DEED OF ABSOLUTE SALE
KNOWN TO ALL MEN BY THESE PRESENTS:
This DEED is made and entered into by and between: Tirso A. Cruz, of legal age, Filipino, single, and a resident of Brgy. Aganan, Pavia, Iloilo City, Iloilo, herein after referred to as the VENDOR: ---and--Anthony B. Martinez, of legal age, Filipino, single, and a resident of Brgy. Pandac, Pavia, Iloilo City, Iloilo, herein referred to as the VENDEE;
WITNESSETH: WHEREAS, the VENDOR is the absolute owner in the fee simple of the certain real property, a parcel of land situated in GORRICETA AVENUE, BRGY. PANDAC, PAVIA, ILOILO CITY, ILOILO, Philippines covered by Transfer Certificate Title No. 1468, issued by the Registry of Deeds for the City of Iloilo, and which is more particularly described as follows:
Title Certificate Title No. 1468 Block 9, Lot 46 A parcel of land, Block 9, Lot 46, situated in DECA HOMES Phase 3 Block 9 Lot 46, containing an area of Thirty Five Square Meters (35 sqm.), more or less.
WHEREAS, the VENDEE has offered to buy and the VENDOR has agreed to sell the above-described propert for the price and under the terms and conditions set forth herein below; NOWTHEREFORE, for and in consideration of the promises, and more specifically of the sum of ONE MILLION AND FIVE HUNDRE THOUSAND
PESOS, Philippines currency, the receipt whereof is hereby acknowledged from the VENDEE to the entire satisfaction of the VENDOR does hereby sell, transfer and convey in a manner absolute and irrevocable, in favour of the VENDEE, his heirs and assigns, the land above-described; That the VENDOR does hereby covenant and agree with VENDEE that the above-described property is free from all liens and encumbrances, that he has a perfect right to convey the same, and that he will warrant and forever defend the same unto the said VENDEE, his heirs and assigns, against the lawful claim of all persons whomsoever; That the VENDEE agrees to shoulder the expenses for the consolidation of the title, capital gains tax, documentary stamps tax, transfer fees, notarial fees, and all other fees or expenses incidental to the transfer of the title of the abovedescribed property while the VENDOR agrees to shoulder the expenses for accrued and current real estate taxes. IN WITNESS WHEREOF, the parties have hereunto set their hands this March 27, 2019 at Iloilo City, Philippines.
