Updated Compartmented Access and Dissemination Guidelines

Updated access guidelines are listed below, revised to include comments and new information. We will update ahd revise this list as needed. All cleared commissioners have access to all materials,; subject to the dissemination guidelines indicated below. The following staff should haveiaccess to a// material held at the Commission and so there is no need to repeat them iri the various categories below: Zelikow, Kojm, Marcus, Campagna, Ivicie, Kaplan, MacEachin, and May. Other members of Teams 1 4 4 should be read into the usual SCI compartments, plus HCS and| [although actual distribution of materials should be handled as indicated below. \ 1.

Designated Sensitive Material (DSM, or just "D")

This is an internal Commission designation, not an official codeword of the intelligence community. Any material you receive marked in this way should not be scanned into any Commission database. It should be held either in the safe in the locked and alarmed 'server room' at our K Street office or in the safe in my office. This material may be read only in the; 'server room' or in my office. It may not be copied or removed. Any notes made from this material must be kept with the material, marked with this internal designation, and handled under the same restrictions. Current Commission staff who;, when Cleared at the TS/SCI level, should have access to DSM: \, Roth, Grewe, Jacobsonj Team l\. Covert action material

Any material we receive marked with thc| Codeword will be examined to determine if it deals with covert action. If so, mark it with our internal designation J I Such material should not be scanned into any Commission database. A preliminary note: The hearing on the afternoon of September 26 is classified with a Special Access Program compartment, presumably because of the testimony of a particular 1C witness. Most of the hearing concerns intelligence collection inside the U.S. and the Moussaoui and Phoenix EC issue and involves the testimony of FBI witnesses. Would it be possible to separate the testimony of the 1C witness or somehow lower the compartmentalization of the entire hearing transcript? This memo provides you with the guidelines for permitting staff access to particular Joint Inquiry documents that will remain in the custody either of the Joint Inquiry or the HPSCI. This guidance is valid now. We will update this memo as some staffers complete the clearance process and as our 'need to know' situation becomes clearer. Commissioners should have access to all materials listed below. 1.
