AFFIDAVIT OF LOSS TITLE I, ERMENIA E. ABBU, of legal age, Filipino citizen, married and presently residing at Anhawon, Bulua, Cagayan de Oro City, after having been duly sworn to in accordance with law, hereby depose and say: 1. That I am the registered owner of a parcel of land situated at Macasandig, Cagayan de Oro City as evidence by Transfer Certificate of Title No. T-192877 issued by the Register of Deeds of Cagayan de Oro City, containing an area of Two Thousand Five Hundred Ninety Nine (2, 599) square meters, more or less. 2. That due to tropical storm "Sendong" that entered the country last December 16, 2011, the duplicate original copy of the said title was lost. Before the tropical storm "Sendong" crossed the island of Mindanao, I am living with my family at our old house located at Macasandig, Cagayan de Oro City covered by Transfer Certificate of Title No. T-192877. 3. That because of the said tropical storm "Sendong" our house was washed out by floodwaters, as well as all our household items including the duplicate original copy of the said title. 4. That serious and earnest effort to locate said title but proved futile, as the same is still not found, even to this date. Hence, for all legal intents and purposes it is now deemed lost and beyond recovery. 5. That I certify and confirm that the said title was not in the position of any banking, financing and lending institution by reason of any encumbrance or real estate mortgage nor confiscated or relinquished in favor of, any government entity, agency, or authority. 6. That I am executing this affidavit to attest to the truth of all the foregoing statements to support my petition for the issuance of new owner’s duplicate copy of Transfer Certificate of Title No. T-192877 as well as for all lawful intents and purposes it may serve.
