The Northeast Air Defense Sector (NEAD) Senior Director log for the 24-hour period beginning with the morning shift change on 9/11/01, and the logs for any subordinate desks in the Sector Operations Control Center (SOCC) that recorded events related to the hijackings on 9/11/01 and NEAD's response, including logs for the Surveillance Technician, the Identification Technician, and the Weapons Director. The First Air Force/Continental Air Defense Region (CONAR) senior duty officer log for the 24hour period beginning with the morning shift change on 9/11/01, and the logs for any subordinate desks that recorded events related to the hijackings on 9/11/01 and First Air Force/CONAR's response. 10. All DoD after-action reviews relating to the events of 9/11/01, including documents relating to the graphic depiction of the events of 9/11/01 presented to a National Reconnaissance Office Conference on June 3, 2002, by Cherie Gott, and the review of scramble activity for the First Air Force and Continental Air Defense Region (CONAR) on 9/11/01 completed by the Chief of Staff (Colonel Scott) or other officials in 2002. 11. Protocols between NORAD and the FAA concerning hijacked airplanes in effect on 9/11/01, and current protocols concerning hijacked airplanes. 12. Protocols between NORAD and law enforcement agencies, including the U.S. Secret Service, concerning hijacked airplanes in effect on 9/11/01, and current protocols concerning hijacked airplanes. 13. All documents relating to communications between NORAD and the FAA concerning the tracking of the hijacked airplanes on 9/11/01. 14. All documents relating to communications between NORAD and law enforcement agencies, including the U.S. Secret Service, concerning the tracking of the hijacked airplanes on 9/11/01. 15. Joint Surveillance System radar files from the 84th Radar Evaluation Squadron (Air Combat Command) relating to the airplanes hijacked on 9/11/01, the responding fighters, and the flights of Air Force One on 9/11/01, as well as the RS3 software to run the radar files. 16. Current organization charts for OSD, JCS, NORAD, First Air Force, CONAR, and NEAD, and organization charts for the same components in effect on 9/11/01. 17. Two copies of the current DoD phone book, and two copies of the DoD phone book in effect on 9/11/01. 18. Access to all documents provided by DoD to the Congressional Intelligence Committees' Joint Inquiry regarding the terrorists attacks on 9/11/01. The Commission requests that documents requested above be provided as soon as they are available, even though all requested documents may not be provided at the same time, through means of a "rolling" production. If any requested documents are withheld from production, even temporarily, based on an alleged claim of privilege or for any other reason, the Commission requests that the respondent, as soon as possible and in no event later than the production date, identify and describe each such document or

Transcripts of all communications and orders conveyed to pilots scrambled in support of the North East Air Defense Sector's (NEADS) response to the hijackings of 9/11. 6. All transcripts, tapes and other documents of the parent wings of aircraft scrambled in support of NEADS' response on 9/11, related to the response of such aircraft to the hijackings of 9/11. 7. All transcripts, tapes and other documents of the Air Force Bases from which aircraft were scrambled in support of NEADS's response on 9/11, related to the response of such aircraft to the hijackings of 9/11. 8. The pilot logs for each pilot that was scrambled in support of NEADS' response to the hijackings on 9/11, including but not limited to the pilots that scrambled out of Otis Air Force Base, Langley Air Force Base, Andrews Air Force Base, Toledo Air Force Base and Selfridge Air Force Base.

