The City Secretary shall be responsiblefor the following:

Section2:

Posting notices of City Council and City Board and Commission meetingsas requiredby statelaw (Chapter551, Tpx. Gov'rCooe).

Notification of membersof the City Council and City Attorney at leasttwo hoursbeforeemergencymeetings.

3.

Notification of City officers of appointment to such offices and requestwritten acknowledgment.

4.

All other duties prescribedby state law and City ordinances,City Council direction,and policy.

It is hereby declaredto be the intention of the City Council of the City of Pelican Bay that the sections,paragraphs,sentences,clauses,and phrasesof this ordinance are severable, and if any part of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competentjurisdiction, such unconstitutionalityshall not affect any of the remainingparts of this ordinance,sincethe samewould have beenenactedby the City Council without the incorporation in this ordinance of any unconstitutionalpart.

Section5:

This ordinance shall be and is hereby declared to prevail over all other ordinancesof Pelican Bay affecting the subject matter herein, but shall not operateto repealor affect any suchordinanceor ordinances,exceptinsofar as the provisions of such ordinanceor ordinancesare inconsistentor in conflict with the provisions of this ordinance in which instanceor instancesthose provisions shall be and they are herebyrepealed.

No person other than the City Secretaryand any Clerks designatedby the City Secretaryshall enter or remain in the city's administrative offices exceptduring regularhoursor during city council meetings,

AN ORDINANCE PROVIDING FOR THE SECURITY OF THE PELICAN BAY CITY RECORDSAND FUNDS WITHIN THE CITY'S ADMINISTRATIVE OFFICES, PROHIBITING THE ENTRY INTO SUCH OF'FICESAT ANY TIME AFTER REGULAR BUSINESS HOURS BY ANY PERSON OTHER THAN THE CITY SECRETARY AND ANY CLERKS DESIGNATED BY THE CITY SECRETARY, EXCEPT FOR INCIDENTAL ACCESS BY THE COUNCIL AND MAYOR DURING A COUNCIL MEETING; ESTABLISHING A PENALTY AND AUTHORIZING PUBLICATION. WHEREAS, the PelicanBay City Council finds that the efficient and orderly functioningof the city would be promotedby the limitation of access to funds, records and the combination of the safe within the administrativeoffices of the city to the City Secretaryand any clerks designatedby the City Secretaryby a limitation of after hoursaccess to suchofficesto the City Secretaryand any Clerksdesignatedby the City Secretary; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PELICAN BAY, TEXAS: Sectionl:

The City secretaryand the Clerks designatedby the City Secretaryshall be the only personswho shall have the combination to the safe in the City's administrativeoffices.

Section2:

The regular hours for the city's administrative offices shall be Monday A.M. and through Friday between the hours of _o'clock P.M. except on weekends and legal holidays, when the _o'clock office shall be closed.

Section3.

No person oiher than the City Secretaryand any Clerks designatedby the City Secretary shall enter or remain in the city's administrative offices except during regular hours or during city council meetings,

Section4.

The City Secretaryis authorized and directed to causethe locks on the doors of the City's administrativeoffices and combinationof the safeto be changedor replacedat city expenseto ensuresecurity.

Section5.

Any person violating Section 3. of this ordinance shall be deemed guilty of a misdemeanorand fined in an amount not to exceed$500.00. It shall be a defenseto prosecutionhereunderif the person chargedwas at the time a fire fighter engagedin responding to an emergencywithin such offices.
