The time is approximately 1224 hours. Today’s date is Tuesday, September 09, 2008. Speaking is Detective Timothy Hightower of the Louisville Metro Police Homicide Squad. This will be a taped statement in regards to Case #08-197. I am currently in my vehicle in the parking lot of PRP High School. Also, present with me in the car; his first name is Kody, last name Thornton. Kody, if you would state your full name for the tape.

I’m taking this statement in reference to the events that occurred on Wednesday, August 20, 2008, that occurred during the PRP football practice. Kody, if you would please describe to me the events of that Wednesday, August 20, 2008; from the beginning of practice to the end of practice?

Thornton

It started out and we normally stretch an inzone and after we stretch, we go to our individuals, which is defense; goes runs their plays, and offence runs a different plays. Actually and we ran we uh, weren’t doing, we were walking to the individuals so we had to go back a few times, go back to in-zone break it down again and run back. Last we did individuals, we went to uh… we did our team take-offs, I mean, then we went to our individuals and after the individuals we started to the teams and we ran.

Okay, what team do you play on?

I’m on the defense team.

Hightower

O.K. So practice, were you in full equipment?

Thornton

Yes sir. Full gear.

Hightower

What is full gear?

Thornton

Shoulder Pads, Helmet, Pants, Cleats.

Hightower

And you said you play your position is defense?

Thornton

Defensive tackle and defensive end.

Hightower

O.K. So you practice you broke off into separate teams. Is that correct?

Thornton

Yes sir.

Hightower

O.K. So if you would go from there, you broke off into your teams and you’re in the defensive…

Thornton

Yes.

Hightower

…the team? And what does that consist of that practice?

Thornton

The individuals existed of us just the defensive line working on our agilities; working like we do, we get our… do little warm ups again, we get our knees, we run do high knees for about 5 yards, we do them twice, we do uh, butt kickers twice and we do some hip rolls and butt rolls and dancing, which is like we kara… … which like karaoke’s. After we do that we got water. The defensive line got water, came

back and I think from directly hit, we went to the bags that’s when we—we got 5 bags on the ground and we jump over the bags, one foot in every hole and after… then after we do them, we uh… we went with the offense. The offense we’re doing a drill called buck drill. Hightower

What is that?

Thornton

The buck drill?

Hightower

Yes.

Thornton

It’s where they run buck one of our offenses plays, they run it and we have a few defensive guys out there just trying to just in spots where the offenses couches want us and we just try to--we just hit where we’re suppose to hit and the offense runs there, the buck drilling. Run to where we’re supposed to be, the blockers got to get where they’re supposed to be and that’s what we do. Then after that we ran the buck drill and then uh, after the buck drill we ended up, we went to go get water and then we ran right after the buck drill because we were —because the guy, I guess everybody was walking and so we ran from the buck drill so.

Hightower

How many water breaks were y’all given as an individual or a team?

Thornton

As an individual on the defensive side, I think we were given 2 to 3.

Hightower

Okay and that’s gonna be on the…

Thornton

That’s on defensive—that’s on the defenses line. I’m pretty sure we got 2 or 3.

Hightower

All right. 2… 2 to 3, what about as a team?

Thornton

Uh, we got… I think 1 or 2.

Hightower

And how many of the water breaks did you take on that August the 20th of 2008?

Thornton

Every water break we had.

Hightower

Every one.

Thornton

Yes sir. We’re not allowed to not take a water break. There’s a water break, we have to go take it.

Hightower

O.K. After the last water break what did practice consist of?

Thornton

Running, gasers.

Hightower

Gasers, what are those?

Thornton

One side of the field together and back.

Hightower

Back?

Thornton

Back to the other side and back.

Hightower

So that’s how many times?

Thornton

So it’s you’re down one, back, down again and back. That’s one gasers, so that’s 4 times.

Hightower

4 times that’s one gasers, okay. Why was the team running those sprints?

Thornton

Because they—because we were walking during practice and not doing what we were supposed to be doing.

How many sprints did your group run?

Thornton

We all ran as a group so…

Hightower

You all ran as a group, the whole team?

Thornton

Yes, yes. Uh… I don’t… I want to say 20s— 30s.

Hightower

20’s—30’s?

Thornton

Yeah, that’s what I was… that’s what I was told by people that were keeping count by teams that players that were able to quit running because they were running good. I heard 20’s—30’s.

