Isinaperang IRA matatanggap na, kung saan gugugulin di pa malinaw L UNGSOD NG M ALOLOS — Matatanggap na ng Kapitolyo sa Setyembre ang isinaperang karagdagang Internal Revenue Allotment (IRA) na hindi natanggap noong 2001 at 2004, ngunit hindi pa malinaw kung saan gugulin iyon. Ngunit habang sinusulat ang balitang ito ay wala pang tugon ang DOJ.

Ayon sa mga nakausap ng Mabuhay, matatanggap na sa Setyembre ng pamahalaang panglalawigan ang P44 milyon ng kabuoang P62 milyon ng karagdagang IRA na di naibigay sa Kapitolyo ng pamahalaang nasyunal noong 2001 at 2004 — kung kailan nagdaos ang bansa ng eleksyon — dahil sa “re-enacted” ang pambansang badyet noon. BF nililigawan na ang mga Bulakenyo SUNUD-SUNOD na ang ginagawang pagbisita ni MMDA Chairman Bayani Fernando sa mga bayan sa lalawigan ng Bulacan. Noon lamang ika-6 ng kasalukuyang buwan ay dinalaw ni Fernando ang bayan ng Bukawe na nagdiriwang ng kanyang ika-430 taong pagkakatatag kaalinsabay ng pagdiriwang ng Banal na Krus sa Wawa na tampok ang pagligid ng Pagoda sa Wawa. Nakasama ni Fernando sa nasabing pagkakataon si Bulacan Gob. Jon-jon Mendoza at Mayor Jonjon Villanueva, at sila ay nakiisa sa pagsakay sa pagoda. Sa ginawang pahayag ni Fernando, inihayag niya ang kanyang hangarin na lumahok sa panguluhan sa darating na halalan sa 2010, dahil sa kanyang marubdob na hangarin na mabago ang takbo ng pamumuhay katulad ng kanyang ginawa sa kanyang bayang Marikina. Dahil sa kanyang tinuran, maraming Bulakenyo ang tumugon sa kanya na naniniwala na magiging maayos ang pamamalakad ng bansa kapag siya na ang naging pangulo.

Unang dinalaw ni Fernando ang bayan ng Pulilan noon Mayo 14, na tanyag dahil sa pagluhod ng mga kalabaw tuwing kapistahan. Pangalawang dinalaw ni Fernando ang bayan ng Obando noong kapistahan ng tatlong santong sina San Pascual, Sta. Clara at Señora de Salambao noong Mayo 17. Si Fernando ay naging alkalde rin ng Marikina at sa loob ng mahabang panahon ng kanyang panunungkulan ay nailagay niya sa mataas na pedestal ang nasabing lungsod, na sa kasalukyan ay nagsisilibing isang magandang halimbawa sa iba pang mga bayan sa Kalakhang Maynila. Food bills “IT is difficult to speak to the belly,” the Stoic philosopher Cato warned his fellow Romans. “It has no ears.” Unnerved by food prices that bolted 53%, in just months, 191 nations gathered in Cato’s city Tuesday for a “Summit on World Food Security”. Convened by the Food and Agriculture Organization (FAO), the gathering gropes for ways to leash runaway food bills before more join the 825 million who barely get enough to eat. FAO general director Jacques Diouf called the crisis a “predictable catastrophe”. But “I foresaw this problem,” Malacañang spokesmen quoted President Arroyo as saying earlier. She did? Not Summit delegates though. They fretted over price spikes from cereals, oil seeds to meat, and fish. Collapse of the Haiti

government, plus street protests, anchor their question: What will be the political spillover if the price crunch persists? “Hunger knows no friend but it’s feeder,” the old proverb says In Asian countries, concern focuses on rice. “Mindanao, the country’s food basket, is going hungry,” the Philippine Daily Inquirer reported. “Polished rice is retailed at more than twice the government-subsidized rice that is not available to most consumers.” Corn grits prices have soared. About 26 percent of the population earn P67 or less a day. They’ve been hardest hit by high food and fuel bills. Asian Development Bank economist Hyun Son estimates about 2.3 million more Filipinos would skid into poverty for every 10-percent increase in food price.

