This presentation is based on the provisions of Republic Act No. 8436, as amended by Republic Act No. 9369 (Automated Election System Law) Inputs were likewise taken from various COMELEC presentations Caveat: We are still awaiting the release by the COMELEC of the General Instructions to the Board of Election Inspectors and General Instructions to the Board of Canvassers, which will contain the implementing details for the May 10, 2010 Elections This presentation will likewise outline the COMELEC’s Continuity Plan in case the Automated Election System fails in certain instances 2

PRECINCT LEVEL: Board of Election Inspectors (BEI) (80,136) Composed of three (3) public school teachers. 1. Chairman 2. Poll Clerk 3. Member At least one member shall be an information technology‐capable person who is trained or certified by the DOST to use the Automated Election System.

VOTING PROCEDURE

CANVASSING PROCEDURE
The COMELEC is authorized to prescribe other manner or procedure for the canvassing and consolidation of votes as technology evolves, subject to the minimum capabilities of the Automated Election System and other pertinent laws. [Section 37, RA 8436, as amended]

Each board of canvassers shall be assisted by an information technology‐capable person authorized to operate the equipment. The COMELEC shall deputize information technology personnel from among the agencies and instrumentalities of the government including GOCCs.
Tasks: 1. Canvass the votes by consolidating the electronically transmitted results or the results contained in the data storage devices used in the printing of ERs 2. Issue the City/Municipal Certificate of Canvass (CCOC/MCOC)/ Statement of Votes (SOV) by precinct

CITY/MUNICIPAL LEVEL: City/Municipal Board Canvassers (CBOC/MBOC) prints thirty (30) copies of the certificates of canvass (CCOC/MCOC) and within one (1) hour after the printing of the certificate of canvass, electronically transmits the canvassing results to the Provincial Board of Canvassers (PBOC). CONTINUITY PLAN 1.
PCOS Failure to Scan/Print: BEI shall wait for spare PCOS to complete its process before it is reconfigured for scanning and/or printing of ballots. If all PCOS fail, manual counting shall be done.
2.
PCOS Failure to Transmit: Defective PCOS shall be connected to functioning transmission facility. If this fails, PCOS shall be physically transported to canvassing center in the presence of watchers and security escorts.
3.
CCS Failure to Consolidate: Removable storage device of defective CCS shall be transferred to available CCS. If this fails, data from COMELEC Central Backup Server shall be printed and sent either to affected BOC or to Special BOC. 36

CRITICAL AREAS 2. Printing of Ballots – Proposed to be printed within the premises and under the supervision of the BSP – Smartmatic‐TIM to provide printing equipments and paraphernalia – Watchers/representatives are allowed to observe printing

Preliminary/Final PCOS Testing and Sealing – Preliminary Testing upon delivery of PCOS – Final Testing/Sealing conducted not later than 03 May 2010 at the precinct level – Watchers/representatives to be deployed to 37,884 Polling Centers to guard PCOS until Election Day – Procedure: (1) Test ballots to be manually counted. (2) Test ballots to be fed into PCOS. (3) Manual count to be compared with automated count. (4) If no discrepancy, PCOS to be sealed. 40

Random Manual Audit – Coverage: 1 to 3 PCOS per city/municipality (up to approximately 4,893 PCOS) – Conducted after electronic transmission of results to CBOCs/MBOCs – Subject to 24‐hour prior notice by COMELEC – Procedure: (1) Randomly chosen precincts to conduct manual count of ballots after electronic transmission of results. (2) If there’s discrepancy, COMELEC En Banc to determine extent of manual count. 41

Transmission of Election Results – Watchers shall ensure that the election results transmitted from the PCOS (at BEI level) to the CCS (at BOC level) contain no discrepancy – Watchers shall be instructed/trained to immediately relay results to the central data center 42
