WHEREAS, the PelicanBay City Council haspreviouslyacquireda water systemand is constructinga sanitarysewersystem,andit is necessary to acquireeasements for pipesfor suchsystems whichis foundto be a publicpurpose;and WHEREAS, theindividualeasements mustbeappraised andtheappraised priceoffered,and an attemptmustbemadeto agreeon thepriceto bepaid for suchproperty;and WHEREAS, theCity's useof thepowerof eminentdomainmaybe necessary to achieveits publicpurpose;NOW, THEREFORE, BE IT RESOLVEDBY THE CITY COUNCILOF THE CITY OF PELICANBAY, TEXAS: Sectioni:

TIIAT the Counciiherebyfinds thai the acquisitionof the easement irr the propertydescribed onExhibitA heretois necessary for apublicpurpose, to wit: publicwaterandsewerpurposes.

Section2:

THAT the City's attorney,GeorgeStaples,is hereby authorizedto obtain propertyownershipinformationandcausesuchpropertyto be appraisedat the City's expense, to offer the appraised priceandto attemptto negotiate, andif not successful, to instituteeminentdomainproceedings to acquiretheproperty describedon Exhibit A hereto.

Section3:

THAT the Councilherebyauthorizes the depositof the awardof the Special Commissioners into theRegistryofthe CourtandauthorizestheCity's attorney and other officersto take all actionsnecessary to take possession of such property.
