PROPOSED STIPULATION OF FACTS: 1. Will the Prosecution admit that the private complainants did not waive, reserve or institute the civil aspect of the criminal cases for estafa in accordance with Rule 111, Section 1? For Estafa: 2. Will the Prosecution admit that the accused is being charged for violation of Article 315, 2(a) of the RPC? 3. Will the Prosecution admit that the Informations for Estafa against the accused state that she allegedly collected from the private complainants individual amounts which does not exceed Php 40,000.00? 4. Will the Prosecution admit that the penalty for violation of Article 315, 2(a) of the RPC if the amount involved is Php 40,000 is prision correctional maximum period to prision mayor in its medium period? 5. Will the Prosecution admit that Republic Act 10951 amended Article 315, 2(2) of the RPC? 6. Will the Prosecution admit that under RA 10951 the penalty for violation of Article 315, 2(a) of the RPC if the amount involved does not exceed Php 40,000.00 is only Arresto mayor in its medium and minimum periods? 7. Will the Prosecution admit that the jurisdiction for crimes punishable by imprisonment of less than 6 years is with the first level courts? 8. Will the Prosecution admit that this Honorable Court is a Regional Trial Court and not a first level court? 9. Will the Prosecution admit that this Honorable Court has no jurisdiction over the Estafa cases against the accused and thus should be dismissed outright by the Court?
