MDHosting.EU Service Terms and Conditions 1 DEFINITIONS 1.1 The terms “MDHosting.EU” or “MDHosting” or “MD-Gaming.co.uk” or “MD-Gaming” or “MeltDownGaming” or “us” or “we”or “contractor” or “sponsor” refers to the owner of the website and vendor/provider of services and products. 1.2 The terms “you” or “user” or “customer” or “client” or “contractee” refers to the independent entity whom is the purchaser of our products and services. 1.3 The terms “products” or “services” or “servers”refers to all services which can be both physical and virtual, and which are availabe to clients, including, but not limited to, be they be paid for in monies, via any payment medium, or granted without charge as part of a special paid package, or part of a sponsorship package. 1.4 The terms “service period” or “gameserver rental duration” refers to the time length for which a service has been purchased for. 1.5 The term “game clients” refers to the independent third party entities which shall use your gameservers. 1.6 The term “default game files” refers to the 'out-of-box' installation of a game service, e.g Call of Duty. This definition does not include third party game modifications. 1.7 The term “slots” refers to the set number of 'game clients' who can connect on a server at any one time. 1.8 The term “root access” refers to the ability to gain access to all game server files for that allocated server. 2 GENERAL TERMS AND CONDITIONS 2.1 Upon full payment for the ordered products/services, your order will be activated and processed. Under no circumstances will MDHosting activate your server without full payment. 2.1.2 Depending on the type of product which you have ordered, your server(s) may be up any time between four hours to twenty four hours once full payment has been made. 2.1.2.1 However, we do not give such warranty, express or implied, that your server will be setup within the specified times above. This can be for a number of possible reasons,ncluding, but not limited to, server limits being reached and therefore requiring us to purchase and install new dedicated servers. If such a situation does occur, whereby, it will take seven working days or more to start your services, you will be notified and advised as to when your server(s) will be up. Customers have the right to cancel the contract in this situation only. Notice must be given to us in writing within seven working days. 2.1.3 The service period will start when your server is running on our servers and online. Generally, your service will be started on the same day of payment, therefore payment date will be

normally be your contract start date. 2.1.3.1 Your server is considered up and running when it is accessible to 'game clients', and has been installed with 'default game files'. This is not dependent on whether your server has been fully configured with user's custom modifications. 2.1.3.1.1 It is the responsibility of the customer to create custom server modifications, however, we will provide full support in this area. 2.1.3.1.2 Some games are hosted in different versions/patches. Clients have a choice, depending on the game required, to choose a version of the game which will be hosted. It is your responsibility to correctly order the desired version. If you have changed your mind, and/or made an incorrect version choice, your service period period will start nonetheless. 2.2 Your contract length is defined by how many months you order the services for; one month, three months, six months, and twelve months. The minimum period is one month. There is no maximum contract length. 2.3 Once a game server has been ordered and paid for, a user can switch the game it is based on, free of charge, if the game is on same price band. If not, users will have to pay the extra amount, which they will be advised of. 2.3.1 Customers are only limited to three game switches a month. 2.3.2 Customers cannot downgrade the 'slots' that have been ordered. If you do wish to downgrade, you will have to do so in your next contract period. 2.3.3 Customers can upgrade their slots. A fee will be levied, which, customers will be advised of. 2.3.3.1 Customers may not, at any time, increase their slots without the express permission of MDHosting. Any client found to do so will have their servers suspended until they provide the correct payment. If no payment is reached within three working days, the account and servers will be deleted, without any refunds. 2.3.4 Sections 2.3.2 and 2.3.3 also apply to voice servers. 2.4 These terms and conditions are governed by English contract law. 2.5 We reserve the right to amend these terms and conditions without notice. However, customers may be given notices of important updates at our complete discretion. It is the responsibility of the customer to regularly check these terms and conditions. 2.6 Since your service will start on the same day, you are not entitled to cancel the contract once accepted. All contact details can be found on our 'contact us' page on our site. 3 SERVER FILES. USAGE AND CONDUCT 3.1 Clients have root access to all related service server directories. This allows you to modify a game server to your gaming needs. 3.1.1 In having root access, certain conditions and responsibilities are placed upon you: a) you will not store, upload, transmit, any files, programs, software, etc., which includes, but not limited to, pornographic material, illegal material, warez, viruses, trojans and spyware; and b) you will not use your to server to send spam of any kind, use it for malicious activity, or any other action which is deemed illegal; and c) any other action(s) deemed to be harmful to the interests of MDHosting, its customers and to any other related party, and if applicable, unrelated party, is not permitted. 3.2 Violation of the above terms will result in an immediate termination of your contract, and no refunds will be given.
