" Jason King, a spokesman for the American Association of Motor Vehicle Administrators, argues that there is a need for a national licensing policy that would require states to have similar standards. With increasing security demands, he said, states must be backed by the federal government in order to make sure the system is functioning properly. "The driver's license is giving Americans a false sense of security," King said. "People expect that when they accept a driver's license ... we have done our homework." A national survey conducted by the American Association of Motor Vehicle Administrators found that 77 percent of Americans favor federal legislation that would require more uniformity and stricter penalties for fraud. Federal legislation now working its way through committee would require states to link driver's license expiration to visa expiration. The National Conference of State Legislatures opposes this legislation, calling it an "unfunded mandate on state governments." Bernstein said that at least for now, the federal government should not get involved in issuing of driver's licenses. "The United States has always made most of the aircraft in use around the world, we produce most of the instructors and we train most of the pilots," said Joseph E. Burnside, vice president for government and industry affairs of the National Air Transportation Association, the trade organization for the general aviation industry. "But now we're concerned that we may be losing that market." "If the government doesn't get its act together, students are going to begin training overseas, and that training will be of lesser quality than they would receive in the United States," Mr. Burnside argued. 01/25/03 Huffman Aviation sold Rudi Dekkers1 tumultuous ownership of Huffman Aviation Inc. took its final turn Friday with the sale of the business to competitor Triple Diamond Jet Center for an undisclosed price. Jim Beach, Triple Diamond's director of operations, said his company would take possession of Huffman Jan. 25, though the deal will not close until two contingencies have been met: * The city of Venice agrees to the assignment of the Huffman lease to Triple Diamond. That probably won't be until February, according to Beach. * Dekkers' sometime financial partner Wally Hilliard drops a suit against the company seeking the repayment of loans. "We're not buying any litigation," Beach said. He said Hilliard was present at the contract signing Friday afternoon and is agreeable to dismissing the suit. Dekkers and Hilliard will be left to resolve their differences on their own, Beach said. Though Hilliard financed Dekkers' purchase of Huffman, Dekkers was the sole stockholder, Beach said. Dekkers bought the company in May 1999.

Close calls Dekkers almost didn't make it to the bargaining table. On his way to Venice Friday morning, the helicopter he was piloting flipped and crashed in the Caloosahatchee River near downtown Fort Myers. He was rescued by another helicopter in the vicinity and traveled to Venice after being checked out at Lee Memorial Hospital. His tenure at Huffman was marked by legal problems of various sorts

Rudi Dekkers sold Huffman Aviation to one of his competitors Friday, in hopes the sale would make some of his legal problems go away. Triple Diamond Jet Center, which had already bought one property from Dekkers, will buy the rest of the business, except for 10 airplanes. The purchase price was not disclosed. Although the transfer of lease at the Venice Airport must be approved by the City Council, Triple Diamond has already taken over day-to-day operation of the business. Dekkers offered the businesses for sale in the face of a civil suit from former business partner Wallace Hilliard of Naples and a criminal suit alleging fraud. The fraud suit stems from the sale of one aviation building to Triple Diamond though it was mortgaged to guarantee a $200,000 loan from a business associate. Dekkers claims the loan money went straight to Hilliard for debts incurred by Florida Air Inc., which Dekkers and Hilliard founded in early 2001. Dekkers said that when everything was finished, all debts would be paid — including one to Kenneth Jossart, who filed the complaint against Dekkers. "If the complainer is dropping the case, hopefully the state attorney will do the same," Dekkers said. Assistant State Attorney Jonathan Greene said he'd consider anything presented to him but at this point he's planning to continue with prosecution. The sale is contingent on Dekkers' sorting out legal and financial troubles with former business partner Hilliard and creditor Jossart, said Jim Beach, director of operations for Jet Center parent company Triple Diamond Enterprises. "We don't care what Wally owes Rudi or Rudi owes Wally," he said. Last month, Dekkers sold the maintenance portion of Huffman Aviation to former Huffman general manager Bob Martin and his partner, Norm Beckman. Martin and Beckman are operating as Venice Aviation Services. That sale, too, is pending City Council approval of assignment of airport leases. Triple Diamond will not be operating a flight school, said Beach, who noted that several people have

Suspected WTC hijackers abandoned plane on Miami taxiway VENICE, Florida (CNN) —Two of the hijackers believed to have steered airliners into the towers of the World Trade Center left a stalled aircraft on the taxiway of Miami International Airport last Christmas, the head of their aviation school said. Mohamed Atta and Marwan Al-Shehhi rented a Piper Warrior from Huffman Aviation in Venice just four days after getting their multi-engine certification from the school, according to the school's president, Rudi Dekkers. It is not uncommon for students to rent aircraft, according to Dekkers, but it is not known why they would travel to Miami or to a major airport. They rented the $65-an-hour aircraft, and after safely landing at Miami International Airport, they had entered the taxiway when the plane's engine quit. According to Dekkers, the men then shut the airplane down, including all communications with the control tower, which he termed a major "rookie mistake." "Students do stupid things during their flight course, but this is quite stupid," Dekkers said. "They shut everything off like dumb ducks." According to Dekkers, his flight report states that the students abandoned the plane and rented a car to drive back to Venice, on Florida's west coast. They had the plane for 2.6 hours of flight time. The plane was towed into Signature Aviation, where it was checked out by a mechanic a few days later. The mechanic, according to Dekkers, could not find anything wrong with the plane. "It could have been flooded, or had a dirty spark plug", Dekkers said. The plane was flown back to Venice on January 3, which is the last time Atta and Al-Shehhi were seen in Venice. They came in to pay their final bill. Dekkers said that flight schools deal with student mistakes on a regular basis. "It happens every week. I've got 40 airplanes and students have problems every day." Dekkers said the FAA told him the students would be fined. "But they can't do that any longer," he said. The FAA did not immediately return calls for comment.

