MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS: This AGREEEMENT made and entered into this______ day of___, 2019 in the City of Borongan, province of Eastern Samar Philippines by and between: The PROVINCE OF EASTERN SAMAR, herein represented by Governor, Honorable MARCELO FERDINAND A. PICARDAL with official address at the Provincial Capitol, Borongan City, herein referred to as the PROVINCE; and the SCHOOL. The QUINPAONDNDAN NHS-ANISLAG ANNEX, QUINAPONDAN EASTERN SAMAR, Represented by herein by the Head Teacher In-Charge TITO D. DADULLA, referred to as the SCHOOL. Withneset: Whereas, the PROVINCE as apolitical corporate unit in the government serve as the dynamic mechanism for the development processes of LGUs and institution within its territorial jurisdiction. Whereas, the SCHOOL, in order to realize social/community services has sought assistance from the Provincial Government for __________________________________________________________________________; Whereas, the SCHOOL

__________________________________________________________________________: NOW THEREFORE. for and in consideration of the forgoing premises, and the stipulations and covenants hereunder, the PROVINCE and the SCHOOL have mutually agreed as follows to with: The PROVINCE

DONATIONS shall provide

for _________________________________________________________________________; 1. The PROVINCE shall be free from any obligation arising from any misuse of the said equipment; 2. The PROVINCE shall have the right to intervene and institute corrective measures to preserve the equipment in case but not limited to misuse and non-compliance with any provision stated in the AGREEMENT; 3. Representing Project Cost (RPC) shall returned by the SCHOOL to the PROVINCE in case of: 3.1. Misuse of Equipment, and 3.2. Non-compliance with any provision stated in this AGREEMENT. 4. Upon transfer of equipment, authorized representative shall prepare an ACKNOWLEDGEMENT RECEIPT OF EQUIPMENT (ARE) to be signed by the authorized representative of the SCHOOL, to be submitted to the province immediately;
