Take Down Notice Ito Ect Act

Take down notice in terms of section 77 of the Electronic Communications and Transactions Act, No. 25 of 2002. I, Joe Smith, state that:

1. I am an adult male businessman with my principal place of business being Office, Street, City, Country. 2. The information contained in this statement is, to my knowledge, both true and correct. 3. I am filing this notice in good faith. 4. I am the proprietor of a website located at http://www.mywebsite.co.za which has been registered in my name since 2000 (proof of registration is enclosed). I am the author of content I have posted to my website. 5. I reserve all rights to my content and do not permit other websites to publish my content.

6. It has come to my attention that a website located at http://www.copycats.co.za ("the offending website") is hosted by Acme Service Provider. The offending website contains copies of my content without my permission and is therefore infringing my copyright in and to my content.

7. The offending website is accessible by and targets South Africans and therefore falls under the purview of the Electronic Communications and Transactions Act, No. 25 of 2002 which provides for a "take down" procedure for rights infringements that go beyond copyright infringement. I am invoking this procedure in terms of section 77 of that Act.
