TERMINAL REPORT February 13, 2019 RE:

PUBLIC HEARING AND WRITESHOP ACTIVITY FOR THE PROPOSED ORDINANCES: “AMENDING VARIOUS SECTIONS OF PROVINCIAL ORDINANCE NO. 16-201 TO INCREASE SOME CURRENT HOSPITAL CHARGES AND FEES AND TO INCLUDE SOME HOSPITAL SERVICES RENDERED TO PATIENTS OF THE BENGUET GENERAL HOSPITAL ECONOMIC ENTERPRISE” -AND“AN ORDINANCE REQUIRING ALL MOTORCYCLE, TRICYCLE, E-BIKE AND BICYCLE DRIVERS AND RIDERS TO WEAR A HIGH VISIBILITY VEST WHILE TRAVELLING ALONG THE NATIONAL HIGHWAY AND IN ALL PROVINCIAL AND MUNICIPAL ROADS WITHIN THE PROVINCE OF BENGUET AND PROVIDING PENALTIES FOR VIOLATION THEREOF”

BACKGROUND: The Provincial Governor’s Office forwarded to the Sangguniang Panlalawigan members a letter forwarding the request of Dr. Maria Imelda C. Ulep, BeGHEE Chief of Hospital, for the amendment of provincial ordinance covering current hospital charges and fees and the inclusion of some hospital services rendered to patients of the Benguet General Hospital Economic Enterprise. Thus, the committee on Ways and Means of the chaired by Hon. Juan M. Nazarro Jr. called for a special meeting inviting the Provincial Finance Committee and the staff of BeGHEE to jointly discuss the matter. On January 21, 2019, the special meeting was conducted. On said meeting, the proposed ordinance was drafted and was agreed upon that a

public hearing will be conducted to accommodate and consolidate the comments and suggestions of the stakeholders. On the other hand, Hon. Fernando M. Balaodan Sr. forwarded to the Sanggunian his proposed ordinance entitled: “AN ORDINANCE REQUIRING ALL MOTORCYCLE, TRICYCLE, E-BIKE AND BICYCLE DRIVERS AND RIDERS TO WEAR A HIGH VISIBILITY VEST WHILE TRAVELLING ALONG THE NATIONAL HIGHWAY AND IN ALL PROVINCIAL AND MUNICIPAL ROADS WITHIN THE PROVINCE OF BENGUET AND PROVIDING PENALTIES FOR VIOLATION THEREOF” for first reading during their session on January 28, 2019. During the session, the proposed ordinance was referred to the Committee on Public Utilities, Transportation & Communication chaired by Hon. Juan M. Nazarro Jr. Upon their committee meeting, both committee chairmen opted to have the proposal be subjected to a public consultation to get more inputs and/or suggestions. Thus, on February 12, 2019, a hearing/consultation was held where both ordinances were presented to the public.

Public Hearing and Writeshop Proper: 

The participants of the said activity was composed of Barangay Officials, BeGHEE staff, Chairman of the SB Committees on Health and Sanitation, Peace and Order and Public Safety, and Public Utilities, Transportation, the Chief of the Municipal Police Stations, the Municipal Mayors or their representatives, the Regional Operations Plan Division Head, Chief of Police of each Municipality or their representatives, a representative from the Highway Patrol Group, and other sectoral groups who have concerns and the general public.

The Program: PART I 

- Opening Prayer & Nationalistic Songs

Hon. Juan M. Nazarro Jr., Provincial Board Member, Acknowledged and welcomed the participants.



Presentation of the draft ordinance entitled “AMENDING VARIOUS SECTIONS OF PROVINCIAL ORDINANCE NO. 16-201 TO INCREASE SOME CURRENT HOSPITAL CHARGES AND FEES AND TO INCLUDE SOME HOSPITAL SERVICES RENDERED TO PATIENTS OF THE BENGUET GENERAL HOSPITAL ECONOMIC ENTERPRISE” facilitated by Mr. Marvi G. Burgos. Dr. Maria Imelda C. Ulep and the proponent Hon. Juan M. Nazarro, Jr. were present to accommodate any and all comments/inputs.



The provisions of the proposed ordinance were carefully reviewed and the participants gave their comments and suggestions.



Significant suggestions and recommendations were then noted for incorporation in the draft proposed ordinance.

PART II 

Hon. Fernando M. Balaodan, provincial Board Member, presented the proposed ordinance entitled: “AN ORDINANCE REQUIRING ALL MOTORCYCLE, TRICYCLE, E-BIKE AND BICYCLE DRIVERS AND RIDERS TO WEAR A HIGH VISIBILITY VEST WHILE TRAVELLING ALONG THE NATIONAL HIGHWAY AND IN ALL PROVINCIAL AND MUNICIPAL ROADS WITHIN THE PROVINCE OF BENGUET AND PROVIDING PENALTIES FOR VIOLATION THEREOF”

Accommodation of participants comments, suggestions and recommendations.



Hon. Robert K. Canuto, provincial board member, ended the activity by giving his remarks.

The comments, suggestions and recommendations were then noted to be incorporated in the proposed ordinances for deliberation once they are calendared for second reading. The comments/suggestions are as follows: 

In the proposed ordinance in relation to the increase of fees and charges and the inclusion of additional services, it was suggested that there should also be improvement in the services rendered to the people.



There is a need of information dissemination with regard to zero billing.



In the proposed ordinance requiring the use of high visibility vests for all drivers and riders of motorcycles, bicycles, tricycles, e-bikes and the like, it was observed that the fine is excessive and therefor the people recommended its reduction.



Clarification on the liability or who should be liable with regard to minors upon violation of the ordinance. (Particularly on the use of bikes).



That it be clearly stated how the ordinance would be implemented and monitored, particularly with regard the deputation of Barangay Officials enacting the proposed ordinance should it will be passed. Coordination between the 13 Municipalities.
