MINUTES OF A SPECIALMEETING AND WORKSHOP OF THE GOVERNINGBODY OF PELICA}{ BAY On this the 16th day of March,,2004, the Council of the City of Pelican Bay convened in a special meeting, the same being open to the public at the regular meeting place thereot in the City Hall, and notice of said special meeting having time, place and subject thereof, having been posted as prescribed in Article 6261-17V.S.C.S.

CALL TO ORDER. Mayor Nightingale Called the meeting to order at 6:34 p.m.

2. ROLL CALL. Alderman Keller, Alderman Davis, Alderman Sparks and Alderman Buel were present. REVIEW AND CONSIDER APPROVAL OF ORDINANCE 167 REPEALING ORDINANCE 150 AND ESTABLISHING A MUNICIPAL COURT TECHNOLOGY FUND. Alderman Keller moved to approve Ordinance 167 repealing Ordinance 150 and establishinga Municipal Court Technology Fund. Alderman Sparks secondedthe motion that passedby a vote of 4/FOR and O/OPPOSED. A

REVIEW AND APPROVE GUTA LOAN. A motion was made by Alderman Sparks to not approve the GUTA loan. The motion was secondedby AldermanDavis and passedby a vote of 4/FOR and OiOPPOSED. R-EVIEW AND CONSIDER INCREASE IN DELINQUENT TAX PENALTIES. Alderman Sparks moved to approve the increasein delinquent tax penalties. Alderman Buel secondedthe motion. After discussion,Alderman Davis moved to table the motion for lack of information. Alderman Buel withdrew his secondand Alderman Sparks withdrew his motion. Alderman Buel secondedthe motion to table the item for further information. The motion to tablepassedby a vote of 4/FOR and 0/OPPOSED. ADJOURN TO WORKSHOP. The Council met in workshopforum to review employerpolicies and procedures..

REVIEW AND CONSIDER APPROVAL OF THE CITY COUNCIL MINUTES FOR THE PREVIOUS MEETING. Alderman Keller moved to approve the minutes of February 1Ofrand February I 7thas amended.Alderman Sparkssecondedthe motion that nassedbv a vote of 5/FOR and 0/OPPOSED.

REVIEW CITY OF RENO CONTRACT. A motion was madeby Alderman Sparksto cancelon March 3l , 2004 the City of Reno Conhact. The motion was secondedby Alderman Schneiderand passedby a vote of 4/FOR and l/OPPOSED.

REVIEW AND APPROVE AMENDMENT TO ORDINANCE 150 REGARDING THE COMPUTER TECHNOLOGY FEE. A motion to table the amendmentto Ordinance150 was madeby Alderman Schneiderand secondedby AldermanSparks. The motion passedby a vote of 5/FOR and O/OPPOSED.

DISCUSS "O'TOLERANCE ON DRUGS PROGRAM. Mayor Nightingale explainedthe "O" Tolerance on Drugs Program and Interim Chief Clark spoke about the inter-local agreementwith the TarrantCounty Task Force Committeeon Narcotics. The Council and the citizenswere pleasedwith the new program.

DISCUSS CHANGE TO DELINQUENT TAX PENALTIES. Alderman Schneidermoved to table considerationof tax penaltiesuntil the March 16thSpecialMeeting. Alderman Davis secondedthe motion that passedby a vote of 5/FOR and 0/OPPOSED.

REVIEW AND APPROVE AN ORDINANCE ESTABLISHING A TEMPORARY MORATORIUM ON ISSUANCE OF BUILDING PERMITS AND MOVING PERMITS. Alderman Schneidermoved to approve Ordinance 166 establishinga temporary moratorium on building and moving permits. Alderman Keller secondedthe motion. Alderman Sparksmoved to table any action item on this ordinanceuntil Items 9 and 10 had been actedupon. Alderman Keller secondedthis motion. Alderman Keller withdrew her secondand Alderman Schneiderwithdrew her motion. The motion to table the item then passedby a vote of 5/FOR and 0/OPPOSED.

REVIEW AND APPROVE GTUA LOAN. Alderman Sparksmoved to table considerationand approval of the loan until the March 176 specialmeeting. The motion was secondedby Alderman Schneiderand passedby a vote of 5/FOR and O/OPPOSED.

10. REVIEW AND APPROVE UPCOMING ORCA APPLICATION. Alderman Schneidermoved to authorize Lawrence & Associatesto apply for ORCA funds and Alderman Keller secondedthe motion that passedby a vote of 5/FOR and O/OPPOSED"
