Introduction
Mid-range Homes
The aim of Exclusive Homes on Phuket is to give information that allows you to appreciate what is available in the market. We have separated homes listed into 6 broad categories. The classifications reflect factors such as location, materials, living space and free space, density of development, facilities and price bands. Check the descriptions below, then look for the symbol in the listing. Bear in mind that a small condominium apartment may be in the upper range as far as quality is concerned, but a lower price band.
Western standards, with good quality finishing. Western kitchens, hardwood floors, good quality close-grained doors and window frames, large ensuite bathrooms are the norm. Often with private or shared pools. Dramatic price differentials according to location. Price guide: 15m to 20m Baht.
High End Properties + Latest western build techniques, high quality and often high tech. Proximity to the ocean is important. Most such homes are substantial, built on upwards of 1600 sqm of land (1 Rai), often in managed developments of a limited number of homes. Price guide: from 40m Baht up.
Upper Range Homes Top quality build and finishing. Usually with private pools. Teak wood is often used in this range for floors, doors and windows. Land plot size is important but the main examples of such homes are defined by their ocean views and proximity to the water. Price guide: 20m to 40m Baht.
Western Spec Homes Western standards with western kitchens, more electrical sockets, higher spec finishings, including floorings and bathroom fittings. These homes may be found all over the island, individually or within estates. Many condominium developments fall into this category. Price guide: 10m to 15m Baht.
Entry Level Housing Properties aimed at both the local Thai market and expatriates seeking a modest family home. Basic finish, but usually have (or provision for installation of) western style kitchens and bathrooms. More electrical provision than local market housing. Price guide: 4m to 10m Baht.
Local Market Housing Mostly single storey, simple properties aimed at the local market and expatriates on a limited budget. Usually in housing estates. Price guide: 1m to 4m Baht.

SHOPPING Shopping for furniture, kitchens, artefacts, soft-furnishings & everything else for the home – as well as everyday provisioning needs – has come a long way in recent years & Phuket now boasts “big-city” standards. The arrival of Tesco-Lotus & Big C several years ago, changed the face of Phuket residents’“weekly shopping” expedition, both in terms of convenience & choice. Central Festival has further opened up shopping ventures, offering a more cosmopolitan boutique store approach, and Jungceylon, a first of its kind lifestyle centre – shopping, dining, entertainment & fitness – is open. The daily markets are still there for the adventurous. On the more significant question of furnishing your home, convenience is less of a factor. Five years ago Phuket boasted perhaps just one quality furniture outlet. Today there are many. It is more of a buyer’s market than ever before. Similarly for home furnishings, décor & those all-important signature pieces that distinguish your home from everyone else’s. When it comes to furnishing your home, it is well worth the time & effort to shop around. One-stop shopping is a good place to start, but is not the complete answer in today’s Phuket when it comes to expressions of your style. Antique & reproduction antique shops abound; some good, some less good. Take the time to find out which is which; there should be no rush. The same goes for soft furnishings, fitted kitchens… in fact everything. There are choices in every field. Take advantage of them.

LEGAL MATTERS Important Issues for Property Investors I’m a minority investor in a Thai company that owns property in Phuket. If the company wants to sell some of the property land what are the specific government taxes and registration fees payable? I understand there is income tax and Specific Business Tax (SBT) and is it true SBT has recently been reduced? “When selling land with a building on it the transfer fee is 0.01% on the higher of the sale price or appraised value of the land as assessed by the Land Office. This is a continuation for a further year (until March 2010) of the reduced rate that the government introduced last year to stimulate the housing market. Your company will have to pay SBT and under last year’s tax breaks to stimulate the housing market this was reduced from 3.3% to 0.11% of the land price. The renewal of this reduced amount until March 2010 has recently been confirmed. Income tax is also payable which is calculated at 1% of the land price.” (Desmond Hughes, Partner)
I have been looking to purchase a property in Phuket. I recall someone telling me that buying a condominium unit in the ‘foreign 49% quota’ is the safest and most secure way for a foreigner to purchase property in Thailand. Unfortunately, I have only either seen townhouses or house type property. How difficult will it be to purchase one of these properties or should I only look for condominium units? “Whilst a foreigner buying a condominium in the foreign quota of a condominium block is a good way to invest in Thailand it is by no means the only secure way to invest in property. A foreigner can buy a lease with a 30 year term with options to renew the lease. These options are typically for two further 30 year periods. Various mechanisms can be implemented to bolster the lease renewal such as setting up a ‘protected leasehold structure’ which some developers take the trouble to create. Leasing from a public company is also a safer way to lease long term. Additionally, whilst a foreigner cannot own land they can own the building itself so if you purchased a townhouse you could lease the land and own the building itself.” (Kris Limcharoen, Partner)
I am not resident in Phuket and am interested in purchasing a leasehold villa to stay in myself for a couple of weeks a year but otherwise to rent out for the rest of the time. I’ve seen a villa in a very nice project and the developer is offering me a fixed rental return for a couple of years. He’s said that I will be responsible for any expenses connected to the rental income. Could you advise on what these are likely to be? “As you are not resident in Thailand (not resident for more than 180 days in a year) you will have to pay a flat rate 15% withholding tax on your rental income. In terms of other expenses it is important to check with the developer who is responsible for what costs that may arise during the rental period. continued on page 19 19

