PEDROSA, of legal age, Filipino, single, and a resident of Naganaga, Palo, Leyte, after having been sworn to in accordance with law, depose and say: That a certain Michael R. Montejo is one of the legitimate heirs and adjudicatee of a parcel of land left by the Late Mariano C. Montejo and Maximina C. Montejo by virtue of the Extrajudicial Settlement of the Estate of Mariano C. Montejo and Maximina C. Montejo entered into by the surviving heirs of the above-named decedents which parcel of land is more particularly described as follows; “A portion of a parcel of land bearing Lot No. 9709-B-6, Title no. P-96489, in the name of the Heirs of Mariano Montejo under Tax Declaration No. : 08-30-0023-04120, bounded on the North by Cad. Lot # 9710 & 9709-A; on the South by Creek with Legal easements; on the East by National Road; and on the West by Cad. Lot # 9713 & 9710; which contains a total area of TWO HUNDRED TWENTY (220) square meters more or less That on September 18, 2017, Michael R. Montejo executed a Deed of Absolute Sale of a Portion of Land in my favor, which document is more particularly identified as Document No. 449, Page No. 91, Book No. I, Series of 2017 in the Notarial Register of Notary Public Atty. Jessica Joy U. Bendoy and a copy of which is attached herein; That in said Deed of Absolute Sale, Michael R. Montejo, for valuable consideration received, CEDED, TRANSFERRED AND CONVEYED to me, my heirs, successors and/or assigns, all his rights, interest and participation in the aforedescribed parcel of land; That as such, Michael R. Montejo has since then relinquished all his rights, interest and participation over the aforedescribed parcel of land in my favor. That unless an adverse claim is annotated on the aforedescribed Transfer Certificate of Title, I am in danger of being defrauded and deprived of my just and valid right over the aforedescribed parcel of land and, as such, I am executing this Affidavit in support of my request for the annotation of an adverse claim over the parcel of land described herein.
