the United Nations measures annual increases or decreases in per capita income, life expectancies and literacy rates. To that, I think that we should also add and measure the annual “eco-safety” scores of member countries. There appears to be no existing method of measuring the ecological safety scores of countries as of now. Towards this goal, I think that we could come up with a general weighted average for particular scores in water safety, air quality and soil or land cleanliness. Personally speaking, I think that we should pass and implement certain sets of national

standards that would ensure and support the human needs of our country in relation to the broadened meaning of wellness and the expanded HDI measures. To be more specific, I could see that a national standard for organic agriculture would support our physical wellness. A national standard for intelligent infrastructure would support our spiritual wellness, because it would feed our minds in a way that would uplift our spirits. A national standard for light manufacture or clean manufacturing would support our financial wellness, because it would create new jobs in urban areas aside from supporting urban renewal. And lastly, a national standard for green architecture would support our environmental wellness, because it would improve the ecological safety of our buildings and surroundings. Summing it up together, livelihood would give us financial wellness, boosted by light manufacture standards, and it would also increase our per capita incomes. Food security would give us physical wellness, boosted by organic agriculture standards and it would also increase our life expectancies. A better standard continued on page 7

SAGOT: Maraming salamat po sa e-mail na ito. Sa ilalim ng Family Code of the Philippines, bagamat hiwalay na ang mag-asawa, kahit gaano katagal, nananatili ang kanilang pagiging mag-asawa. Hindi kasi napapawalang-bisa ang kasal ng magasawa kung sila ay hiwalay na sa isa’t isa. Kakailanganin po ang kautusan ng hukuman, matapos ang paglilitis, na nagsasabing balewala na ang kasal ng mag-asawa. Kung mag-aasawa ang sinuman sa kanila habang buhay pa o may bisa pa ang unang kasal, magkakaroon po sila ng pananagutang kriminal para sa kasong bigamya, daan upang sila ay makulong ng hanggang anim na taon, humigit-kumulang. Hindi din po maaaring gamiting dahilan ang pagbubuntis ng babae sa ibang lalaki upang ang lalaking asawa ay mapayagang makapag-pakasal na sa iba. Kahit nabuntis na ang babae sa ibang lalaki, wala pa ding karapatan ang lalaki na magpakasal sa ibang babae naman. Kailangan po ang pagsasampa ng kaso sa husgado, upang ang hukuman ang siyang magpapasya kung dapat na nga ba, o hindi pa, na madeklarang wala nang bisa ang naunang kasal. Dahil diyan, ipapayo ko pong bago kayo magpakasal sa bagong asawa, kailangan po ninyong ipabalewala muna ang kasal ninyo sa unang asawa, at, kung naging pinal na ang kautusan ng hukuman na kumakatig sa pagpapawalang-bisa ng inyong kasal, doon pa lamang kayo magkakaroon ng karapatang mag-asawang muli. Pangangapkap ng mga batang mababa ang edad sa 15 taon TANONG: My nephew who is an elementary student — about 10 years old — was wrongfully accused of shoplifting. He was with his 11-yearold brother and their mom doing the grocery when the guard accused the little boy of stealing. My sister, of course, got furious with the accusation and refused to have her son searched but the store watcher insisted that he saw the boy put two items in his pocket so the guard pulled the kid from the mother and started to search the poor boy who was too shocked to defend himself and he started to cry. Not finding anything in his pocket, the guard proceeded with looking into the boy’s inside pants — inside his underwear — which violated the child. My sister got very furious and as any mother would have done started to curse the guard and watcher and the supervisor who sided with her two staff. Since nothing was found from the poor kid, they started to gang on the elder brother and accused the elder, who is a year older, to be the one shoplifting. The elder who did not want to subject himself to the