FAO’s “Food Outlook” for June 2008 provides context. Bad weather and export curbs jacked up rice prices “by an extraordinary 71 percent between January and April 2008”. Cyclone Nargis in Myanmar spurred “international price quotations to leap by 10 percent in one week. By early May 2008, prices were more than double their May 2007 level.” Even small exporting nations — Brazil, Ecuador, Cambodia and Ecuador — curbed sales. This came when rice-short countries, notably the Philippines (whose President foresaw the problem?) and Bangladesh, shopped for sizeable volumes abroad. This “propelled international prices skyward”. Despite tapering supplies, Thailand kept its export window open. So did the U.S. “These are  continued on page 4

Mountain retreat I JUST had the very precious privilege to spend a few days in a mountain retreat somewhere in the elevated fastness of Bukidnon. It was a very cool place, windy, often wet and shrouded in mist and fog. But when the air cleared up, it showed a breath-taking view of green rolling hills, valleys, trees swaying, clouds forming and chasing, with the hint of the sea in the horizon. It was as if God himself painted and was showing his work in all its splendor. Beautiful flowers abounded. Cows, sheep and horses kept me company, and colorful birds simply decorated the pines and sky. For sounds, there was the murmur of the brook, the chorus of the insects, the fluttering of leaves. This must be paradise, I imagined. Obviously, my heart was exploding in gratitude to God and to all, even as I ventured into that very delicate task of recollecting, reflecting, studying and praying. I strongly believe that we need to have a time for silence. Silence enables us to go deep into ourselves. We’ll be surprised that in spite of our age and experience, there still are uncharted waters and unmapped territories to be discovered. Truly, our human condition is soaked in mysteries. The hubbub of the city, with all its comings and goings, has a way of paralyzing our spiritual faculties, of disorienting and even of alienating us from our own selves, not to the mention, from the others. Imperceptibly, we build walls

around us, separating us from the others, and establish our own mechanisms to complete our own make-believe world where God and the others become mere props, decors and tools. With silence and the help of untouched nature, we can readily see the tricks played on us even by our own senses and reasonings. These powers, supposed to bring us to God and to reality, often hijack us to another world, if we are not careful. Reality for us, of course, is a malleable thing. With our intelligence and will, with our freedom and creativity, even if there’s an objective reality established by God, we are capable of bending, molding and making it also according to our own designs. The reality we live in is never rigid, fixed and inert. It’s constantly flowing and morphing. We have to understand that our subjective reality is supposed to coincide with God’s objective reality for us. For this, a very dynamic process is involved. There’s always in our life an interplay between God’s will and ours, between God’s laws and our intelligence and freedom. We have to train ourselves rigorously to do our part well in this lifetime dance. We have to frequently check what and how we are thinking, how we are using our will and freedom, to see whether we are truly in love and whether we are loving properly, that is, in the truth. Silence helps us to see the basic structure of our mind and

heart, and the objects to which they get oriented. This is where we see whether these human powers are in their proper condition and are properly used. They are supposed to be locked on God always, immersed in him even as we grapple with our earthly affairs. But if we don’t take pains, they can dare to detach themselves from God and be and work on their own, an anomaly gripping many of us. That’s when we start constructing our own world and reality. True, we are intelligent and free, and in fact we need to be so as best as we can. We just have to remember that our proper and constant object is God, and not just some earthly, sensible or intelligible matter. We have to develop the proper skills and virtues to spend our whole life in God’s presence, driven with rectitude of intention, even as we handle mundane things. Thus, we need to continually renew and enrich our routine and lifestyle to fit this need. Silence also facilitates internalizing things, attuning our senses and faculties to their proper object. It also merges us with time, allowing us to run from the present to the past and then to the future, rectifying and refocusing things along the way, until we reach the doorsteps of eternity and infinity itself. Benedict Down Under I WAS preaching a retreat to prepare a group of high school students for a much awaited encounter with Pope Benedict XVI when he meets the youth from all over for the 23rd World Youth Day in Sydney this July 15-20, 2008. This warm and cheerful ecclesial and spiritual meeting is held annually alternating between Rome and another country. World Youth Day was the initiative of Benedict’s predecessor, the Great John Paul II. When the United Nations proclaimed 1985 as the International Youth Year, John Paul saw it as a wonderful opportunity to gather the youth every year to remind them about the indispensable role they play

in the Church and in the world. Ever since 1986 this meeting has attracted millions of young boys and girls around the Pope, to reaffirm their human and spiritual commitment of becoming other Christs in the midst of the world. In that same International Youth Year of 1985, John Paul wrote a lengthy Apostolic Letter entitled Dilecti amici (My beloved friends). It was meant for everyone but primarily addressed to the youth of the world. I believe quoting some of the most salient ideas from that letter’s first part will help us — both young and old — to be reborn in our commitments to the Church, the family and society.