For example, it would be expected that you are responsible for any major refurbishment that is required. Other things to check are who pays for the cost of furniture repair and replacement, insurance, and general day to day maintenance expenses. You mention that you want to stay in the property for a couple of weeks each year so check with the developer how many weeks a year you are entitled to and how much notice you need to give the developer about your intended stay. Good News for Property Investors as the Land Transfer Fee Stimulus Packages Extended We reported last year that the Cabinet of Thailand had resolved to reduce the registration fees payable upon the transfer of certain interests in real estate, as a measure to stimulate the real estate sector of the Thai economy. The reduced registration fees came into effect on 29th March 2008 and were initially frozen at the lower rate for a period of one year ending on 28th March 2009.

extension of the reduced fees payable on the registration of immoveable property, ending on 28th March 2010. The reduced registration fees are applicable to land and building transfers, condominium unit transfers, the registration of buildings as condominiums and the registration of mortgages. The registration fees in relation to these transactions have been reduced from 2 percent to 0.01 percent (except mortgage registrations which have been reduced from 1.1 percent to 0.01 percent). In addition to the reduced registration fees, certain taxes payable upon the transfer of real estate have also been reduced. It is important to note that the reduced registration fees do not apply to the registration of leases or the transfer of land which has no buildings or structures built upon it.
Many buyers who stand to benefit from the reduced fees and whose property is near completion, have been applying pressure upon developers to ensure that completion of their property has taken place and the registration process has been concluded prior to 28th March 2009, thus allowing them to benefit from the considerable reduction in government registration and transfer fees. The Ministry of Finance recently reported that the reduced registration fees had stimulated the real estate sector of the Thai economy. Consequently, on 2nd December 2008 the Cabinet of Thailand resolved to approve a one year 62
The reduced registration fees and taxes, which may (depending upon the value of the interest transferred) amount to a saving of several thousand U.S dollars, provide prospective buyers with a valuable incentive to invest in their dream home in Thailand now rather risk considerable additional costs post 28th March 2010.

Tips for a greener lifestyle It's something you've been meaning to do for a while start a compost heap, buy recycled paper, trade in that gas guzzler for a fuel-efficient vehicle - but you never get round to it. Now could be the time to turn your green ideas into reality before its too late. Below are 7 easy steps to you get started.
Before being separated, waste products must first be weighed. The charge is 200 baht a ton. If the waste weighs less than a ton, you will be charged less. You can leave your waste at the plant, and the officers will sort it for you. This service is open to everyone, 24 hours a day.
5. Start Composting This reduces the burden on landfill sites and also produces a great natural fertilizer for plants and gardens. Buy a composting bin at a garden supplier or make your own from an old bucket or bin. Start with lawn trimmings, fruit and vegetable scraps, and coffee grounds. You can add EM solution to prevent smells.
1. Cut down your driving miles Every gallon of fuel in your car releases about 24 pounds of carbon dioxide. Reducing your driving by a few miles a day will help prevent tons of carbon dioxide entering the air. Push for traffic-calming techniques like speed bumps in your community. More pedestrian and bikefriendly areas mean less congestion, less energy consumption, less pollution.

4. Participate fully in recycling On Phuket, you can drop your waste at the sorting plant located behind the Phuket Town Municipal Incinerator, on Rattanakosin Road in Phuket Town. 92
6. Take smarter showers Washing our bodies can account for up to 16.8 percent of home water use. Installing a low-flow shower head saves two gallons for every minute of showering. A typical shower lasts about eight minutes and uses about 17 gallons, while an efficient shower lasts three or four minutes and uses 7.5 gallons.
7. Repair leaks Fix leaking and dripping taps to save water and lower your water bill. A dripping tap can waste up to 20 gallons of water per day. A leaking toilet can waste up to 200 gallons every day. Not all leaks are visible but you can diagnose leaks in your toilet by placing some food coloring in the tank, waiting 30 minutes, and then checking if it appears in the bowl.
