Stephanie - looked at this again, and please also note (in addition to the questions I raised by my earlier e-mail) that the July 16 hearing was a staff briefing to the Committees and thus is not available for review by the Commission staff. Access Guidelines for Commission Staff
Jamie S. Gorelick Slade Gorton Fred F. Fielding John Lehman Timothy J. Roemer James R. Thompson
Ph ). Zelikow EXECUTIVE DIRECTOR
A preliminary note: The hearing on the afternoon of September 26 is classified with a Special Access Program compartment, presumably because of the testimony of a particular 1C witness. Most of the hearing concerns intelligence collection inside the U.S. and the Moussaoui and Phoenix EC issue and involves the testimony of FBI witnesses. Would it be possible to separate the testimony of the 1C witness or somehow lower the compartmentalization of the entire hearing transcript? This memo provides you with the guidelines for permitting staff access to particular Joint Inquiry documents that will remain in the custody either of the Joint Inquiry or the HPSCI. This guidance is valid now. We will update this memo as some staffers complete the clearance process and as our 'need to know' situation becomes clearer. Commissioners should have access to all materials listed below. 1.