If and when Osama bin Laden is killed it will be the equivalent of a declaration of war on Saudi Arabia - a statement that Osama's and the Saudi regime's services are no longer needed. As the Administration now congratulates itself over the alleged capture of the 9-11 "mastermind" Khalid Sheikh Mohammad, in spite of the fact that stories from last year reported that he had been killed or captured, and even as it can't seem to figure out whether he's being held in Pakistan or Diego Garcia and as it won't show a video of a living body, a whole new wrinkle surfaces. Testimony Huffman Aviation by CEO President Rudi Dekkers On July 1st, 2000, Mohamed Atta and Marwan Alshehhi arrived at Huffman Aviation in Venice, Florida to inquire about taking flying lessons. After a description was given about our flying school, they said they would let us know what they would decide about the flying lessons. On July 3rd, 2000, Atta and Alshehhi came back to Huffman Aviation to sign up for lessons. Atta already held a Private Pilot License but wanted to advance and get his Commercial License and Alshehhi was there to obtain both a Private and Commercial License. They had stated they were unhappy with a flying school they attended up North. We told them the cost for the licenses they wanted was about $18,000 per person with $1,000 down payment and $1,000 weekly thereafter paid by Atta with a check drawn from a First Union account. They inquired about a place to stay. It is normal procedure for a flying school to offer proper accommodations for students whom are learning to fly. However, at the time Huffman Aviation had no such accommodations. Due to the fact they came through the front door without advanced notice for Huffman Aviation to take care of a room. Rudi Dekkers, owner of Huffman Aviation, knew that Charles Voss, CFO of Huffman Aviation, rented out rooms in his home. Atta and Alshehhi rented a room from Voss, but after one week were asked to leave due to excessive rudeness from Atta to Mrs. Voss. After their eviction there was no mention of where they were staying. Atta and Alshehhi started their flying lessons on July 6th, 2000 in a Cessna 172, N734EE with flight instructor Thierry Leklou. Then in August Leklou went to the Chief Flight Instructor, Dan Purcell, to complain that Atta and Alshehhi had behavioral problems and that they were not following instructions, they also had bad attitudes. Purcell asked Dekkers if it would be okay to expel them from the program. Dekkers said that if necessary it would be acceptable to expel them from the program. Purcell had a meeting with both Atta and Alshehhi to let them know there had been complaints about their behavior and that if they would not conform they would have to leave the program. Their behavior changed and they were able to continue their lessons without any further problems throughout the course. On August 29th, 2000, Nicky Antini, Student Coordinator of Huffman Aviation, sent in I-20M's to the INS along with a copy of their passports.

CHAPTER FOUR THE INS'S DELAYED PROCESSING OF ATTA'S AND ALSHEHHI'S APPLICATIONS FOR CHANGE OF STATUS

I. Introduction In this chapter of the report, the OIG addresses the first of the two questions presented by the Attorney General in his March 13, 2002, memorandum requesting our investigation: • Why did the INS take so long to process the change of status applications, including the 1-20 forms, of Atta and Alshehhi? We begin with detailed information about the forms used in the change of status process and the circumstances that gave rise to Atta and Alshehhi filing change of status applications with the INS. Next we describe the processing of Atta's and Alshehhi's change of status applications at the Texas Service Center, as well as the processing of the 1-20 - the form that was sent to the contractor and returned to Huffman Aviation in March 2002. We then analyze the reasons that the INS took several months to process the change of status applications of Atta and Alshehhi. Because it is directly related to the issue of the processing of the 1-539 applications, we also analyze whether the INS properly approved Atta's and Alshehhi's change of status applications. In addition to examining each step of the adjudication process, we examine information that should have been available to the adjudicator before the adjudication was completed but was not. II. Process to Obtain Nonimmigrant Student Status As we previously discussed, foreign students who want to study in the United States can obtain legal permission to do so in two ways. The method pursued by the majority of foreign students is through the student visa process. The State Department is responsible for issuing visas to nonimmigrants outside the United States who intend to become full-time students. ^ Nonimmigrants may also ask the INS to change their status to students after they have entered the United States through other legal means. —This method does not involve the State Department. To change their status to student while in the United States, the applicants file INS Form I539 (Application to Extend/Change Nonimmigrant Status), — along with the appropriate fee