same humiliation and violation that the younger brother received volunteered to empty his pocket which revealed his comb and an empty Hansel pack which he consumed before they got to the grocery store. Now the supervisor changed their story into accusing the elder brother to have eaten the biscuit inside the store — which of course is absurd, how can anyone start eating item inside a small grocery store without getting caught? My question is what are the rights of the child in cases like these? We are bent on finding justice for my nephew who got violated at a very young age. Personally, I consider it a child abuse for any adult to be looking inside a child’s and see his private parts. Do these establishments even have rights to search children or anyone accused of shoplifting when they feel like doing so? My sister went to the San Pedro Laguna Women’s Desk that same night — Saturday — but she’s confused why the police officer only took note of the guard’s name when she has given the supervisor’s name for police blotter. The police officer said she has to come back on Monday to have it filed. She went back the following day — Sunday — to have the supervisor’s name and the establishment included in the police report. But the officer-of-the-day said she has to wait for Monday to have the report added by the officer who attended to her last Saturday since she’s not the one who attended her. Is that how blotter is supposed to work? Apologies if my case is confusing as at this point we really are at a loss on how to proceed with this situation. We feel that the police are not fully assisting us with the continued delay in including the establishment and the supervisor’s name. Hope you can shed light to our case and give us a direction as we do not have any legal connections and are still looking for a lawyer to best represent the interest of our nephew and get justice. How to care for the ocean WE know that we live and survive in a planet because it supplies our most vital needs and we all know that one of these needs is the ocean water. Well, most of the animal population dwells in the blue deep. We humans also needed water to survive. We could survive a month without food but we could only survive a week without water. That proves that we really need water. We all know that we humans are the ones that destroy these liquid blessings. We destroy the ocean water by accidental oil spills, cyanide fishing which kills fishes and the corals that they thrive in, the dangerous dynamite fishing, and the never-ending case of throwing garbage in aquatic areas, to name a few. Well, there are many ways to prevent the destruction of the ocean water. The greatest contribution that you can make is that you just stop throwing waste materials in the ocean, especially those that are non-biodegradable. You may also tell some fishermen not to use dynamite, cyanide, and other potential hazards. In conclusion, to save the ocean, we do not need ways for what we need is the will to save it. Well, I hope that I’ve inspired you to care and save the ocean.

Kampanya laban Kill (this) ‘Right of Reply’ Bill sa ‘Right of Reply’ NI DINO BALABO LUNGSOD NG MALOLOS — Katulad ng apoy, mabilis na kumalat ang pagtutol at panawagan ng mga mamamahayag laban sa panukalang right of reply bill dahil sa pananaw na labag iyon sa umiiral na Saligang Batas ng bansa. Pinangunahan ng ng National Union of Journalists of the Philippines (NUJP) ang paglulunsad ng kampanya sa pangangalap ng mga lagda bilang pagtutol sa nasabing panukalang batas. Sa kasalukuyan, mahigit sa 200 mamamahayag na sa buong bansa ang lumagda at marami pa ang nadadagdag bawat araw. Sinuportahan naman ito ng iba’t iba pang samahan ng mga mamamahayag katulad ng Center For Media Freedom and Responsibility (CMFR), Philippine Press Institute (PPI), Institute for War and Peace Reporting (IWPR) at maging ng mga mamamahayag sa Bulacan at Gitnang Luzon. Isang maling lehislasyon Ayon sa nagkakaisang pahayag na ikinalat at pinalalagdaan ng NUJP, ang right of reply ay isang maling lehislasyon dahil nilalabag nito ang kalayaang magpahayag na ginagarantiyahan ng Saligang Batas. “The danger in the right of reply bill is that it would legislate what the media OUGHT to publish or air, while casting a chilling effect that could dissuade the more timorous from publishing or airing what they SHOULD,” ayon sa NUJP. Binigyang diin pa na “the bills would free public officials, especially the corrupt — and they are legion — of accountability and give them carte blanche to force their lies on the suffering public.” Iginiit din ng NUJP sa kanilang hiwalay na pahayag sa pinalalagdaang kampanya na mas makabubuting ibasura ang nasabing panukalang batas. Inayunan naman ito ng CMFR na nagpahayag din na ang katulad na batas ay ibinasura sa Amerika. Nagbabala rin ang CMFR na kung mapagtitibay ang nasabing batas ay nahaharap sa mas malaking problema ang mga mamamahayag sa pagsapit ng 2010 elections. “CMFR not only predicts that if a right of reply bill is passed, 2010, an election year, will be especially problematic for the media in terms of dealing with demands for replies,” ayon sa CMFR. Nagpahayag din ng pagtutol sa pamamagitan ng paglagda sa nasabing pahayag ng NUJP ang mga mamamahayag na kasapi ng Bulacan Chapter nito. Ang mga kasapi ng Central Luzon Press Council ay lumagda din. Pinaplano din ng dalawang grupo ang pagsasagawa ng mga forum para sa mga mag-aaral hinggil sa right of reply bill upang higit na maipaunawa ang banta nito sa malayang pamamahayag. Ang panukalang batas ay isinusulong sa Kongreso ni Kint. Monico Puentevella ng Bacolod at ni Senador Aquilino Pimentel. Ito ay naglalayon na mabigyan ang sinuman ng karapatan para sa patas na espasyo sa pahayagan o oras sa himpapawid upang sagutin ang naging pagbatikos o akusasyon laban sa kanila. Bukod dito, ang nasabing panukalang batas ay naglalaman din ng mga parusang pagmumulta hanggang P200,000 o pagkakabilanggo hanggang 30 araw, o pagkansela sa lisensiya ng pahayagan o himpilan ng radyo at telebisyon, o di kaya ay tuluyang pagpapasara sa kanila. Para sa mga mamamahayag, hindi na kailangang isabatas pa ang nasabing karapatan dahil kasalukuyan namang tumatanggap ng mga “letter to the editor” ang mga pahayagan. Bukod dito, iginiit ng mga taga-media na malinaw na labag sa Saligang Batas ang right of reply bill.

