LEAVE AND LICENCE AGREEMENT

THIS AGREEMENT is made on this 15th day of September 2009 (in the year of ) B E T W E E N DEBASHIS PAL son of Late Sachindra Kumar Pal, by faith Hindu, by occupation Business residing at Flat no. A-03/69, 41/44, Dum Dum Road, Kolkata-700 074, hereinafter called as the Party of the FIRST PART/LICENSOR(which expression shall unless excluded by or repugnant to the context be deemed to mean and include his legal heirs, executors, administrators, representatives and assigns).

No.510,PurbasinthiRoad,Dumdum,Kolkata-700030 hereinafter called as the Party of the SECOND PART/LICENSEE (which expression shall unless excluded by or repugnant to the context be deemed to mean and include his legal heirs, executors, administrators, representatives and assigns)

WHEREAS the 1st party is the owner of a Garage situated at WestNorthern Corner on the ground floor of premises Benduprava Apartment, 41/44, Dum Dum Road, Kolkata-74, P.S. Dum Dum, which is lying vacant measuring 120 sq. ft. at ground floor.

AND WHEREAS on being noticed the above fact, the 2nd party/Licensee approached the 1st party/Licensor to allow him to use the said Garage for the period of 22 months w.e.f. 14-07-2011. And on discussion between the both parties, the 1st party/Licensor agreed to the said proposal and both parties have agreed to reach into an agreement on the following terms and conditions for avoiding the future litigations.

NOW WITHNESS THIS DEED as follows:-

1. That this agreement is invariably valid for a period of 22 months with effect from 15th September,2009 (15-09-2009) and to be ended on 14TH July 2011(14-07-11) 2. That the 2nd party/Licenses would deposit a sum of 12000/- (Rupees Twelve thousand only) to the 1st Party/Licensor as an advance as well as security Deposit which would be refundable to the 2nd Party at the time of leaving said garage with peaceful vacant possession to the 1 st party/licensor by the 2nd party//licenses without any interest.

3. That the monthly licensed fees has been fixed @ Rs. 1200/- (Twelve Hundreds Rupees Only) per month payable within 7h day of each English Calendar month. 4. That if the 2nd party/licenses fail to pay the monthly licenses fee consecutively 2 month then the 1st party shall have the right to evict the 2nd party/licensees from the possession of the said Garage. 5. That the 2nd party/license is not allowed to use or keep any combustible thing in the said garage.

6. That the 2nd party/Licenses is not allowed to sublet the said garage to any other third party or hand over of transfer the said garage to any party/parties. 7. That if the 2nd party/licenses intend to leave the said garage before expiry of the said licensed period then he must serve the 2nd month’s prior notice to the 1st party/Licensor. (Written or verbal). 8. That the both the parties must carry out all the above mentioned terms and conditions and if any dispute arise between the both parties that would be solved by mutual discussion 9. That the 2nd party/license must keep good relations with the 1st party/licensor and with his neighborhood. 10. That the 1st party may renewed this agreement @ 10% (ten percent increase of the present License fees after every year IN WITNESS WHEREOF both the parties have hereunto subscribed their respective signature on the day, month and year first above written. 11. That garage is to be used for keeping the vehicle or car in the same and not to be used for other purpose by 2nd Party.
