COOPERATION AGREEMENT BETWEEN THE NATIONAL ELECTION COMMISSION AND THE CENTRAL CHAPTER OF THE INDONESIAN DOCTORS’ ASSOCIATION CONCERNING THE GENERAL ELECTION OF THE PRESIDENT AND VICE PRESIDENT NUMBER:

On this day, Thursday, the fifteenth of April of two thousand and four, the undersigned: 1. Prof. DR. NAZARUDDIN SJAMSUDDIN as the Chairman of the National Election Commission with the address of the Office of the National Election Commission, Jalan Imam Bonjol No. 29 Jakarta, and hereafter is referred to as the FIRST PARTY. 2. Prof. DR. Dr. FARID ANFASA MOELOEK, Sp.OG as the General Chairman of the Indonesian Doctors’ Association with the address of the Office of the National Chapter of the Indonesian Doctors’ Association, Jalan Sam Ratulangi No. 29 Jakarta, and hereafter is referred to as the SECOND PARTY. The FIRST PARTY and the SECOND PARTY agree and approve to make a Cooperation Agreement concerning further description of the provisions of Article 6 Letter d of the Laws Number 23 of 2003 on the General Election of the President and Vice President as follows: CHAPTER I BASES OF AGREEMENT Article 1 The bases of the agreement is: 1.

Article 22 E of the Constitution of 1945;

2. Law Number 23 of 2003 on the General Election of the President and Vice President; 3. Article 1 item 14 of Law Number 18 of 2002 on Science and Technology which states that a professional organization is an institution for the scientific community of one discipline, or interdisciplinary of science and technology, or

for professionalism and professional ethics in society, in line with rules and laws. CHAPTER II AIMS, OBJECTIVES AND OUTCOMES Article 2 (1)

The aim of this cooperation is to share information, technical assistance and other matters in the establishment of the procedure for implementing Article 6 letter d of Law Number 23 of 2003, so that the General Election of the President and Vice President can run smoothly, safely and in an orderly manner, in line with the principles of the general election.

The objective of the agreement is to ensure the procedure for implementing Law Number 23 of 2003, as referred to in paragraph (1), providesf legal surety, legal equality and legal benefit for all members of Indonesian society. Article 3

The outcomes of the joint agreement are: 1. Provision of data, information, and descriptions related to the technical and juridical aspects of Article 6 letter d of Law Number 23 of 2003; 2. Other pending outcomes that will be agreed, which are specific and or special between the two parties, that are closely related to the establishment of the procedures for implementing the General Election of President and Vice President. CHAPTER III IMPLEMENTATION Article 4 (1)

The implementation of the cooperation is conducted in synergy, in harmony, coordinated and continuous.

The National Election Commission will present materials for the draft of the Decree that is being developed, to coordinate issues that require further discussion specifically and or especially with the Indonesian Doctors’ Association.

(3)

The Indonesian Doctors’ Association will give suggestions and opinions on the substance of the material in the draft Decree that is being developed by the National Election Commission, based on the code of ethics of medical doctors and the current laws.

CHAPTER IV FUNDING Article 5 The implementation of the cooperation is funded by the State Revenue and Expenditure Budget (APBN) and other non-binding funds. CHAPTER V TERM OF COOPERATION Article 7 (1)

The cooperation shall take effect from the date of its promulgation to the conclusion of the stages of the General Election of the President and Vice President.

The cooperation can be extended on condition that the extension is agreed by both parties. CHAPTER VI CLOSING Article 8

To explore, discuss and formulate the follow-up of the mutual agreement, the FIRST PARTY and the SECOND PARTY have agreed to form a technical working group consisting of elements of the FIRST PARTY, the SECOND PARTY and other required elements. Article 9 The agreement is printed on two copies on sealed paper with equal legality, one copy is for the National Election Commission and the other copy is for the Indonesian Doctors’ Association.
