Dear Mr. Marcus: This supplements our prior responses to the Commission's Document Request No.l 1 to the Department, which requested documents in 13 itemized categories, and Request No. 13, which requested materials in four categories relating to the Foreign Intelligence Surveillance Act (FISA) and information sharing matters. Enclosed are 150 pages of classified documents that were provided by the Department's Office of Intelligence Policy and Review (OIPR), which are responsive to these Requests. The Department has previously offered to make these documents available for review and they have been reviewed at the Department by Commission staff. We are providing them for further review at the Commission's offices, in response to your request and pursuant to your agreement that they will be returned to the Department, rather than becoming part of the Commission's records. We understand that while they are in the Commission's offices, they will be stored and handled in accordance with established requirements relating to their classification. As we have previously indicated, some of the materials within the scope of this Request, which goes back to 1978, have been retired to the National Archives and, hence, are no longer available to the Department. We have provided you separately with an list of those documents which may be responsive to this Request so that you can request them directly from the Archives. Enclosed are documents from the Offices of the Attorney General, Deputy Attorney General, and Legal Counsel that we have located in response to categories two and three of the Request. In order to respond to your Request as promptly as possible, we are providing these documents before they have been formally processed, but we will make available Bates stamped versions at a later time. We note that some of these materials are classified and trust that the Commission will treat those materials in accordance with the requirements relating to their classification. We also are prepared to make Appendix D to the Bellows Report, which is classified and responsive to the first category of the Request, available for review by cleared Commission staff at the Department this afternoon. The Department has substantial confidentiality interests in this collection because many of the documents are deliberative in character and contain advice and recommendations that would not usually be disclosed outside of the executive branch. Several of the documents have already been made available to the Commission. One of them, the Dellinger opinion of 1995, has previously been publicly disclosed and is enclosed with this letter. We anticipate that the document requested in the fourth category of this request will be available for review at the Department in the near future.
