September 5, 2003 Dan Marcus, General Counsel National Commission on Terrorist Attacks Upon the United States 2100 K Street, NW, Suite 300 Washington, DC 20036 Dear Mr. Marcus: This responds to item 14 in the Commission's Document Request No. 5 to the FBI, which requested information about the Department's declinations pursuant to 18 U.S.C. 2339A or 2339B during the period from 1996 through September 11, 2001. Department records indicated that 37 United States Attorneys' Offices had declined cases under Section 2339. Since the additional requested information was not readily retrievable in the Department's computerized systems, the Executive Office for United States Attorneys contacted those United States Attorneys' Offices to obtain the particular information responsive to your request. The data is collected on a fiscal year basis, October 1 through September 30. There were 23 decimations under section 2339A and nine declinations under section 2339B between October 1, 1994 and September 30, 2001. The breakdown by Fiscal Year is as follows: 2339A Decimations

FY 95 - One FY 96 - One FY 97 - Four

FY 98 - One FY 99 - Zero

FY 00 - One •

FY 01- Fifteen (one of which was re-opened under 2339A under another name - the reopened case is active)
