Explanation – Bylaw No. 4765 Bylaw 4765 revises the Langley Cemetery Bylaw 1994 No. 3202 to remove all references to Fees and Charges. These changes will be effective the day following adoption of Amendment Bylaw 2009 No. 4765. All references to Fees and Charges pertaining to cemetery operations can now be found in Langley Fees and Charges Bylaw. Langley Cemetery Bylaw Amendment.pdf 3. Fire Prevention Bylaw 2005 No. 4410 Amendment Bylaw 2009 No. 4766 Report 09-103 File FIN 3900-20 Recommendation that Council give first, second and third reading to Fire Prevention Bylaw 2005 No. 4410 Amendment Bylaw 2009 No. 4766. Explanation – Bylaw No. 4766 This Bylaw repeals and replaces Fire Prevention Bylaw 2005 No. 4410 by deleting Schedule “A” Fees and Charges – Cost Recovery and other housekeeping amendments. The primary focus is to regulate fire prevention and suppression, specifically dealing with fire risks, alarms, hazardous activities, fire emergency planning, signage, egress, flammable and combustible liquids, fire hydrants and connections, open air burning, fees and costs, and enforcement. Recommendation that Council give final reading to “Erosion and Sediment Control Bylaw 2006 No. 4381 Amendment Bylaw 2009 No. 4754”. Explanation – Bylaw No. 4754 Bylaw No. 4754 amends Erosion and Sediment Control Bylaw 2006 No. 4381 by updating and amending clauses and definitions for consistency with related Bylaws, Township Policies and the current Best Management Practices for erosion and sediment control. Rezoning Application No. 100319 (Fernridge Place) Bylaw No. 4729 Report 09-31 File CD 07-15-0038 Recommendation that Council give final reading to “Township of Langley Zoning Bylaw 1987 No. 2500 Amendment (Fernridge Place) Bylaw 2009 No. 4729”. Explanation – Bylaw No. 4729 Bylaw No. 4729 rezones a 0.51 ha (1.26 acre) portion of property located at 2107 - 200 Street from Suburban Residential SR-2 to a new Community Care Facility Zone P-2N to permit expansion from six (6) to fifty one (51) beds of an existing specialized residential care facility for persons with developmental disabilities. Clerk’s Note: Please note that all development prerequisites listed in the Community Development Division report to Council of March 23, 2009 attached to the bylaw have been satisfactorily addressed. The Public Hearing for the bylaw was held on April 20, 2009 with 3 rd reading given on May 11, 2009.

Explanation - Bylaw No. 4718 Bylaw No. 4718 rezones property located at 20327 96 Avenue and the vacant lands to the west from General Industrial Zone M-2 and Rural Zone RU-1 to Comprehensive Development Zone CD-14 to accommodate a four (4) lot service industrial / commercial subdivision. compliance with the Township’s Street Tree and Boulevard and Treatment program to the acceptance of the Manager of Parks Design and Development; Signage to be in substantial compliance with Schedule “N” and in compliance with the Township of Langley Sign Bylaw; Fascia signage shall consist of channel lettering; Rooftop mechanical equipment to be located so that it is not visible from adjacent roads or alternatively to be screened from view by compatible architectural treatment; Garbage facilities to be located within screened enclosures and screened from view by compatible architectural treatment; Section 914.4 of the Township Zoning Bylaw 1987 No. 2500 being varied from a minimum 5.0 metre side lot line setback from a flanking street to permit a minimum 2.0 metre side lot line setback from a flanking street as shown in Schedule “C”;

Although not part of the Development Permit requirements, the applicant is advised that prior to the issuance of a building permit the following items will need to be finalized: h) i) j) k) l)

Landscaping (including the buffer / trail) and boulevard treatment to be secured by letter of credit; Compliance with the Township’s Exterior Lighting Impact Policy, including the provision of an Exterior Lighting Impact Plan to the acceptance of the Manager of Permits and Licences Department; Issuance of an Erosion and Sediment Control permit in conjunction with the Township’s Erosion and Sediment Control Bylaw; Submission of a stormwater management plan to the acceptance of the General Manager of Engineering; Payment of supplemental Development Permit application fees.

Clerk’s Note: Please note that all development prerequisites listed in the Community Development Division report to Council of February 16, 2009 attached to the Bylaw have been satisfactorily addressed. The Public Hearing for the Bylaw was held on March 9, 2009 with 3 rd reading given on March 23, 2009. Also, please place accompanying Development Permit No. 100562 on the same agenda for issuance by Council. Please note that the Development Permit has been revised to reflect changes to the development plans as discussed at the Public Hearing. At the Public Hearing, some residents from the adjacent Chelsea Green development expressed concerns regarding potential noise exposure from the development's light industrial activities (primarily noise generated from commercial vehicles). To reduce potential noise impacts on Chelsea Green, the applicant has proposed to construct a landscaped 4.5 m (15 ft) high continuous concrete screen wall along the eastern property line between buildings A and D (adjacent to the development's parking and loading areas). According to a noise study prepared by BLK Consultants Ltd., the wall will reduce potential noise impacts on Chelsea Green by 15 dBA or more and will be approximately 25% less than the maximum permitted by the Township's Noise Control Bylaw. Development Permit No. 100562 has been revised as follows: modifying Schedules F and I and adding Schedule O to show the continuous wall.

At the June 22, 2009 Special Meeting of Council Councillor Fox provided the following notice of motion: Proposed Water Management Plan Whereas there is considerable concern and continuing issues with wells and their draw on the aquifers in the Township of Langley; and Whereas there is need to address the issues associated with wells in an expedient manner; Therefore be it resolved that we move to implement recommendations #1, #7, #12, #13, #21 and #23 to the proposed Water Management Plan commencing immediately; and further That staff investigate funding for the implementation of these recommendations with the Provincial Government; and further That staff investigate an implementation strategy to provide an incentive to encourage residents to cap unused wells.
