This directive establishes policies and procedures by which the New York Guard appoints or enlists all New York Guard Officer, Warrant Officer and Enlisted personnel. 2. Application. This directive is applicable to all prospective members of the New York Guard Officer, Warrant Officer and Enlisted personnel. a. Format and procedures established in this publication apply to Officer, Warrant Officer and enlisted personnel in the New York Guard. b. This publication is directive in nature. These formats and procedures will be followed except when in the judgment of the commander exceptional circumstances dictate otherwise. 3. Scope. This publication describes policies and procedures by which the New York Guard will appoint or enlist personnel. 4. Basis in Law. Officers and Warrant Officers of the New York Guard will be appointed, commissioned or warranted by the Governor, pursuant to Section 70 paragraph 1, Section 71, Section 79 and Section 165 paragraph 6 respectively, of the Military Law of the State of New York. Enlisted personnel are enlisted pursuant to Section 90 and 91 of the Military Law of the State of New York. 5.

This directive establishes policies and procedures by which the New York Guard will commission or enlist New York Guard Officer and Enlisted Personnel.

NYGD 1304 CHAPTER II RESPONSIBILITIES

1. Commander, New York Guard, will Approve/Disapprove all appointments and/or enlistments of New York Guard personnel. 2. G-1 Headquarters, New York Guard, is responsible for all personnel actions to include but not limited to: a. To review all applications for appointment and enlistment for completeness and correctness. b. To provide guidance and assistance to administrative personnel at all echelons. c. To insure that all personnel are afforded equal opportunity and all actions taken under the provisions of this directive are made without discrimination with regard to sex, race, color, religion, national origin, or marital status. d. To review and recommend approval/disapproval of requested rank, branch and assignment. 3. Commanders of MSCs will: a. Comply with the intent of the directive. b. Disseminate the Directive to all subordinate units and/or make available access to NYG members.

NYGD 1304 CHAPTER III QUALIFICATION FOR APPOINTMENT

1. Initial Appointment Criteria. a. The following categories for appointment in the New York Guard will be considered: (1) Applicants with prior United States military or Organized Militia commissioned service. (Provide documentation). (2) Applicants with prior United States military or Organized Militia enlisted service. (Provide documentation). (3) Applicants with no prior military service. (4) Applicants with prior foreign military service. b. Physical requirements. Applicants must meet the physical requirements as published in the New York Guard Directives 1308 and 6130. c. Age. Applicants must be at least twenty-one (21) years of age. d. Citizenship. Applicants must be citizens of the United States. e. Education. Applicants for enlistment must be high school graduates. Applicants for Commission must have a Bachelor or higher degree from an accredited institution. Applicants for Warrants must be high school graduates and have additional college or and experience per Table III-1. 2. Service obligations. a. No individual will be appointed in the New York Guard who is a member of the armed forces of the United States or of any State or has any service obligation to any of the armed forces of the United States. Retired military personnel or inactive military reservists may be enlisted in the New York Guard, if otherwise found qualified. b. Where the policies of an employer provide that employee membership in a military organization or a component is not permitted, a person will not be appointed into the New York Guard unless the applicant obtains and submits written authorization from such employer. 3. Individuals not authorized for appointment. No waivers will be granted. a. A former member of the Armed Forces of the United States including reserve components and/or the Organized Militia of any state whose separation or discharge documents indicate "not recommended for ReEnlistment or further military service." b. A deserter or an individual "AWOL" from any of the Armed Forces of the United States including Reserve components and/or the Organized Militia of this State of any other State. c. An individual who has been convicted of a felony or other criminal offense by a civil court, punishable by death or imprisonment; and persons under sentence, parole, probation, or suspended sentence from any court. d. An individual having a record of insanity or emotional instability. e. An individual, who does not speak, read and write English.