Hightower

20…

Thornton

I just heard different thing; I never really…

Hightower

O.K. You never kept count?

Thornton

No, I didn’t keep count. about that.

Hightower

So that 20 or 30 is what you heard other teammates say?

Thornton

Teammates say, yeah.

Hightower

And you had said you were in the uh, you ran at the team?

Thornton

Yeah.

Hightower

How many sprints did you run before you took off your gear?

I wasn’t worried

Uh, we probably ran about 8 and took off our helmets, then 2 more after that. So 10 altogether, we had our… after the 10th one we took off our shoulder pads.

Hightower

O.K. So you did 8 and you took off your helmet.

Thornton

And 10… then 2 more after the 8 we took off our helmet.

Hightower

2 more, yeah. You did 8?

Thornton

Took off the helmet.

Hightower

Took off the helmet and then you did 2 more.

Thornton

And then we took off the shoulder pads.

Hightower

Then the shoulder pads you said. How many you do with the shoulder pads?

Thornton

Uh, 10.

Hightower

10.

Thornton

We did 10… we did 8 with the helmets on after the… during the 8th one we took our helmets off. Then we ran 2 more after the 8, then we took our shoulder pads off then. However many we ran after the shoulder pads; I do not know.

Hightower

O.K. How long do you think the team was running those sprints?

Thornton

45 minutes maybe to an hour.

Did you or any of your teammates ask for water breaks?

Thornton

No sir.

Hightower

Or try to get water during the running of the sprints?

Thornton

Didn’t nobody say that.

Hightower

Did you or any of your teammates become ill by running the sprints?

Thornton

No sir.

Hightower

Nobody? During the practice this year have you personally seen or heard any teammates being injured?

Thornton

I’ve seen players get hurt from—not from running but they hurt their ankles or something like that.

Hightower

O.K.

Thornton

But I haven’t seen anybody get hurt from running.

Hightower

Any other injuries besides ankles? That’s the only one you saw ankles?

Thornton

I’ve seen ankles, shoulders.

Hightower

Shoulders okay.

Thornton

Just like stingers and things like that.

Hightower

Stingers, okay.

I’ve never seen anybody get hurt from running.

Hightower

What about anybody quitting the team?

Thornton

Yeah, there was two people that day that, I think, they quit but I think they’re back on it.

Hightower

O.K. Who were the people that quit that day?

Thornton

David Engler and Chris Bryant.

Hightower

Chris Bryant… David Engler what is his race?

Thornton

White.

Hightower

O.K. And what about Chris Bryant?

Thornton

Bryant is white.

Hightower

O.K. So they both quit that day? Do you know when they quit the team, what time of that day they quit?

Thornton

During the running.

Hightower

During the running?

Thornton

Yes.

Hightower

Was that the reason they said or do you know the reason why they quit?

Thornton

No sir. They did… they just didn’t want to run no more that would be my guess.

O.K. Now did you see Max collapse?

Thornton

After we ran, yes. Actually, no, because we ran this last one after David Engler and Bryant

we ran one more, and everybody… only a few people entered the running on that one because everybody walked over because he said we were done but a few of the defensive guys they ran it anyways; they ran down, they ran back, and when I was walking towards the bleachers or whatever your are supposed to take a knee at. I seen him—I seen him on the ground and people running to get ice to him and water towards him. Hightower

And then uh, Athletic director Mr. Sweat, he was on his way over there.

Hightower

O.K. So you… when you were walking towards the uh, the tree, I guess you said to put and walking towards the tree when you got over there, then you looked around that’s when you saw him down?

Thornton

Yes sir.

Hightower

O.K. You said who ran to him?

Thornton

Uh, we had Coach Steve and a few—and a few other coaches, I think, and then Tray is… is the water—water boy.

Hightower

Tray, uh did anybody else get sick or collapse?

Thornton

Antonio Galloway.

Hightower

Antonio Galloway you say. occur before Max’s or after?

Thornton

Before Max.

And he had a hard trouble breathing… breathing.

Yes.

Did he continue to practice or did he stop?

Thornton

He stopped and they carried him over to the water.

Hightower

No sir.

Has anyone influenced you in any way to withhold information or change the facts that actually occurred during the practice?

Thornton

No sir, he told us to tell the… tell the truth and nothing but the truth.