It is very moving to see how John Paul II stressed greatly on the role of the youth in the Church. Not only because they are physically and mentally more agile, but because they embody a way of being and becoming which every Christian is called to nurture and live on the path of identification with Christ. “You young people are the ones who embody this youth: you are the youth of the nations and societies, the youth of every family and of all humanity; you are also the youth of the Church. We are all looking to you, for all of us, thanks to you, in a certain sense continually become young again.”  continued on page 4

The act and art of giving WHILE reading my favorite daily recently, I came across a news report that multi-awarded singeractress Barbra Streisand donated US$5 million for research on women’s cardiac problems, which kills half a million of American women every year. “Women need to be educated about female cardiovascular disease, and the medical community must be propelled toward change,” explained the Broadway singer, who catapulted to stardom with her Oscar-winning 1968 performance in Funny Girl, why she gave such a huge amount. If you were in her shoes, would you give such an amount for a cause? Well, you don’t have to be a millionaire to give a huge amount. Just give what you can afford. As Nobel Peace Prize winner Mother Teresa said, “If you can’t feed a hundred people, then just feed one.” Or as what an Arab proverb urges, “If you have much, give of your wealth; if you have little, give of your heart.” “Some people give time, some money, some their skills and connections, some literally give their life’s blood. But everyone has something to give,” says Barbara Bush. “You must give some time to your fellow men. Even if it’s a little thing, do something for others — something for which you get no pay but the privilege of doing it,” pointed out Albert Schweitzer. Anne Frank, who wrote The Diary of Anne Frank, stated, “No one has ever become poor by giving.” To which British Prime Minister Winston Churchill added, “We make a living by what we get, but we make a life by what we give.” “For it is in giving that we receive,” reminded Saint Francis of Assisi. German-born American physicist Albert Einstein echoed the same sentiment. “The value of a man,” he wrote, “resides in what he gives and not in what he is capable of receiving.” At one time, a rich man complained to his friend. “People don’t like me,” he said. “They say I’m selfish and stingy. And yet in my last will and testament, I have donated all that I own to a charitable institution.” Hearing his explanation, the friend told him. “Well, maybe the story of the cow and the pig has a lesson for you. The pig came to the cow and grumbled, ‘People always talk about your friendliness. Well, it’s true: you give them milk. But they get much more from me. They get ham and bacon and lard, and they even cook my feet. And yet — no one likes me. To all of them, I am just a pig. Why is that?’ “The cow thought it over a bit and then said, ‘Perhaps it’s because I give while I am still alive.’” This reminds me of a line from a Shaina Twain song, “It’s important to give it all you have

while you have the chance.” An open hand can receive but a closed hand cannot. The phrase has a Biblical ring and a Biblical wisdom that applies profoundly to everyday human affairs. The man who will not share himself with his neighbors receives little friendship in return. The tight parental grip that holds children too closely defeats its own purpose in the end. It is no accident, probably, that in many countries the symbol of totalitarianism is the one that you can’t shake hands with: a clenched fist. “To be sower of seeds, a man must open his hand,” said Arthur Gordon. “He must do this, clearly, before he can reap. And the process doesn’t stop there. To possess knowledge or wisdom, he must open his mind. If he wants to receive love, he must offer it — and to do this, he will need an open heart. A closed hand cannot receive — partly because it is shut, and nothing can get in. But mostly because it has nothing to give.” A very conscientious Christian lady looked back on her childhood in a big city. She was from a wealthy family and as she puts it, “The poor were our pets.” On Sunday, it was the favorite charity of these superior Christians to make the rounds of the cells at the police station. The men in particular did this. They visited the week-end drunks, lectured them, forced them to take the pledge, and then bailed them out of jail so they would be back to work on Monday. These do-gooders were smugly respectable, very visibly in a different moral category from those to whom they gave. They had only one fault: they never gave themselves. Lebanese-born American philosophical essayist Kahlil Gibran once wrote: “You give but little when you give of your possessions. It is when you give of yourself that you truly give.” Dr. Karl Meninnger, the famous psychiatrist, once gave a lecture on mental health and afterward answered questions from the audience. “What would you advise a person to do,” asked one man, “if that person felt a nervous breakdown coming on?” Most people expected the doctor to reply, “Consult a psychiatrist.” To their astonishment, he replied, “Lock up your house, go across the highway, find someone in need, and do something to help that person.” “Life is a gift, and it offers us the privilege, opportunity, and responsibility to give something back by becoming more,” Anthony Robbins said. Each of us has the responsibility to give. We get the best out of others when we give the best of ourselves. American philanthropist John D. Rockefeller Jr. urged, “Think of giving not as a duty but as a privilege.” The Lord Jesus Christ himself said, “It is more blessed to give than to receive.”

