Inspector General's Act (04/09) Parliament of eAustralia

Definitions: The following definitions defined below relate to this Act specifically: PM = Prime Minister DPM = Deputy Prime Minister CM = Cabinet Minister IG = Inspector General Citizen = Any member of the government or citizen of the country other than the previously listed individuals Purpose: This Inspector General's Bill Act outlines the Inspector General’s Duties and Tasks, which will be the person responsible for keeping a watchful eye on the activities of the Executive Branch of the Government. Duties 1 - Keep an eye on the Cabinet Discussions 2 - Keep an eye on the main gDocs used by the government 3 - Be the person everybody goes to for information about the operations of the Exec Government (eg: Spending) only if the request is denied/stalled by the PM/DPM/CM 4 - Talk to the PM/DPM/CM if any "questionable" content emerges in the Discussions/gDocs 4.1 - Futher to Duty 4, the IG is required to make a report to the Senate concerning the actions of the Exec Government if talking to the PM/DPM/CM fails Procedures Part I - Accessible Areas 1) The IG will have read only access to the cabinet section on the forum and any google docs created by ministers. 2) The IG must be added to a google doc within 3 days upon its creation. 3) The IG will not have access to the War Council section in the Cabinet. Part II - Investigating 1) When the IG decides to investigate the PM/DPM/CM, the following must abheared to: a) The IG is forbidden to confront the PM/DPM/CM on a one-to-one basis i) If the IG is investigating the PM, then the DPM must be present at the conversation ii) If the IG is investigating the DPM, then the PM must be present at the conversation iii) If the IG is investiaging a CM, then either the PM or DPM must be present Part III - Reporting

1) When the IG is making a report to a Citizen: a) Only the data requested must be reported, anything above and beyond that which was asked for will be considered a breach of security. b) The report to the citizen must be done in as timely a manner as possible. If the IG is unsure about the information requested he must tell and ask for the PM's permission immediately to release the information. c) Reports to the Senate are to be made in Sensitive Discussion ONLY. 2) When the IG is making a report to the Senate: a) Only data relevant to the report is to be posted b) Absolutely no analysis must be presented, the IG is to report on the actions only; the Senate must decide on the action to take. Part IV - Inspector General Selection Process 1) Due to the highly sensitive nature of content which will be viewable, candidates who wish to run for the role must nominate themselves and be "seconded" by two others. 2) Candidates must be either a Senator which hold no other government role, or a recipient of an Order of Australia medal. 3) Candidates will be voted upon in the Senate as per normal Senate procedure after 2 days discussion. 4) Candidates require 50%+1 of the votes to be elected and a minimum of 50% of the Senate must vote for the result toe valid. 5) Once a candidate has been elected a 24 hour poll in which Cabinet Members and Senators can vote in will be held to see if the candidate has been approved by all levels of government. For the vote to pass 50%+1 of the vote is needed. If the vote fails the process starts over. Part V - Vote of No Confidence 1) In a normal term the Inspector General should hold his role for a month, with a new vote occurring 2 days after the Prime Minister general election. However, if the IG breaks any of the above bylaws or is not doing his job adequetly the following will occur. 2) The PM, DPM, CMs, or Senators can start a 'Vote of No Confidence' in the Senate. For the vote to be initiated it needs to be "seconded" by two others in the 2 day discussion period. 3) Once a 'Vote of No Confidence' is requested the Inspector General's access will be frozen until the outcome of the vote is reached. 4) For the 'Vote of No Confidence' to pass 2/3 of votes must be yes a minimum of 50% of the Senate must vote for the result to be valid. 5) If the 'Vote of No Confidence' passes a new the Inspector General Selection Process restarts.