Many people in the media are concerned with the prospects and implications of Senate Bill 2150 being passed as is very likely: For their part, the Bill’s originators and sponsors claim the media are overreacting. Readers can read the Bill here as it is posted on the Senate website and decide for themselves. Yes it’s a very quick read: It is less than 350 words in length and only takes a minute or two to read: A flippant person might suggest it probably only took a moment longer to write. Bizarrely, such criticism — flippant or not — will no longer be deemed to be “fair comment”. Now such a dismissal can be penalized under the terms of the new Bill when it becomes law. So too can such criticism contained in any email or text message — though how the right of reply will actually work in these cases is not clear. But the main question is “why the need for such a law?” Doesn’t the Philippines already have libel and slander laws? If they are deemed ineffective they should be revised. What should not happen is the introduction of a catch-all law that is so badly conceived and written that it can be used to target free expression. Oops. Criticism again …

Traditionally, acts of parliament in democracies the world over are subject to a long drawn out process of scrutiny, debate and development to ensure the final result is appropriate, comprehensive and exact. Unfortunately 2150 is none of the above. The reason bills typically come out the way they do is that many politicians the world over are former lawyers and are very careful and precise about each and every word. This Bill by comparison is incredibly sloppy (oops) — and is open to all manner of interpretation. It is a license for chaos and bully pulpits. The reported suggestion made by somebody this week during a Manila roundtable that it is an “act of terrorism” against the media is silly — yet it is true to say the Bill can very easily be manipulated to effectively silence dissent. Newspapers and radio stations, TV stations can effectively be gagged by gangs of wily politicians and businessmen who may seize on a Bill such as this to neutralize all criticism and legitimate debate. Let us say a politician or several politicians are rightly and objectively criticized for a series of bad decisions, poor management, incompetence, or worse on the front page of a daily newspaper in the lead story. The following day, the lead story is a complex and lengthy rebuttal and platform for one of the people

criticized. The next day, the lead story is written by another of the people criticized. The following day so on … and what happens if one of the politicians refers to a third person who is not happy with what has been written? He or she too then gets to use the front page. Where will it stop? And in the meantime, where will the news and all the readers and the advertisers go? What will happen to the media? What will happen to the role of the media being monitors and guarantors of society? What will happen to those in the media who are trying to expose corruption and malfeasance? What a nightmare. What a mess. And if the media do not do as instructed by the Bill? They are repeatedly fined with the penalties rising each time. The originators of the Bill say the media have nothing to be worried about. Oh really? Legislators are right to voice concern over the behavior of some radio commentators — so-called block timers — and libelous, inflammatory and malicious reporting. This should be addressed through the courts and perhaps, too, the licensing system of radio stations. Station managers and owners need to be held liable and accountable for what they allow to be broadcast. Absolutely — with free