With youth’s identity defined, John Paul continues to admonish them not to be selfish about this vital stage in their life. “So your youth is not just your own property, your personal property or the property of a generation: it belongs to the whole of that space that every man traverses in his life’s journey, and at the same time it is a special possession belonging to everyone. It is a possession of humanity itself.”(Ibid.) Today’s generation must realize that youthfulness is not something to be selfishly indulge upon, but must be activated in view of the good of humanity’s present and future progress. He goes on to reveal what is so special about youth and why it is important for every young person to bear in mind: “In you there is hope, for you belong to the future, just as the future belongs to you. For hope is always linked to the future; it is the expectation of ‘future good things.’ As a Christian virtue, it is linked to the expectation of those eternal good things which God has promised to man in Jesus Christ. And at the same time, this hope, as both a Christian and a human virtue, is the expecta-

tion of the good things which man will build, using the talents given him by Providence.” (Ibid.) The young, when they put their energies and aspirations in the service of God and society, become agents of Providence to restore God’s Kingdom here on earth and also to promote a more just and peaceful society. This is a very important responsibility that reminds the youth not to get lost in and enslaved by the present virtual world of materialism and superficiality. The present and the future will be what they are today, and it is important to remind them about the identity they are called to live and to transmit for generations to come. That is why John Paul tells them their mission: “In this sense the future belongs to you young people, just as it once belonged to the generation of those who are now adults, and precisely together with them it has become the present reality. Responsibility for this present reality and for its shape and many different forms lies first of all with adults. To you belongs the responsibility for what will one day become reality together with yourselves, but which still lies in the future.”

Neil J. Quirke S.J. (deceased) at dating rector ng Xavier University, Cagayan de Oro City: “You’re a fighter.” Lalo akong nagulat. Ibig ba niyang sabihin, war freak ako o guerrera sa palengke? Hindi naman siguro. Ibig siguro niyang sabihin ay hindi ako nagpapatalo sa sitwasyon at inihahanap ng solusyon ang anumang kumplikasyon. ’Yon nga kaya? Naging kaibigan ko si Julie Merkel at Josephine Soto na nakasama ko sa iba’t ibang lakad gaya ng pagpunta sa mga beach, farm at Apo Island. Balak din naming pumunta sa Siquijor Island kaya lang di na natuloy. Pumunta kami sa Cebu ni Julie at doon na sumakay ng flight pabalik ng Maynila. ○

Whether we may be in Sydney or not, let us accompany — through our prayers and sacrifices — the Holy Father, Pope Benedict XVI, so that his encounter with the world’s youth may bear lasting fruits of holiness and apostolic zeal in all God’s children.

