THE RIGHTFUL HEIR The annotated case is all about the process of how succession works and how, by means of inheritance, the decedent’s property would be transferred to their rightful heir. This pinpoints the rampant problems of Filipino families not only in soap operas and movies but, yes, in real life situation. The legal terms abovementioned regarding acquisition of such property gives me an idea on how inheritance of one’s estate happened here in our country. We all know that succession works through the last will and testament that considered as a free will of an individual with the requisites and obligations attached to it since he has the capacity to decide whether who will be the recipients of his possessions. And through the years of our existence, we cannot deny the fact that we’re facing issues regarding mode of acquisitions that are based on family relations. This subject matter usually aired on radio and television hit close to reality, and sometimes the outcome is not that good as you think. The distribution of the inherited wealth is often unequal in a way that the majority might receive little and only a small number inherit a larger amount in a sense that sometimes gender might be one of the qualifications of the amount of inheritance when the son is much more favored than the daughter of the family usually in inheritance of business since they have this thinking that men are much more expert in handling business than women which is quite not right and unfair. This is especially seen in old world cultures, but continues in many families to this day. Other scenario of succession results to warring families that they are willing to kill each other or they will do everything through greed and fraudulent act albeit they’re not the beneficiaries written in a will just for the sake of possessing such wealth. They tend to value wealth over their own family, which is still bothersome though it’s an old issue to be stressed on but still need to be concerned as it reflects the not so perfect society we’re living in. Succession is one of the stressful issues in every family that’s why the will plays a very important role with regards to this matter. We concur to the requisites that it be in writing attested by witnesses and that it be signed and also we coincide that court should not sit in judgment upon the motives of a testator because nothing in the law restrained them from disposing their possessions in a manner they desired to their chosen rightful heir as it is a free will of an individual through the will and testament provided by law.