expression comes media responsibility. Absolutely — the lawmakers are right on that. But we should not forget that politicians do not help by renting air time and block-timers to dish the dirt on their opponents during election campaigns. But this Bill is no way to go forward. It is not fit for its purpose and has no place in a democracy. And right now and as many people are increasingly saying, the Philippines needs all the transparency and good investigative reporting it can get. It would be interesting to know the views of the international community based in Manila on this Bill. Will it help or hinder development and governance? Don’t shoot the messenger. Don’t blame the bringer of bad news. This adage is as old as language and literature itself — being first coined by the Greeks. Everybody knows it save, it seems, the lawmakers. Is this Bill really necessary to protect people — or does it just help to protect politicians and the business community from unwanted inspection? Former Palace Press Secretary Jesus Dureza who is reportedly a fan of the Bill has been quoted on record as admitting, “Actually you don’t need a law for this.” I don’t think any rightminded person who believes in good and transparent government and a free society could agree with him more.

Kinondena naman ng mga samahan ng mga mamamahayag sa bansa tulad ng National Union of Journalists of the Philippines (NUJP), Center for Media Freedom and Responsibility (CMFR), Philippine Press Institute (PPI), Institute for War and Peace Reporting (IWPR) at mga kinatawan ng mga pangunahing pahayagan at himpilan ng radyo’t telebisyon. Maging ang mga samahan ng mamamahayag sa ibayong dagat at pati mga mamamahayag sa Bulacan at Gitnang Luzon na nagsusulong ng Citizen’s Press Council ay sumuporta din sa pagtutol sa right of reply bill. Ayon sa opisyal na pa-

hayag ng CMFR, ang isinasantabi ng panukalang batas ay ang pangingibabaw ng pananaw at desisyon ng mga patnugot ng mga pahayagan at news broadcasting station o channel sa pamamagitan ng pagdidikta kung ano ang dapat ilathala o isahimpapawid. Binigyang diin din ng CMFR na labag sa umiiral na Saligang Batas ang right of reply bill dahil nakasaad sa Article 3, Section 4 ng 1987 Constitution ang garantiya na walang batas na dapat ipasa para supilin ang karapatang magpahayag at ang malayang pamamahayag. Para naman sa NUJP, ang right of reply bill ay magagamit sa pag-abuso at panunupil. Sinabi pa ng NUJP sa

opisyal na pahayag nito, “Enacting a law on the right of reply distorts this right to favor politicians who are oversensitive to criticism. It is this attempt to caricature a political right to favor those in power that we in media are critical of.” Inayunan naman ito ng ilan sa mga kasapi ng NUJP-Bulacan Chapter at ng ilan sa mga bumubuo ng Citizen’s Press Council of Bulacan na nagsabing dapat nang ibasura ang panukalang batas. Sinabi rin nila na hindi ang right of reply bill ang dapat tutukan ng Kongreso, Senado at ng gobyerno sa kabuoan, sa halip ang pagtugis sa mga taong nasa likod ng pamamaslang sa mga kapwa nila mamamahayag.