Ito ay dahil sa isasama sa kasalukuyang badyet ng lalawigan, na P2.038 bilyon, ang isinaperang IRA na nagkakahalaga ng P44 milyon, sabi ni Natividad. “Pag-uusapan pa uli iyan dahil sa isasama sa badyet bilang supplemental budget,” aniya, at idinagdag na kaya nagmadali sa pagsasapera ng nasabing IRA ang Kapitolyo noong Hunyo 27 dahil iyon ang itinakdang araw ng Development Bank of the Philippines (DBP) upang makumpleto ang mga papeles na kailangan isumite ng Kapitolyo sa DBP. Isa sa mga dokumentong kailangan ng DBP ay ang resolusyon na nagbibigay kapangyarihan kay Gob. Mendoza na lumagda sa kasunduan ng pagsasapera ng karagdagang IRA. Ipinaliwanag ni Natividad na ang Land Bank of the Philippines (LBP) ang nagbigay ng garantiya sa DBP na may perang panagot ang gobyerno sa karadagang IRA na isinapera at kokolektahin ng Kapitolyo. Hinggil naman sa desisyon ni Mendoza na madaliang isapera ang nasabing IRA, sinabi ni Bokal Natividad na iyon ay gagamitin sa iba’t ibang programa ng pamahalaang panglalawigan. Si Natividad na kasapi ng mayorya sa S.P. at kaalyado ng punong lalawigan, ang umakda sa resolusyong nagbibigay ng nasabing kapangyarihan kay Gob. Mendoza na nanalo ng 9-2 sa botohan sa S.P. Tinanong din si Natividad ng Mabuhay kung mayroong bang emergency o mahigpit na pangangailangan na dapat tugunan ng apurahang pagsasapera ng IRA. “Wala naman,” ang tugon ni Natividad na natawa pa nang ilarawan ng Mabuhay na ang karaniwang pumapasok sa mga proseso ng pagpapare-discount o apurahang pagsasapera ng tseke ay iyong mga taong may emergency gaya ng kailangang ipagamot ang kaanak upang masagip ang buhay. Binigyang diin naman ni dating Gob. Pagdanganan na dapat isaayos ni Gob. Mendoza ang pamamahala sa lalawigan. Hindi dapat sumunod si Mendoza, ani Pagdanganan, sa tatlong panukala ng Malakanyang kung paano isasapera ang IRA na hindi naibigay ng pamahalaang nasyunal noong 2001 at 2004. “Dapat ay ilagay niya sa ayos ang lahat, dapat ay naaayon sa batas,” ani ng dating gobernador na naupo sa Kapitolyo mula 1986 hanggang 1998. Bilang pangulo ng Liga ng mga Gobernador sa bansa, si Pagdanganan ay kabilang sa nagsampa ng kaso laban sa administrasyon ni Pangulong Fidel V. Ramos noong 1998 dahil sa pagpigil sa IRA ng mga pamahalaang lokal bilang reaksyon ng Malakanyang sa “financial crisis” sa Asya noong 1997. Ang nasabing kaso ay pinaboran ng Korte Suprema na nagsabing bawal bawasan o pigilan ang pagbibigay ng IRA sa mga pamahalaang lokal. Ang minorya sa S.P. sa pangunguna ni Bise Gob. Alvarado ay lumiham na sa DOJ upang humingi ng opinyon hinggil sa nasabing pagsasapera ng IRA kung saan ang ibinigay na pamamaraan ng Malakanyang ay “installment”, “discount” o kaya ay gamitin iyon bilang kolateral upang makautang sa bangko. Sinabi ni Alvarado sa Mabuhay na ang lahat ng pamamaraang ito ay mali at di legal. Binigyang diin niya na malinaw sa batas na hindi dapat bawasan o pigilan ang pagbibigay ng IRA sa mga pamahalaang lokal. “Hindi iyan ang intensyon ng batas,” ani Alvarado. Matatandaan na noong Hunyo 27 ay namayani ang mayorya sa Sangguniang Panglalawigan sa botong 9-2 upang bigyang kapangyarihan si Mendoza na lumagda sa isang kasunduan sa bangko sa pagsasapera ng IRA na nagkakahalaga ng P66 milyon. DECISION Before the Court is a petition for the declaration of nullity of marriage filed by petitioner Maria Juanita P. Enriquez, a.k.a. Mary Jane P. Enriquez against Rolando Santos Enriquez, respondent. Petitioner and respondent were married on 9 January 1983. Their union was blessed with a children named Michelle and Anne Christine both surnamed Enriquez. Despite valid service of summons on 13 February 2000, respondent did not file the necessary pleading for which reason and upon order of the court Prosecutor Marcial Distor submitted a report that no collusion existed between the parties. The petition was endorsed to the Office of the Solicitor General in the Order dated 14 November 2000 but no Certification was issued. Trial ensued in the presence and with the active participation of the Public Prosecutor, Marcial Distor. The records reveal that petitioner