The Air Traffic Control Logs for each base from which fighters were scrambled in support of NEADS' response on 9/11, including but not limited to: Otis Air Force Base, Langley Air Force Base, Andrews Air Force Base, Toledo Air Force Base and Selfridge Air Force Base. 10. All NORAD logs related to the exercise VIGILANT GUARDIAN, beginning with the morning shift change on 9/11 and for the 24-hour period thereafter. 11. Intelligence scenarios and briefing papers for all national military exercises, since January 1993, in which a plane was hijacked and/or used as a weapon and which involved any of the following DoD entities: NORAD, JCS, and Special Operations Command (SOCOM). 12. The final briefing and intelligence scenarios for NORAD Exercises AMALGAM VIRGO 01 and 02. With regard to AMALGAM VIRGO 02, please provide documentation of the scenario as it existed prior to 9/11 as well as the version used in the actual exercise. 13. All documents of the Office of the Assistant Secretary of Defense (Special Operations/LowIntensity Conflict) prepared for or signed out by the Assistant Secretary, that address the mission of NORAD. 14. Portions of the following Office of the Secretary of Defense (OSD) documents that relate to NORAD: (a) Defense Planning Guidance (b) Contingency Planning Guidelines This request includes current versions of the aforementioned documents, and those versions that were in effect on 9/11/01. 15. Portions of the following Joint Chief of Staff (JCS) documents that relate to NORAD: (a) Joint Strategic Capabilities Plan (b) Joint Strategic Review (c) Joint Warfighting Capabilities Assessment (JWCA) for Combating Terrorism This request includes current versions of the aforementioned documents, and those versions that were in effect on 9/11/01. With respect to those documents that were in effect on 9/11, please provide the staffing package that accompanied the documents when submitted for approval by the Director of the Joint Staff. 16. Portions of the following NORAD documents that relate to domestic air defense and/or combating terrorism: (a) Integrated Priority List (b) Requirements Review Report This request includes current versions of the aforementioned documents, and those versions that were in effect on 9/11/01.

Documents that establish the universe of military aircraft, other than air defense aircraft, that were airborne within 150 nautical miles of the New York City and Washington D.C. areas, anytime from 0800 to 1030 hours on the morning of 9/11/01. The documents should include the takeoff time, flight plan, and ordnance load of such aircraft. 19. An Information Paper or fact sheet that establishes how clocks were synchronized and to what standard on 9/11/01 for the following: the Joint Surveillance System radar tapes, the National Military Command Center logs, the Cheyenne Mountain Operations Center logs, the Northeast Air Defense Sector logs, and the First Air Force/Continental Air Defense Region logs. 20. The final briefing and intelligence scenario for the National Reconnaissance Office (NRO) exercise scheduled on 9/11 concerning a plane crash into NRO headquarters. 21. The final briefing and intelligence scenario for the October 24-26, 2000 emergency drill based upon the crashing of an airliner into the Pentagon. 22. The final briefing and intelligence scenario for the May 2001 DoD training of medical personnel to respond to a guided missile in the form of a hijacked 757 airliner crashing into the Pentagon. 23. All files of Lt. Col. Dawne Deskins, USAF, Northeast Air Defense Sector, related to the hijackings of 9/11. 24. There are conflicting accounts of when NORAD first received notification from the FAA that American Airlines Flight 11 had been hijacked. Please provide all documents relating to the FAA's notification to NORAD of the hijacking of Flight 11. 25. The National Military Joint Intelligence Center (NMJIC) Senior Duty Officer log for the 24hour period beginning with the morning shift change on 9/11, and for any subordinate desks that recorded events related to the hijackings on 9/11. 26. The National SIGINT Operations Center (NSOC) Senior Duty Officer logs for the 24-hour period beginning with the morning shift change on 9/11, and for any subordinate desks that recorded events related to the hijackings on 9/11. 27. The National Imagery and Mapping Agency (NIMA) logs that document imagery requests and responses for the 24-hour period beginning with the morning shift change on 9/11. 28. The Alternate National Military Command Center (ANMCC) Senior Duty Officer log for the 24-hour period beginning with the morning shift change on 9/11, and for any subordinate desks that recorded events related to the hijackings on 9/11. 29. The National Emergency Airborne Command Post (NEACAP) Senior Duty Officer log for the 24-hour period following activation of the Command Post.