Pagkatay sa 6,000 baboy sa Pandi ’di naging madali NI DINO BALABO LUNGSOD NG MALOLOS — Hindi naging madali para sa mga opisyal ang pagbuo ng desisyon kung paano kakatayin ang 6,000 baboy na hinihinalang may ebola reston virus sa bayan ng Pandi, Bulacan dahil sa batas na tinaguriang Animal Welfare Act. Ang mga nasabing baboy na matatagpuan sa isang babuyang isinailalim sa quarantine sa Pandi ay nakatakdang katayin sa Pebrero 28 dahil, ayon sa pagsusuri ng mga dalubhasa, ay patuloy ang pagkalat ng sakit na dulot ng ebola reston virus. Ayon kay Dr. Joy Gomez, provincial health officer na siya ring tagapagsalita sa lalawigan hinggil sa kaganapan sa pagsugpo sa virus, ang pagkatay sa mga baboy ay batay sa payo ng mga dalubhasang nagsagawa sa pagsusuri sa dugo ng baboy at tissue samples na kinuha sa mga atay at lalamunan ng baboy noong Enero. Kabilang sa mga nagsagawa ng pagsusuri ay mga dalubhasang nagmula sa World Health Organization (WHO), United Nations Food and Agriculture Organization (UN-FAO), World Organization for Animal Health (OIE), at Department of Agriculture (DA) na nagpadala ng tissue samples sa Center for Disease Control (CDC) sa Amerika at sa Regional Institute for Tropical Medicine (RITM) sa Maynila. Batay sa ulat ng mga dalubhasa, kumakalat pa ang ebola reston virus sa babuyan sa Pandi at umabot na sa apat na katao ang kanilang nasuri at natuklasang nahawa, ngunit sila ay naka-develop ng “anti-bodies” laban sa ebola reston virus kaya’t hindi nagkasakit. Gayunpaman, patuloy pa ring tinutuklas ng mga dalubhasa kung paano nahawahan ng ebola reston virus ang mga tao. Sa pakikipanayam ng Mabuhay kay Dr. Gomez sa telepono noong Pebrero 25, sinabi niya na hindi naging madali ang pagbuo nila ng mga hakbang kung paano kakatayin ang 6,000 baboy na kinabibilangan ng mga biik, inahin, bulugan, at mga patabain dahil sa ikinunsidera nila ang nilalaman ng Animal Welfare Act. Isinasaad kasi ng batas, aniya, na hindi maaaring maging brutal ang pagpatay sa mga hayop. Dahil dito, napagkasunduan ng mga opisyal na dumalo sa pagbuo ng mga hakbang sa pakatay sa mga baboy na gumamit ng stunning gun at kalibre .22 na baril na tinatanggap ng Animal Welfare Act. Ayon sa impormante ng Mabuhay, ang mga baboy ay babarilin sa ulo gamit ang kalibre .22 upang madali ang pagkamatay

ng hayop, kung hindi mamamatay kapag ginamitan ng stunning gun. Ang stunning gun ay ang pagpapaputok ng baril sa ulo ng baboy na walang bala. Ayon sa mga dalubhasa, ang baboy ay namamatay kapag pinutukan sa ulo kahit walang bala dahil nagkakaroon iyon ng internal hemmorage sa ulo. Ayon kay Dr. Romeo Manalili, ang pang rehiyong beterinaryo, tatlong isyu ang kanilang kinunsidera sa pagpatay sa 6,000 baboy sa Pandi, at sa pagsasantabi ng mga labi nito. Sinabi ni Dr. Manalili na kinunsidera nila ang pagiging “humane” o mahinahon sa pagkatay sa mga baboy, ang proteksyon ng kalikasan at ang kalusugan ng tao. Sinabi niya sa Mabuhay nang siya ay makapanayam noong Pebrero 25 sa telepono na ang mga papatayin na baboy ay susunugin at ililibing sa 10 hukay na may lalim na 15 talampakan, at may luwang at haba na tig-30 talampakan. Inayunan naman ito ni Provincial Health Officer Gomez at sinabing kinunsidera rin nila ang isinasaad ng Clean Air Act at Clean Water Act. Sinabi niya sa Mabuhay na ayaw nilang magkaroon ng panibagong problema matapos matuklasan ang problema sa ebola reston virus. “Isa iyan sa mga dahilan kaya kasama namin ang mga taga-DENR para mas malinaw sa amin ang aming gagawin, dahil kukuha rin kami ng mga clearance sa kanila,” ani Dr. Gomez. Matatandaan na noong nakaraang linggo ay nagpahayag sina Gomez at maging si Gob. Joselito “Jon-jon” Mendoza na malapit nang tanggalin ang quarantine sa isang babuyan sa Pandi matapos matuklasan doon ang ebola reston virus noong Disyembre. Ang ebola reston virus na karaniwang nakikita sa mga unggoy ay natuklasan din sa mga baboy sa kauna-unahang pagkakataon noong Disyembre matapos magpadala ng mga tissue sample sa CDC sa Amerika ang mga magbababoy sa Bulacan upang matukoy kung anong strain ng procine respiratory and reproductive system virus ang naging sanhi ng pagkamatay ng baboy sa Bulacan noong 2007 at 2008. Ang ebola reston virus ay isang uri ng “filo virus” na animoy hibla ng sinulid. Ito ay kauri ng kinatatakutang ebola virus na natuklasan sa Africa, ngunit ang ebola reston ay hindi kasing bagsik noon. Ang pangalang ebola reston virus ay hinango sa Reston, Virginia, USA kung saan ito natuklasan noong 1989 matapos suriin ang mga unggoy na inangkat mula sa Ferlite Farm sa Laguna.