and respondent were working for the same company, Electronic Assemblies, Inc. About forty days after the tragic death of Mary Jane’s fiancee, respondent introduced himself and asked if he could visit the former Mary Jane agreed and soon after they were dating regularly. Sometime in August of 1982, they had already established a live-in relationship. However a few weeks after the arrangement, Mary Jane started suspecting Rolando of having a relationship with another woman. This triggered an altercation which ended up Mary Jane being slapped and punched by Rolando. Mary Jane at that time, thought she was at fault because of her jealousy. In spite of this physical encounter, they got married on 09 January 1983 and sometime in September of 1983, Mary Jane gave birth to a baby girl, Michelle. In 1983, petitioner was sent by her office for a computer course at the Ateneo. Respondent on his own, also enrolled in the same class with the primary intention of looking over his spouse. After three courses, respondent dropped out but pressured petitioner to do the same. His reasons were, she was staying out too late and most of her classmate were male. On her fourth course, she quit just to please her husband. In 1983, they had to live with her in-laws because of want of a maid to take care the child Michelle. However,while at her in-laws, she was continuously criticized even by her in-laws over her choice of clothes. She was not allowed to wear “too revealing” clothes like shorts and blouses with low necklines. This prompted fights between the two but petitioner always acceded, again to please her husband. In 1984, petitioner arrived at around 11 PM at home from work and was confronted by her husband who thought that she had a lover. This led to another altercation with respondent hitting petitioner. Petitioner was dissuaded from leaving when respondent profusely apologized and promized that they would transfer to their own home. Also in the same year, respondent left for work in Saudi Arabia. He came home every six months. During those times, their relationship was pleasant for a few days but would always turn sour when respondent started “interogating” petitioner about her schedule and other activities. Several times, he would also rummage through the personal belongings of petitioner in search of “evidence” of her alleged paramour. Sometime in 1990, respondent went home for good because of the gulf war. In that same year, petitioner gave birth to thier second daughter, Christine. Shortly after, petitioner enrolled for her Masters in Business Administration. Respondent who was unemployed at that time also enrolled in the same course but dropped out when he got employed at the Philippine Geothermal. In the meantime, he also continuously harangued his spouse to drop out from her course. He cited reasons like she was staying out too late because of her classes and had “no need to socialize”. Petitioner eventually stopped her Masteral studies because of the constant pressure from her husband. In the early 90"s, to petitioner’s surprise she was invited by her husband to attend dinner-dances sponsored by the Philippine Geothermal about once or twice a year. However, during those affairs, she was not allowed to dance and had to wear long sleeves and closed-neck dresses. Sometime in 1992, petitioner joined Levi Strauss where her income doubled. Despite having a new job and turbulent marriage, she convinced her husband to attend Couples for Christ and Marriage Encounter seminars. However, and to her dismay her husband continued to irritate her regarding her work and personal schedule according to petitioner, respondent often insinuated that she was having a relationship with another man. Also in that same year, petitioner once woke up having difficulty breathing. To her shock, she realized respondent was strangulating her, who only stopped when she managed to escape from his hold. She tried to separate from him but was again dissuaded. Sometime in 1994 and 1995, petitioner discovered that respondent was having an affair with a married woman who was their