4. Appointment criteria for personnel with prior United States military commissioned service as officers or warrant officers. a. Appointments will be made to vacant TDA/UMD positions only. b. Appointment may be made in highest former rank/grade held while serving on active federal military duty or reserve component if appointed to a TDA/UMD position which calls for such a grade. Regardless of prior service, an Officer or Warrant Officer must serve at last one year in the New York Guard to be considered for promotion to the next highest rank. Credit for Time in Grade for prior service will applied to Date of Rank up to one year less than the required grade for promotion. c. Appointments may be made, with the consent of the individual, one grade lower than applicants former rank/grade, if a TDA/UMD position in their previous grade is not available for which the applicant qualifies. 5. Appointment criteria for personnel with prior United States military enlisted service. a. A Former NYARNG member who leaves the NYARNG in good standing in the grade of E4 (SP4) and has at least 1 year time in grade (TIG) will enter the NYG in the grade of E5. The soldiers date of rank (DOR) will be his/her NYG entry date. If the soldier has attended the ARNG Primary Leadership Development Course (PLDC) it will fill the military education NYG BNCOC requirement for E6, but the soldier must complete the 24 month TIG as E5 NYG requirement. b. A former NYARNG member who leaves the NYARNG in the grade of E5 with at least 24 months TIG and has completed the ARNG PLDC will enter the NYG in the grade of E6. The DOR will be the NYG entry date. c. A former NYARNG soldier who leaves the NYARNG in the grade of E6 with at least 24 months TIG and has completed Phase I ARNG BNCOC will enter the NYG in the grade of E7. The DOR will be the NYG entry date. d. A former NYARNG soldier who leaves the NYARNG in the grade of E7 with at least 30 months TIG and has completed the ARNG ANCOC will enter the NYG in the grade of E8 with a DOR on the entry date. Completion of the ARNG ANCOC will fill the military education requirement for future promotion to E9. e. In cases where the soldier does not meet the above TIG requirements the soldiers TIG from the NYARNG will be used as the NYG TIG. When the above TIG requirement is met the soldier will be administrative promoted without board procedures. f. In all cases the soldier will be required to complete the required TIG requirements for future NYG promotions. For military education requirements the ARNG PLDC will fill the NYG BNCOC requirement. The ARNG BNCOC will fill the NYG ANCOC requirement and the ARNG ANCOC will fill the requirement for the NYG SNCOC. g. NOTE: The above procedure will also apply to former active and reserve Army, Navy, USMC, USAF and NYANG. Personnel. 6. Appointment criteria for non-prior service personnel. a. Applicants who have college degrees from an accredited institution (baccalaureate degree or higher ) but do not possess a professional degree (doctors, lawyers and chaplain with armed forces ecclesiastical endorsements), must enlist in the New York Guard a grade of Private or Private First Class (depending on age and work experience). After enlistment, they can apply for Officer Candidate School or the Pre-Commission Course depending on their age. The application is subject to the approval of their MSC Commander. They will graduate as Second Lieutenants (OCS) or in the case of PCC they can graduate as First Lieutenants, Captains or Warrant Officers (depending on their qualifications – see table below). The New York Guard Basic Officer Course consists of Pre-Commission Course and Officers Candidate School.

The qualifications for New York Guard Basic Officer Course are as follows: a. Officers’ Candidate School (OCS) – This course is for enlisted personnel who desire to become officers in the NYG. To qualify they must at least have a minimum of a bachelor’s degree from an accredited institution and pass the qualification exam for OCS given each spring. The course lasts approximately 13 months from the AT of the current year until the following AT. Once enrolled, they will wear OCS brass until successful completion of the course when they will be appointed Second Lieutenants (2LT). b. Pre-Commissioning Course (PCC) – Aspirants without prior military service as an officer but who are approved for a commission as an Officer (letter to NYG Commander), have documented demonstrated managerial/supervisory skills and take the Pre Commissioning Course. They will wear OCS brass until successful completion of the PCC and then will be commissioned at the rank recommended by the individual’s commander and approved by the NYG Commander. The individual will attend classes to learn the vocabulary of leadership and staff procedures at the battalion level. The individual must meet the life experiences (documented as supervisory/ managerial) and education (minimum Bachelor Degree from an accredited institution) requirements to apply for the Pre-Commissioning Course (PCC). They will wear OCS insignia until successful completion of PCC; they can be commissioned at the rank specified in Table III-1, below: Table III-1 Minimum Educational Requirements 2LT (O1) *Bachelors Degree 1LT (O2) *Bachelors Degree CPT (O3) *Bachelors Degree * Degrees must be granted by an accredited institution. d. Applicants who hold professional degrees from an accredited college will be commissioned at a rank commensurate with education and job experience as outlined in table III-3 below. Medical Corps - Physicians, Nurses and Dentists, must hold a valid State license to practice in their field. Staff Judge Advocates must be members of a state bar. An appointment as a Chaplain requires Ecclesiastical Endorsement from a religion or denomination recognized by the U.S. Military. Applicants may be commissioned up to the rank of Captain, O-3. Physicians and Dentists may be commissioned up to the rank of Major, O-4. See Table III-3, below. 7. Branch Assignments. Officers will receive a commission in the branch of service appropriate to their professional licensing and TDA position. Female officers will not be commissioned in a combat branch. Former federal and State Defense Force commissioned officers may be commissioned in their prior branch. 8. Appointment policy. a. The initiating MSC or HQ NYG Appointment Board will examine each candidate’s application and make a recommendation for approval or disapproval through the NYG-AG, to the Commander, New York Guard.

