Permod Kohli, J. (Oral) Even the reply has not been filed. However, keeping in view the nature of controversy and the relief sought for, this writ petition is disposed of at this stage. The petitioner retired from Indian Army as Brigadier on 31.5.2006. The recommendations of 6th Central Pay Commission were announced in March, 2008 and the same have been accepted by the Government. The said recommendations were made applicable w.e.f. 1.1.2006 for which presidential sanction was granted on 12.11.2008. The petitioner is entitled to the benefits emanating from the aforesaid presidential sanction based upon the acceptance of 6th Central Pay Commission recommendation. The only grievance of the petitioner is that even though, the presidential sanction has been granted, yet the benefits have not been released to the petitioner. The petitioner accordingly filed this petition seeking direction for implementation of the presidential sanction and consequential benefits in his favour. In view of the above circumstances, this petition is allowed and the respondents are directed to release the benefits on the basis of the presidential sanction dated 12.11.2008 in favour of the petitioner within the period of three months.