neighbor in Binan, Laguna. She also saw in his possession a credit card of a woman officemate. Sometime in 1996, she and the whole family move to Singapore because of a recent promotion. Her husband also was able land a job with 3M Singapore. In the same year, in one of her trips to Malaysia, her children reported to her that respondents went out with another woman. In reaction, she attempted to discuss this with respondent but was always rebuffed. In 1997, while on vacation trip to the USA, respondent most often sulked and refused to join the family on nights out like watching the opera. And in December of 1998, while on a vacation trip to Manila, respondent hit his daughter, Michelle on the head several times over a trivial matter. Sometime in April of 1999, petitioner in one of her business trips to Manila received an overseas phone call from respondent. In a fit of jealousy, respondents threatened to kill their children and himself. She had to stay on to phone for several hours just to appease her husband. Upon arriving from Manila, after insuring the safety of her children, she finally confronted her husband who left the conjugal house. The parties did not acquire properties during the marriage. Dino SC Pena, a Psychiatrist clearly found in his report: “Based on the above findings it is, however, the conclusion of the undersigned that respondent manifested symptoms that do not meet the criteria for any one specific personality disorder, but together the symtoms have shown to cause significant distress and impairment to his marital relationship. Hence, he is labeled to have a diagnosis of Personality Disorder Not Otherwise Specified (Mixed Typed). The disorder attributed to the respondent has been present since the early adolescence and antedate his marriage. This disorder continued to manifest during his marriage and up to the time he separated from the petitioner. The psychological deficits of the respondent labeled as Personality Disorder Not Otherwise Specified is development and pervasive in nature and not amendable to cure to any of the currently available psychiatric treatment modality.” Petitioner’s uncontroverted recital of respondent’s behavior during the marriage well as the report of the psychologist and the corroborative witness Benigno Pabalan, Jr. convince this court that the marriage between the parties is one susceptible for annulment on the ground of psychological incapacity of the respondent to comply with the essential obligations of marriage. Marriage is a special contract of permanent union between a man and woman entered into in accordance with law for the purpose of establishing a conjugal and family life. As such, husband and wives have right as well as the corresponding obligation toward each other. Article 68, of the New Family Code obliges them to live together, to observe mutual love and respect and fidelity and to render mutual support Art. 36, of the New Family Code, however, similarly provides that the marriage contracted by any party who, at the time of the celebration, was psychologically incapacitated to comply with the essential marital obligations of marriage, shall likewise be avoid even if such incapacity becomes manifest only after its solemnization. The framers of the Family Code held the view that one of the other factors constituting psychological incapacity to discharge the essential requirments of marriage, is the refusal of the respondent to dwell with the petitioner without fault on the part of the latter. The aforesaid circumstance is relevant to the instant case. In no instance did respondent, Rolando Santos Enriquez showed his intention to love and start a family with the petitioner, Maria Juanita P. Enriquez a.k.a. Mary Jane P. Enriquez. While the law puts marriage in such high pedestal, it equally realizes that there are persons who may not be able to comply with the essential responsibilities of marriage due to psychological reasons which were existing during the time of celebration of the marriage but become manifest only during the cohabitation of the parties. In such a case, the law grants a relief for offented party who may trap in marital union that exists in name only. To reiterate, the evidence in this case of convincing testimony of the petitioner, the findings of the psychologist and the corroborative withness which remain uncontroverted by any evidence from respondents can be annulled under Art. 36 of the New Family Code. This is a remedy available to parties who are enmeshed in the marriage that is a sham or spouses who that have long separated because of the inability of one of them to perform the duties of married couples. The respondent, by his failure to file answer, is similarly considered to have failed to present controverting or refuting evidence which would repel, counteract or disprove facts established by the petitioner. The petitioner on the other hand, has proven her case by preponderance of evidence, and accordingly, a judgement in her favor. WHEREFORE, the court declares the marriage between Maria Juanita P. Enriquez a.k.a. Mary Jane P, Enriquez and Rolando Santos Enriquez, celebrated on 9 January 1983 as NULL and VOID pursuant to Art 36 of the New Family Code. The absolute Community Regime under Art. 99 of the Civil Code between the parties are accordingly TERMINATED. The petitioner as recommended by the Court Social Worker is granted custody of the minor child giving visitorial rights to respondent. The parties must jointly support the minor child. Upon securing a copy of his Birth Certificate sometime in January 2007 he was surprised to find out that in his Certificate of live Birth issued by the National Statistic Office, the middle name and birth place of his father as appearing therein were entered as “Mejahera” (Annex “A2”) and “Naga City” (Annex “A-3”) respectively but in truth and in fact, in the Certificate of Live Birth of his father (Annex “B”), the same were entered as “Miyahira” and “Bombon, Camarines Sur” respectively, which is the truth and correct middle name and birth place of his Father. Likewise, the date of marriage of his parents as appearing therein was entered as “March 7, 1983” (Annex “A-4”) instead of April 7, 1998 which is thrue and correct date of marriage of his parents; that the error in the above entries in the Certificate of live Birth was due to a misunderstanding between the informant and the records officer; to avoid confusion and to put things in legal perspective and to conform to his official records and documents, it is necessary that a change in the entries be made in the Certificate of Live Birth from the middle name of his father as appearing therein entered as “Mejahera” be corrected to “Miyahira” and his father’s birthplace from “Naga City” be corrected to “Bombon, Camarines Sur”, likewise, the date of marriage of his parents as appearing therein as “March 7, 1983” be changed to “April 7, 1998”, that such change and /or correction is not being done in order to perpetuate fraud, or any miscarriage of justice, or even to evade prosecution, petitioner is not unmindful that as a consequence of filling this petition, he is required by law to pay the docket fess and other necessary legal fees in order for the said petition to prosper. However, he cannot afford to pay the said fees as he is an indigent. Pamintuan: Sa tulong ng Diyos, tao matatapos ang proyektong NorthRail NI DINO BALABO LUNGSOD NG MALOLOS —Tiniyak ni Secretary Edgardo Pamintuan na matatapos ang naaantalang proyektong NorthRail kahit dalawang taon na lamang ang nalalabi sa implementasyon nito sa pamamagitan ng tulong ng Diyos, suporta ng mga tao, at kanyang focus o matiim na paninindigan sa proyekto. Si Pamintuan ang itinalaga ni Pangulong Arroyo bilang bagong pangulo at Chief Operating Officer ng North Luzon Railways Corporation (NorthRail) na namamahala sa nasabing proyekto. Una rito, inamin ni Pamintuan noong Hunyo 30 na itinigil ng mga kontraktor na Tsino ang paggawa ng civil works sa proyektong nagkakahalaga ng $503 milyon na mag-uugnay sa lungsod ng Caloocan, Metro Manila at Malolos, Bulacan. Sa pakikipanayam ng Mabuhay kay Secretary Pamintuan noong Hulyo 5 sinabi niya na matatapos sa 2010 ang NorthRail. “With God’s help and our people support, and my laser focus on the project, we will not fail,” ani Pamintuan na dating alkalde ng Lungsod ng Angeles sa Pampanga, at kasalukuyang tagapangulo ng Subic Clark Alliance Development Council (SCADC). Sinabi ni Pamintuan na kahit dalawang taon na lamang ang natitira sa implementasyon ng NorthRail ay titiyakin niyang matatapos at magagamit iyon. “We only have two years and we will see to it that tracks will be laid down and trains rolling by then,” aniya. Binigyang diin din niya ang intensyon ni Pangulong Arroyo na

