Temporary Disability Assistance Program (TDAP) Benefits

What is TDAP?

TDAP (formerly known as TEMHA) is a monthly cash benefit of $185 for unemployed individuals who are not eligible for other types of assistance (for example, if you are eligible for TCA you are not eligible for TDAP) and who have a disability that will last for 3 months or more.

How do I apply for TDAP?

You can apply at your local DSS office. You will have to return a medical form called a 402B. This form needs to be filled out by a doctor and has to certify your disability.

Under TDAP:

Under TDAP, you are only eligible to receive benefits for 9 out of the previous 36 months unless you meet 3 other requirements: You are certified by the State Review Team (SRT) as having a disability that will last for 12 months or more. You have an active application for SSI. You are cooperating with DEAP, the state agency that assists SSI applicants. TDAP requires a “dollar for dollar” reduction for unearned income. For every dollar of unearned income you have, your TDAP benefit will be reduced by one dollar. If you receive more TDAP money than you should, money will be deducted from your future grants until the amount is paid back.

What is the State Review Team (SRT)? They are a group assembled by the state to review you case and decide whether or not you are disabled based on federal SSI standards. The SRT must develop your medical record and consider all of the medical evidence that you provide them. If you think they are wrong you should appeal their decision. How Long does DSS have to make a decision on my TDAP case? DSS has 30 days to make a decision you application DSS has 30 days to make a decision on your application. If you have provided all of the necessary information and meet the other criteria you should receive benefits pending the SRT decision for up to 90 days. Do I need a new 402B at every redet? If you have already been certified as disabled for 12 months you do not need a new 402B at your re-det. As long as you have an active SSI application, and you are cooperating with DEAP your benefits should continue. If you do not have access to a doctor, DSS should provide you with a $60 voucher and list of doctors that will accept them. Ask your case worker. I think that DSS is wrong, what should I do? You can request to speak to a supervisor about your case, if you are not satisfied with the results you should file an appeal and seek legal help. You can appeal nearly everything DSS does. You can appeal if your benefits are: Terminated, if your application is denied or delayed, or, if you are determined not disabled. In all notices of adverse action, DSS must include an appeal form. You can fill this form out and submit it. Also, DSS should have appeal forms at each local office. You can also call: 1-800-332-6347 and ask for a hearing. Your worker must help you in requesting an appeal.
