-versusPI PERMIO M. HADJI-ISAH For: Simple Neglect of Duty PO1 SALIC B. MANABILANG Respondents. X------------------------------------------/ JOINT ANSWER We, PI PERMIO M. HADJI-ISAH and PO1 SALIC B. MANABILANG JR. both of legal age, Filipino, married and respectively residing at Block 2, Lot 40, Vamenta Estate, Barra, Opol, Misamis Oriental and Block 24, Lot 31, Labuena Vida Subdivision, Lumbia, Cagayan de Oro City, after having been duly sworn to in accordance with law, hereby depose and state: 1. That we are the respondents in the above-entitled case docketed as ADMINISTRATIVE CASE NO. 05-08-2018-12 for SIMPLE NEGLECT OF DUTY now pending for investigation before the HONORABLE OFFICE OF THE SUMMARY HEARING OFFICER, with office address at Brgy. 40, Poblacion, Carmen, Cagayan de Oro City Police Station. 2. That sometime on 21 September 2018, we received a copy of the SUMMON/ORDER TO ANSWER dated on the same day of 21 September 2018 giving us five days from receipt thereof within which to file our responsive answer. Attached on the said SUMMON/ORDER TO ANSWER are copies of the complaint, sworn statement and other documents submitted by the complainant. A copy of the SUMMON/ORDER TO ANSWER is hereto attached and marked as Annex “A” and made an integral part hereof. 3. Hence, we have until 26 September 2018 within which to file our responsive answer and in compliance with the said

lawful Order we are submitting this joint answer with the corresponding supporting documents. Ergo, we have filed this Joint Answer within the reglamentary period specified in the SUMMON/ORDER TO ANSWER. 4. That for the true information of this Honorable Office, the reason why we were not able to submit our Salaam Weekly Compliance on Peace Building Forum Reports on March 29, 2018 and we were not able to submit our Salaam Weekly Compliance on Peace Building Forum Reports on April 05, 2018 on time, is narrated hereunder. 5. That between the period from March 29 to March 30, 2018 we were among the Police Officer who were detailed to conduct crowd control, body search, baggage inspection including the ban of bringing matches, lighters, deadly weapons to all devotees entering Malasag area of Barangay Cugman and Guadalope area of Barangay Tablon. A copy of the Detail Order dated 27 March 2018 is hereto attached and marked as Annex “B” to B-2” and made an integral part hereof. 6. That on the following week, we have conducted a clean-up drive in our office at Lumbia Police Station. A copy of the Picture showing that we have attended and participated in the clean-up drive in our office is hereto attached and marked as Annex “C” and made an integral part hereof. 7. That due to the foregoing important activities we were not able to submit our Weekly Compliance on Peace Building Forum Reports on March 29, 2018 and we were able to submit our Salaam Weekly Compliance on Peace Building Forum Reports only on 06 April 2018 or one day late for the 05 April 2018 weekly reports. 8. That we humbly asks apology upon this Honorable Office for our lapses. Our lapses to submit our Salaam Weekly Compliance on Peace Building Forum Reports on March 29, 2018 and on April 05, 2018 was not an obstinate refusal to comply with the lawful order of the higher activities but due to circumstance above narrated which was done in good faith. 9. That the Salaam Weekly Compliance on Peace Building Forum Reports which is required to be submitted every week has always been complied with except only to those two

consecutive weeks dated March 2, 2018 and April 5, 2018 due to above- mentioned circumstances. 10.That we have no intention to defy the lawful order of the higher authorities. In fact, right after the two consecutive weeks activities we were able to file our Salaam Weekly Compliance on Peace Building Forum Reports for the April 5, 2018 deadline on April 06, 2018 or one day late only for that deadline showing that we have no intention to defy the lawful order of the higher authorities. 11.That it is our firm belief that our lapses to comply with the Salaam Weekly Compliance on Peace Building Forum reports for two weeks does not qualify as Simple Neglect of Duty as the same was done in good faith without any evident bad faith and any intention to defy the lawful order of the higher authorities. 12.That we have served the Philippine National Police (PNP) with utmost dedication, competence, highest degree of responsibility, integrity, loyalty, honesty and efficiency. Likewise, we have never been convicted for any other administrative offense in our life nor been involved in any acts constituting dishonesty, misconduct, oppression or fraud both in our public and private life. As a matter of fact, we are the recipient of numerous awards and commendations in the course of the performance of our duties. A copy of our PNP PERSONAL DATA SHEET is hereto attached and marked as Annexes “D to D-3 and “E to E-3”, respectively and made an integral part hereof. 13.In view of the foregoing circumstances, we appeal to the mercy and compassionate understanding and magnanimity of this Honorable Office for humanitarian consideration and administrative leniency relative to our unintentional transgression as we have no intention to defy the lawful order of the higher authorities. 14.That we are executing this Joint Answer to attest to the truth of all the foregoing statements in compliance with the lawful Order of this HONORABLE OFFICE OF THE SUMMARY HEARING OFFICE and finally we respectfully prayed of this Honorable Office that after notice and hearing an order be issued DISMISSING the complaint against us for lack of merit.
