The National Commission on Terrorist Attacks Upon the United States is directed by statute to investigate the facts and circumstances surrounding the September 11, 2001 terrorist attacks, including the nation's preparedness for, and immediate response to, those attacks, as well as to evaluate the lessons learned from those attacks and to make recommendations for preventing future attacks. As part of its investigation, the Commission has issued Arlington County Police Department Document Request No. 1, which is enclosed. ARLINGTON COUNTY POLICE DEPARTMENT DOCUMENT REQUEST No. 1 The National Commission on Terrorist Attacks Upon the United States (the "Commission") requests that the Arlington County Policy Department (ACPD or the "respondent") provide the Commission with copies of the following documents no later than July 25, 2003 (the "production date"): 1. All records, plans or other documents setting forth or discussing ACPD's Standard Operating Procedures (SOPs), duties, protocols and policies in connection with response plans to catastrophes, disasters, terrorist attacks of any nature, and fires or other crises at the Pentagon which were in place on September 10,2001, including, but not limited to, implementing instructions, training manuals, emergency recall plans and guidance, and related materials. 2. The following documents, records or raw data pertaining to ACPD's response to the September 11, 2001 attack (the 9/11 Attack): (i) radio communication tapes and transcripts for ACPD communications on September 11, 2001; (ii) operational logs for September 11,2001 through September 20, 2001 (this ten day period is referred to as "9/11-9/20"); (iii) dispatch records for 9/11-9/20; (iv) internal and external video footage of the ACPD's response from 9/11-9/20 to the 9/11 Attack; and (v) staffing and unit location charts for 9/11-9/20. 3. Records of all interviews conducted in connection with any report (including after-action final reports and "Pentagon Briefings"), study, evaluation, critique, summary or review of the ACPD's response from 9/11-9/20 to the 9/11 Attack, as follows: (i) where a transcript of the interview exists, please provide the transcript; (ii) if no transcript exists, please provide any notes or other memorialization of the interview; (iii) if no notes or other memorialization exist, please provide the taped interview. 4. All incident reports, "Pentagon Briefings," after-action reports, summaries, evaluations, reviews, critiques and studies of the ACPD's response from 9/119/20 to the 9/11 Attack, conducted either internally by the ACPD or by any external entity, as well as all records and materials used to produce such items, including, but not limited to, all records made available to Titan Systems Corporation for its "Arlington County After-Action Report" on ACPD's response to the 9/11 Attack. 5. All documents, records or raw data related to action taken on September 11, 2001 or in response to the 9/11 Attack that pertain to critical information or essential elements of information (EEI) on (i) lifesaving needs, such as evacuation and TEL (202) 331-4060 FAX (202) 296-5545 www.9-llcommission.gov
ACPD DOCUMENT REQUEST No. 1 Page 2 search and rescue; (ii) the status of critical infrastructure and facilities; (iii) the risk of damage to the community from imminent hazards; and (iv) information about the potential for cascading events. 6. All hazard analysis worksheets and hazard profiles in effect as of September 11, 2001 pertaining to the Pentagon, including, but not limited to, information such as (i) frequency and/or likelihood of occurrence; (ii) severity of potential impact; (iii) speed of onset and/or warning time; and (iv) potential for cascading events. 7. All documents and records pertaining to emergency response training exercises prior to September 11, 2001 involving the Pentagon, including, but not limited to, documents such as exercise scripts, major event sequence lists, intelligence scenarios, after-action reports, summaries, evaluations, reviews, critiques, and studies. 8. An up-to-date status report on ACPD actions or plans to implement all Arlington County After-Action Report Annex C, Part I, Sections 1-3 "Recommendations and Lessons Learned." The Commission requests that the documents requested above be provided as soon as they are available, even though all requested documents may not be provided at the same time, through means of a "rolling" production. If any requested documents are withheld from production, even temporarily, based on an alleged claim of privilege or for any other reason, the Commission requests that the respondent, as soon as possible and in no event later than the production date, identify and describe each such document or class of documents, as well as the alleged basis for not producing it, with sufficient specificity to allow a meaningful challenge to any such withholding. If the respondent does not have possession, custody or control of any requested documents but has information about where such documents may be located, the Commission requests that the respondent provide such information as soon as possible and in no event later than the production date. If the respondent has any questions or concerns about the interpretation or scope of these document requests, the Commission requests that any such questions or concerns be raised with the Commission as soon as possible so that any such issues can be addressed and resolved prior to the production date.