Final data from the Defense Special Missile and Astronautics Center (DEFSMAC) that establishes the time of impact for each of the hijacked aircraft. 35. Copies of the JCS/DoD message to commanders, worldwide, raising the threat level to "Delta." 36. Copies of the JCS/DoD Order raising the defense condition to DefCon 3. The National Commission on Terrorist Attacks Upon the United States (the "Commission") requests interviews with the pilots and other personnel that were involved in the Department of Defense's response to the hijackings of September 11, 2001. Outlined below are three air force bases (and corresponding fighter wings) from which planes were scrambled on the morning of September 11, 2001. The Commission would like to visit each of these sites, receive a short briefing on the facility and its operations, and conduct interviews with the Commanding Officer, Director(s) of Operations, pilots, and other personnel that were directly involved in the air defense operation on September 11, 2001. In order to facilitate the scheduling of these visits, the Commission requests that the Department of Defense ("DoD") designate points of contact at each location to coordinate arrangements and schedules. The Commission further requests that DoD provide the Commission with the list of names of the individuals described in paragraph one above, and current contact information if an individual is no longer assigned to the facility or is no longer in the military. Finally, the Commission reserves the right to request additional interviews with individuals at these facilities, should the Commission discover on site that such individuals have information relevant to the events of September 11, 2001. DOD INTERVIEW REQUEST No. 2 The National Commission on Terrorist Attacks Upon the United States (the "Commission") requests interviews with personnel from the North American Aerospace Defense Command ("NORAD") that were involved in NORAD's response to the events of September 11, 2001. Outlined below are personnel, described by position, at three separate NORAD locations. The Commission would like to visit each of these sites, receive a briefing on each facility and its operations, and conduct interviews with the individuals who held these positions and any other position that was closely involved in orchestrating NORAD's response to the events of September 11,2001. hi order to facilitate the scheduling of these visits, the Commission requests that the Department of Defense ("DoD") designate points of contact at each location to coordinate arrangements and schedules. The Commission further requests that DoD provide the Commission with a list of names of the individuals described in the paragraph above, and current contact information for individuals no longer assigned to the facility or no longer in the military. Finally, the Commission reserves the right to request additional interviews with individuals at these facilities, should the Commission discover during the site visits that such individuals have information relevant to the events of September 11, 2001.

The National Commission on Terrorist Attacks Upon the United States (the "Commission") requests that the Department of Defense (DoD or the "respondent") provide the Commission with a copy of the following document no later than February 10,2004 (the "production date"): 1. The report referenced in a Washington Post article dated January 5, 2004, entitled "Military Split on How to Use Special Forces in Terror War." According to the Washington Post article, the report is classified, was authored by a DoD consultant named Richard H. Shultz, Jr., and relates to why U.S. forces were allegedly not dispatched to kill or capture terrorists responsible for several major terrorist attacks against the United States. The Commission requests that the document requested above be provided as soon as it is available.

A classified DoD report on the war on terrorism authored by Pentagon consultant Richard H. Shultz, Jr., a scholar at the Fletcher School of Law and Diplomacy at Tufts University, which is referenced in a January 5, 2004 Washington Post article entitled "Military Split On How to Use Special Forces in the Terror War" by Gregory L. Vistica. Among other subjects, the requested document reportedly discussed why Special Mission Units were not used to respond to the 1993 attack on the World Trade Center, the 1998 bombings of U.S. embassies in East Africa, or the 2000 attack on the USS Cole.

The National Commission on Terrorist Attacks Upon the United States is directed by statute to investigate the facts and circumstances surrounding the September 11,2001 terrorist attacks, including the nation's preparedness for, and immediate response to, those attacks, as well as to evaluate the lessons learned from those attacks and to make recommendations for preventing future attacks. As part of its investigation, the Commission hereby requests to interview you on issues relating to the following general topic: U.S. military preparedness, including use of Special Operations Forces, for combating terrorism since 1998. Bonnie Jenkins, counsel to the Commission, will make the arrangements for your interview.