scured the image of God and has opened the doors to disbelief.” Of course, the way to correct this anomaly is really to focus our attention on Christ, the fullness of God’s revelation, who is both historical and contemporary to us, since as God, he goes beyond the limitations of space and time. And to understand Christ, and ultimately to know God’s will, we need to meditate on Christ’s sacred humanity, for that is what will take us his divinity, the goal to which we are called. The Church’s social teaching is derived from such careful and inspired meditation of Christ’s sacred humanity, so that our socio-political concerns can really be infused by the proper Christian spirit. We have to remember that the Church’s social doctrine is developed in an organic way from Christ’s life and redemptive work, which remain the perennial pattern for our life, words and deeds, no matter what circumstances we may find ourselves in. It is important that we understand deeply and appreciate the role of Christ’s sacred humanity in developing our own life and actuations. We need to learn how to meditate on Christ’s sacred humanity in a way that would give us practical impulses and guidelines everyday. For this, we have to go beyond just doing theology. While that is always necessary, it should be imbued by a faith-driven personal meditation on every detail of Christ’s life as recorded in the Gospel, Tradition and taught by the Magisterium. ○

Sa kabila ng krisis ay may pag-unlad NI DINO BALABO STA MARIA, Bulacan — Senyales ito ng pagunlad sa kabila ng krisis. Ito ang buod ng mga pahayag ng mga opisyal ng lalawigan na dumalo sa pagbubukas noong Pebrero 24 ng ikalawang WalterMart community mall sa Bulacan sa bayang ito.

“Malalampasan natin ang sigwadang pangekonomiya sa tulong ng Diyos dahil sa patuloy nating pagpupursige patungo sa kaunlaran,” ani Kint. Reylina Nicolas ng Ika-4 na Distrito ng Bulacan. Inayunan naman ito nina Bise Gob. Wilhelmino “Willy” Sy-Alvarado, Mayor Bartolome Ramos ng Sta. Maria, at Bokal Glenn Santos ng Ika-4 na Distrito. Ayon kay Bise Gob. Alvarado, palatandaan ng pag-unlad ang pagbubukas ng WalterMart ng pinakabago nitong mall na pampamayanan sa bayang ito. Ang WalterMart ay nagsimulang magtayo ng mga community mall sa iba’t ibang panig ng bansa noong 1991 kung kailan sumabog ang bulkang Pinatubo, ayon kay Alvarado. “Sa Maynila at Calabarzon sila nagsimulang magtayo ng mga sangay noon, aniya, dahil nasalanta ng Pinatubo ang Bulacan at malaking bahagi ng Central Luzon, kaya karaniwang sangay ng WalterMart ay nasa Laguna at Cavite. Pero sa pagsisimula ng dekada ’90 ay nabaling na sa norte ang paningin nila dahil sumisibol na ang kaunlaran sa atin,” sabi ni Alvarado na ang tinutukoy sa katagang Calabarzon ay ang mga lalawigan sa Timog Katagalugan na kinabibilangan ng Cavite, Laguna, Batangas, Rizal at Quezon.

