European Union -Measures Affecting Tariff Concessions on Certain Poultry Meat Products

Dispute of Case On 8 April 2015, China requested consultations with the European Union regarding measures to modify the European Union tariff concessions on certain poultry meat products.
Council Proceeding:
On 8 June 2015, China requested the establishment of a panel. At its meeting on 19 June 2015, the DSB deferred the establishment of a panel. At its meeting on 20 July 2015, the DSB established a panel. Brazil, the Russian Federation and the United States reserved their third-party rights. Subsequently, Argentina and Canada also reserved their third‑party rights.
On 23 November 2015, China requested the Director-General to compose the panel. On 3 December 2015, the Director-General composed the panel. On 11 July 2016 the Chair of the panel informed the DSB that the panel expected to issue its final report to the parties by early December 2016, considering the complexity of the legal issues and in accordance with the timetable adopted by the panel after consultation with the parties. On 28 March 2017, the panel report was circulated to Members.
Articles GATT 1994: Art. I, I:1, II, II:1, II:2, XIII, XIII:1, XIII:2, XXVIII China's Claims Under Article I: Article I:1 of the GATT 1994 prohibits discriminatory measures in connection with importation that confer an "advantage, favour, privilege or immunity" to products from certain countries and not to like products from other countries.
Conclusion WTO is "to preserve the rights and obligations of Members under the covered agreements, and to clarify the existing provisions of those agreements in accordance with customary rules of interpretation of public international law."