9. Processing Procedures of an appointment application. a. Applications for Commission and Enlistment will be forwarded through the appropriate chain of command to Commander, New York Guard, Attn: NYSG-AG. b. Unit Commander will submit executed Oath of Office to Commanding General, New York Guard, Attn: NYSG-AG. Upon receipt of applicants Oath of Office, Headquarters, New York Guard, will prepare appointment orders. f. The date of appointment and date of rank will be the date of the Oath of Office.

NYGD 1304 CHAPTER IV QUALIFICATIONS FOR ENLISTMENT

1. Original Enlistment criteria. Applicants for enlistment in the New York Guard must meet the following requirements: a. Citizenship. Individual must be a citizen of the United States or have declared intention of becoming a citizen of the United States as evidenced by Immigration and Naturalization Service Form N300 (US Department of Justice). The form must be furnished for review to the initiating unit commander for the proper completion of the Enlistment Record. (A notarized copy of INS Form N300 is acceptable.) b. Age. Applicants must be at least seventeen (17) and not over sixty-five (65) years of age. Applicants that have not reached their eighteenth (18th) birthday will complete Parental Consent Form. (NYG Form 665) c. Physical requirements. Applicants must meet the physical requirements as published in New York Guard Directive 1308. 2. Service obligations. a. No individual will be enlisted in the New York Guard who is a member of the armed forces of the United States or of any State or has any service obligation to any of the armed forces of the United States. Retired military personnel or inactive military reservists may be enlisted in the New York Guard, if otherwise found qualified. b. Initial enlistment in the New York Guard will be for a period of three (3) years. Individuals must qualify in accordance with paragraph 7 and 8 of this chapter. 5. Enlisted Grades. New York Guard enlisted grades will be as indicated in the Table of Distribution and Allowances. (TDA) or Unit Manning Document (UMD) See Table IV-1

Enlistment criteria for personnel with prior military service. a. Individuals must have served on active duty with the armed services of the United States or have served in the active Reserve or National Guard of the United States or in the organized military forces of any state, and must have an honorable discharge/separation. Persons who have served in the Armed Forces of friendly nations may be considered under these criteria. b. Individuals may be enlisted in their last former rank if TDA/UMD position in that rank/grade is vacant. (Discharge certificate or other documented proof of rank/grade must be attached to the enlistment packet.) 7. Original enlistment criteria for personnel with non-prior military service. a. Maximum age for enlistment is fifty-five (55) years of age. b. Upon completing twelve- (12) month’s service, individuals may become eligible for promotion in accordance with special criteria for non-prior service personnel. Personnel considered for the special promotion criteria must have attended Annual Training (AT) and maintain a minimum of 75% attendance at administrative drills, and training drills during this period. c. Having met the criteria established in paragraph b above, individuals become eligible for promotion based on civilian acquired skills. Maximum rank/grade to be considered under these special promotion criteria shall be SSG E-6. This special promotion eligibility is limited to one promotion only during individual’s service in the New York Guard. The should state that the civilian skill should be management in a civilian skill should be in a management field related to the soldiers TOE position. Further promotion shall be in accordance with the regular promotion procedures and policy as outlined in Chapter IV, NYG Directive 1305, dated 15 January 2001 (see Table IV-2) Rank E-2 E-2 E-2