Maayos na pamamahala sa mga bayan Kinumpirma ito ni Wilson Lim, pangulo ng WalterMart community malls. Ayon kay Lim, ang isa sa dahilang nakahikayat sa WalterMart na magtayo ng mga sangay sa Bulacan ay ang maayos na pamamahala sa mga bayan sa lalawigan, bukod pa sa maunlad na mga pamayanan at malaking populasyon. Sinabi ni Lim na nais nilang makatulong sa mga Bulakenyo sa pamamagitan ng pagbibigay ng pagkakataon para sa madaling pamimili, pagbibigay ng trabaho at pagpapaunlad ng mga lokal na produkto na kanilang binibili at ibinebenta sa iba nilang community mall. Ilan sa mga lokal na produktong binibili ng WalterMart sa mga bayang kanilang pinagtayuan ng kanilang sangay ay ang tilapia sa bayan ng Plaridel at tsinelas sa Lungsod ng Gapan sa Nueva Ecija. Bilang isang community mall, ang WalterMart ay mas maliit kumpara sa naglalakihang regional mall na itinayo ng kanilang kakumpitensya. Ngunit, kakaiba ang community mall ng WalterMart dito sa Sta. Maria dahil ito ay tinagurian ding “eco-friendly” at “life-style mall”. Bilang isang eco-friendly at lifestyle mall, mahigit sa 4,000 metro kuwadrado ng kabuoang 18,770 metro kuwadradong espasyo ng WalterMart ay di ginagamitan ng air conditioner kaya’t makakatipid ito sa kuryente. Ayon kay Simplicio De Guzman, assistant vicepresident ng shopping center operation ng WalterMart, ang kanilang disenyo ay kaunaunahan sa bansa. Ang gitnang bahagi ng community mall ay bukas, ani De Guzman kaya’t tuloy-tuloy ang daloy ng hangin doon, samantalang may malalaking bintana sa itaas nito na pinaglalagusan ng liwanag. Iginiit pa ni De Guzman na dahil bukas ang gitnang bahagi ng mall ay lalagyan nila iyon ng iba’t ibang uri ng halaman. “First of its kind ito sa Pilipinas kasi gusto naming ma-enjoy din ng mga customer namin ang nature,” ani de Guzman. Ang community mall ng WalterMart sa bayang ito ay may malawak na shopping center at supermarket, bukod sa Abenson appliance center at mga fastfood outlet, drug store, tatlong sinehan at iba pang mga tindahan.

Maria. Pinayuhan naman ni dating Labor Undersecretary Susan “Toots” Ople ang mga nawalan ng trabaho na agad makipag-ugnayan sa mga Public Employment Service Office (PESO). Binalaan niya ang mga naghahanap ng trabaho sa ibayong dagat na magingat sa mga illegal recruiter. Ayon kay Efren Reyes, executive officer ng Department of Labor and Employment (DOLE) sa Bulacan, umabot sa 469 na kontraktwal na manggagawa ng Stam Builders and Developers Inc., dito sa Marilao ang nawalan ng trabaho nang magsara ang kumpanya nitong Pebrero. Sa bayan ng Guiguinto, umabot sa 57 manggagawa ng Inchem Industries sa Barangay Tuktukan ang sumailalim sa forced leave ng walang suweldo simula Marso 7 kung kailan sisimulan ang pansamantalang pagsasara ng kumpanya na tatagal ng tatlong buwan. Umabot naman sa 11 trabahador ang binawasan ng araw ng trabaho ng Proudly Filipino Frozen Dairies na matatagpuan sa Cagayan Valley Road sa Barangay Sta. Rita ng Guiguinto. Ayon kay Reyes, ang dating anim na araw ng pagtatrabaho ng mga manggagawa ng nasabing kumpanya ay magiging limang araw na lamang. Sinabi ng DOLE executive officer na ang pagsasara ng mga kumpanya sa lalawigan at pagkawala ng trabaho ay bahagi pa rin ng epekto ng pangdaigdigang krisis pang-ekonomiya. Gayunpaman, sinabi ni Reyes na hindi magtatagal ay makakaahon sa krisis ang Bulacan dahil sa kung may mga nagsasara ay may nagbubukas din. Kabilang na dito ang WalterMart Community Mall sa bayan ng Sta. Maria na nagbukas noong Pebrero 24 na naging daan para magkatrabaho ang 970 Bulakenyo. single digit growth.” Iginiit pa ni De Guzman na naniniwala sila na hindi magtatagal ang krisis pang-ekonomiya ng bansa. “It will not be a prolonged situation, mag-iimprove ang economy natin in six to eight months,” ani De Guzman. Sinabi pa niya na ang pagbubukas ng WalterMart community mall sa Sta. Maria ay nagbukas din ng 970 trabaho para sa Bulakenyo, bukod pa sa mas naunang mahigit 1,000 trabaho na nabuksan sa pagbubukas ng WalterMart sa bayan ng Plaridel may apat na taon na ang nakakaraan. Kumpara sa naglalakihang regional mall ng kanilang mga kakumpitensya, ang mga WalterMart community mall ay maliliit lamang at hindi nangangailangan ng mga pagpapalabas ng mga artista kung Sabado at Linggo upang puntahan ng mga tao. Hinggil sa payo ni dating Labor Undersecretary Ople na makipagugnayan sa mga tanggapan ng PESO at DOLE ang mga nawalan ng trabaho kabilang ang mga napauwing overseas Filipino worker (OFW), sinabi niya na ang pakikipagugnayan ang simula ng solusyon sa lumalalang problema ng pagkawala ng trabaho hatid ng krisis pangekonomiya. “That will allow the government to easily pinpoint displaced workers, map out plans and identify threatened areas,” ani ng pinakabatang anak ng yumaong si dating Sen. Blas F. Ople na umakda ng Labor Code ng bansa na nagbukas ng pagtatrabaho ng mga Pilipino sa ibayong dagat. Kapag ang mga nawalan ng trabaho ay nakipag-ugnayan sa PESO at DOLE, ayon sa batang Ople, mas mapapadali ang pagbibigay ng tulong sa kanila katulad ng livelihood assistance and scholarship sa ilalim ng mga programa ng Technical Education and Skills Development Authority (TESDA). Inayunan ito ni Larry Villanueva ng DOLE-Bulacan na nagsabing mula pa noong nakaraang taon ay nagbibigay ang TESDA ng mga scholarship. Hinggil naman sa babala ni Susan Ople na mag-ingat sa mga illegal recruiter ang mga naghahanap ng trabaho sa ibayong dagat, sinabi niya na noon lamang nakaraang linggo ay may nadakip sa Maynila. “Marami na naman ang magsasamantala, pero sana hindi na tayo matangay sa mga mabubulaklak na pananalita,” ani Susan. Iginiit niya na dapat tiyakin ng mga aplikante sa Philippine Overseas Employment Administration (POEA) kung may akreditasyon doon ang mga job placement agency.

