Hon’ble members Mrs and Mr Gandhi, This has reference to your letter of 23rd January 2008 raising some points and seeking the response of Wilmer CHS Ltd. The EOGM unanimously decided to include –and not impose as contended in your letter—Rs.100/- per month from January 2008 as contribution to celebrate festivals. The suggestion had come from several members who said moving door to door collecting contribution was not a proper way since it was a collective affair like running a housing society. This contribution has been taken after due consultations with legal experts in the Cooperate Act. They have given a candid opinion that there is no legal bar on adding such contribution into the monthly society maintenance bill. Your letter does not mention under which provision of the society’s Bye-laws it has been held unlawful. Since the society members have agreed and approved the resolution to this effect it shall be binding on all members, as per existing legal provisions. If one has to accept your contention that since you do not wish to participate and therefore would not like to contribute then society members occupying ground floors of both wings may very well ask ‘Why should we pay for the elevators maintenance?’ Both
these arguments sound fanciful if not insane and have no place in the smooth running of a society. As to your further queries in this regard , they had been orally clarified in the EOGM to the satisfaction of the members who had then unanimously passed the resolution to include Rs. 100/-This leads me to remind you that every member should be present at the General Body meeting to voice their opinions and suggestions instead of asking for clarifications at a later date. Such clarifications entirely defeat the purpose of the General Body meeting . It is not possible to answer each member individually. Since as you say, your previous letters have not been answered , the present committee have decided to answer this one and take this opportunity to inform you that no further queries regarding decisions already taken in the General Body meetings shall be entertained in future. As to your not participating in any celebrations, the same is your prerogative and makes no difference to the society at large. However, the billing shall be as has been the practice till date. Another point raised by you related to our society’s maintenance charges which are comparatively on the higher side in contrast to other buildings in our vicinity. Agreed. The reason for this anomaly is that our society has yet to obtain a complete Occupation certificate from the Municipal Corporation. So the charges are much heavier and would remain so till we get the OC.
This gives us a chance to remind your good self that about a year ago the Society in its General Body meeting had given you Power of Attorney reposing confidence in you that you would abide by your promise of getting us a complete OC. However , since then despite several reminders , you have neither responded nor informed the members as to the progress on the OC front. Now that everybody is feeling the pressure of paying higher society charges , it would be in the best interests of all members to get the complete OC through your good offices. We hope you would not let our society down in this regard. Finally, One fails to understand the reasoning or the intention behind your sending your letters through RPAD/Courier when you can, being a resident member of the society hand deliver the same. As to your allegation that the Secretary did not accept your previous letter for reasons unknown, you are well aware that she is a working woman and there is no one at her residence during the day to accept such letters. Further , if every member were to communicate to the Secretary via post , like you did, she would have time only to go to the post office to collect the letters which being the sensible person you obviously are would agree would be mere harassment to a person who is willingly holding and discharging her duties as efficiently as is possible, what is after all only an honorary post. It would not be too much to expect every member to give their utmost cooperation to us all committee members so that we can make our society an ideal society.

NOTICE It is brought to the notice of all the members that prior intimation should be made to the society regarding any renovation work to be undertaken by them. It has been decided by the Managing Committee that henceforth a cash deposit of Rs.5000/- shall be collected from members who are renovating/repairing their flats/shops towards security deposit against damage to society premises and disposal of rubble if not done by the member himself. The balance shall be returned on completion of all work. This is done to avoid any rubble being accumulated in the society premises and prevent any damage to the society. Members are specifically requested not to do any extension work in the kitchen. It may also be noted that any further dumping of rubble shall be done in bags to be kept in the garden/backyard of the society which can be accessed by the small gate. Any dumping of rubble in the front garden shall attract penalty of Rs.500/-.Members are requested to cooperate with the society to keep it clean and ensure disposal of rubble as early as possible.
