The Democratic People’s Republic of Korea and the Republic of Korea, Resolved to achieve in free self-determination the unity of Korea in peace and freedom as an equal partner in the community of nations,

Mindful of the desire of the people in both parts of Korea to live together in peace and freedom in a democratic and parliament state governed by the rule of law and with respect to international law,

In grateful respect to those who peacefully helped freedom prevail and who have unswervingly adhered to the task of establishing Korean unity and are achieving it,

Aware of the continuity of Korean history, the impact of the Korean War, and bearing in mind the special responsibility arising from our past for a democratic development in Korea committed to respect for human rights and to peace,

Seeking through Korean unity to contribute to the unification of North and South Korea and to the building of a peaceful Korean order in which borders no longer divide and which ensures that all Koreans can live together in a spirit of mutual trust,

Aware that the inviolability of frontiers and of the territorial integrity and sovereignty of all states in Asia within their frontiers constitutes a fundamental condition for peace,

Have agreed to conclude a Treaty on the Unification of the Korean Peninsula, containing the following:

CHAPTER I Effect of Unification Article 1 – Unification (1) Upon the signing of this treaty, The North and South Korea shall be known as Korea. Article 2 – Capital City (1) The capital of Korea, the seat of the parliament, and government shall be decided after the establishment of Korean unity. CHAPTER II Government Article 3 – Establishment of a Parliamentary Government (1) Upon determining the seat of the parliament and government, North and South Korea shall undertake to establish a Constitution to govern the affairs of the Parliamentary Government. (2) The Parliamentary Government shall be composed of fifty percent North Korean officials and fifty percent South Korean officials. CHAPTER III International Relations Article 4 – Treaties of The Democratic Peoples’ Republic of Korea (1) The Contracting Parties proceed on the understanding that international treaties and agreements to which the Democratic Peoples’ Republic of Korea is a contracting party, including treaties establishing membership of international organizations or institutions, shall retain their validity and that the rights and obligations arising therefrom. Where adjustments become necessary in individual cases, the all-Korean Government shall consult with the respective contracting parties. Article 5 - Treaties of The Republic of Korea (1) The Contracting Parties proceed on the understanding that international treaties and agreements to which the Republic of Korea is a contracting party, including treaties establishing membership of international organizations or institutions, shall retain their validity and that the rights and obligations arising therefrom. Where adjustments become necessary in individual cases, the allKorean Government shall consult with the respective contracting parties.

CHAPTER IV Nuclear Program Article 6 – Ownership (1) The united Korea shall own the Nuclear Program of the former North Korea. Maintenance for the program shall be on a 50/50 shared basis between the former North and South Korea during its transition period. (2) After fully transitioning into a one Government, maintenance for the Nuclear Programs shall be state funded. CHAPTER V Transitory Provision Article 7 – End of the Korean War (1) This treaty shall signify the end of the Korean War. (2) The Demilitarized Zone shall be kept as a landmark of the past remembering the event and a symbol of unification, recalling the endeavors of the leaders who pushed for the unification. Article 8 – Establishment of One Korean Government (1) Upon the signing of this treaty, the two governments shall endeavor to have sessions for the development of a Constitution that shall establish a one Parliamentary government that shall be the official government of the united Korea. (2) This session shall be done not more than one (1) year from signing. Article 9 – Amendments (1) No amendments shall be done and/or catered after the first meeting of the joint session of the North and South Korean governments. Article 10 – Effectivity (1) This treaty shall be effective immediately after its signing. (2) This treaty shall be deposited to the International Court of Justice.