matapos at magamit ang NorthRail tulad ng kanyang ipinangako sa pagsisimula nito. “Determinado kaming ituloy at tapusin ang proyekto tulad ng pangako ni PGMA,” ani Pamintuan. Binanggit din niya na hindi pa tuluyang inaabandona ng mga Tsino ang proyekto at patuloy pa silang nakikipag-usap sa mga ito. “Hindi pa kanselado ang kontrata,” aniya. Patungkol naman sa bumubuo ng pamunuan ng NorthRail Board, ipinahiwatig niya na may mga mapapalitan nang sabihin niya: “We’ll bring in a new board and set the basic mechanisms to get it off the ground.” Ang konsepto ng NorthRail Project ay nabuo noong kalagitnaan ng dekada ’90. Ito ay naglalayon na makapagbigay ng mabilis at maayos na sasakyang bibiyahe sa pagitan ng Kalakhang Maynila at Gitnang Luzon sa pamamagitan ng muling pagbuhay sa inabandonang riles ng Philippine National Railways (PNR) mula sa Caloocan hanggang sa Malolos at sa Clark Freezone sa Pampanga. Maaari ding dugtungan sa mga darating na panahon ang nasabing riles hanggang sa hilagang Luzon, ayon sa plano ng pamahalaan. Ang unang bahagi (Caloocan-Malolos) ng proyektong NorthRail ay may habang 32.2 kilometro na pinondohan ng China Export-Import Bank (Ceim Bank) ng halagang $400 milyon matapos lumagda sa isang kasunduan ang mga pamahalaang ng Pilipinas at Tsina noong Pebrero 26, 2004. Ang nasabing kasunduan sa pagutang ng Pilipinas sa Tsina ay nagkabuhay simula noong Setyembre 13, 2004 at may maturity period o babayaran sa loob ng 20 taon.

Batay naman sa tala ng National Economic Development Authority (NEDA) na nakuha ng Mabuhay, ang aktuwal na pagsisimula sa implementasyon ng proyektong NorthRail ay noong Abril 12, 2005, at natapos dapat sana ito noong Oktubre 31, 2007. Ngunit, dahil sa kinailangan pang ilipat muna ang libo-libong pamilyang iskwater na nasa riles, na natapos noong Disyembre 2005, hindi agad nasimulan ang civil works o paghahanda sa inabandonang riles ng PNR para isagawa ang NorthRail.