Ibinigay niya sa Mabuhay ang numero ng Blas Ople Policy Center and Training Institute na (02)-8335337 upang matawagan sa pagkumpirma ng akreditasyon ng isang job placement agency. Tutulungan, aniya, ng Blas Ople Policy Center ang mga aplikante na matiyak kung may akreditasyon ang placement agency na nag-aalok ng trabaho sa ibayong dagat. Kaugnay nito, sinabi ng batang Ople na magsasagawa rin sila ng isang jobs fair sa bayan ng Hagonoy ngayong Marso sa tulong ng DOLE at pamahalaang lokal. “Parang tulong na rin namin iyan sa mga bagong graduate at iba pang naghahanap ng trabaho,” aniya. Samantala, nararamdaman na rin ng ilang mga negosyante sa Bulacan ang epekto ng krisis sa ekonomiya kaya’t nagsagawa na sila ng mga positibong hakbang upang tugunan iyon. Ayon kay Corina Bautista, manedyer ng Max’s Restaurant sa Lungsod ng Malolos, hiniling na nila sa mga empleyado nila na magsagawa ng anim na oras na boluntaryong trabaho sa loob ng isang linggo. Sinabi ni Bautista na ang nasabing boluntaryong trabaho ay bahagi ng pagpapababa ng kanilang gastusin o pagtitipid. Ayon pa kay Bautista, naabot pa nila ang kanilang sales target noong Enero, ngunit sa pagsisimula ng Pebrero bumaba ng tatlong porsiyento ang kanilang benta kumpara sa parehong buwan noong nakaraang taon. Para naman kay Jun Joson, ang manedyer ng Pambansang.com, maayos pa ang takbo ng kanilang negosyo, ngunit “talaga lang dapat sabayan ng mahusay na marketing strategy.” Ang Pambansang.com ay nagbebenta at nagtatatak ng mga t-shirt na kinagigiliwan ng mga kabataang Bulakenyo dahil sa mga kuwelang mensaheng nakatatak doon. Sinabi pa ni Joson, “Mahirap talaga ang buhay ngayon. Dapat affordable at high quality pa rin.” Matatandaan na noong nakaraang linggo ay sinabi ng Bulacan Chamber of Commerce and Industry (BCCI) na wala pang nagsasara sa may 200 negosyanteng kasapi nila, ngunit may mga nag-ulat na bumaba ang benta. Ipinayo rin ng BCCI sa mga Bulakenyong negosyante na huwag sumuko sa krisis, sa halip ay maging malikhain. Una rito, sinabi ng DOLE at Department of Trade and Industry (DTI) na hindi masyadong maapektuhan ng krisis ang ekonomiya ng lalawigan.