8. Recommendation for Enlistment in the New York Guard. a. An enlistment packet and recommendation for enlistment in the New York Guard will be prepared by the unit concerned and signed by the Unit Commander and/or respective S-1 (G-1 for NYG Headquarters personnel enlistments),

and forwarded through channels to the Commanding General, New York Guard, Attn: NYSG-AG for approval/disapproval. b. All applicants will undergo a background history review. They will be eligible for enlistment after the review has been completed, providing there is no information that would disqualify the applicant under law and regulations. d. Upon approval of appointment, Headquarters, New York Guard, will provide Unit Commander with a letter of approval authorizing the Unit Commander to administer the Oath of Office. e. Unit Commander will submit executed Oath of Office to Commanding General, New York Guard, Attn: NYSG-AG. Upon receipt of applicants Oath of Office, Headquarters, New York Guard, will prepare enlistment orders. f. The date of enlistment and date of rank will be the date of the Oath of Office. g. 9. Extension of Enlistment. a. An enlistment in the New York Guard may be voluntarily extended at the Expiration Term of Service (ETS) by executing an agreement to extend the enlistment for three (3) years. (Original and one copy of NYG Form 660.) Example: If an enlistment/re-enlistment occurred on 10 February 20XX for a period of three (3) years, the ETS date will be 9 February three years later. The date of the new Extension of Enlistment will be 10 February, exactly three years after the date of the prior enlistment/re-enlistment. b. When the extension of enlistment has been executed, the unit commander will submit the original completed NYG Form 660, Extension of Enlistment, through channels, to Headquarters, New York Guard, Attn: NYSG-G1.

NYGD 1304 CHAPTER V PERSONNEL RECORDS

1. Personnel Records. The documents required for Appointment or Enlistment in the New York Guard form the basis for the military record of the individual during his/her military service in the New York Guard. This record is known as the Military Personnel Records Jacket or MPRJ. Upon separation from military service this MPRJ will retained as part of the permanent records of the Division of Military and Naval Affairs of the State of New York. 2. Required Actions. a. New York Guard forms for Enlistment or Appointment will be prepared as indicated in paragraph 3. b. Original packets will be submitted to Commander, New York Guard: Attn AG. Field file (duplicate documents of the MPRJ except for Form s 88 and 93) will remain with individual's unit of assignment. No medical forms are to be kept in a Field MRPJ. c. Request for re-enlistment: NYG Form 660, in duplicate will be initiated and completed by the unit commander. Original to be submitted to Commander, New York Guard, no later than fifteen (15) days after completed personnel action, Attn: NYSG-AG. 3. Completing the forms. a. Initial appointment. Prepare all forms in duplicate. Original documents are to be forwarded to Commander, New York Guard, Attn: AG. Duplicate forms to be retained by initiating unit placed in individual’s Field MPRJ file, to be maintained at unit level. (2) NYG Form 611 Agreement of Understanding. Complete all items. (3) NYG Form 615 Authorization for release of information. Complete all items. (4) NYG Form 620 Personal History. Complete all items (5) NYG Form 620-A Personal History Questionnaire. Complete all items (6) NYG Form 625 Service Record. For initial entry into the NYG, complete items: 1, 2, 3 and 4. If applicant has prior military service, complete all items that are applicable. (7) NYG Form 88 Report of Medical Examination. (a) Items 1 through 15 may be completed by initiating unit personnel. (b) Optional items: 44 through 50, 56, 58 through 72, 76, 81. (c) Items 17, 82, leave blank. (d) All items must be completed and signed by medical officer and/or private physician. (8) NYG Form 93 Report of Medical History. (a) Initiating unit personnel may complete items 1 through 7. (b) Applicant will complete item 8 through 24 with signature of examinee. (c) Item 25 to be completed by medical officer and/or private physician. Physician's signature required at end of report. (9) NYG Form 660 Oath of enlistment/re-enlistment. Written approval from Headquarters, New York Guard is required in order to administer oath of enlistment/reenlistment. Original document is submitted to Headquarters, New York Guard.
