Please make the list in priority order. Cite-checking. Steve Dunne has a team of cite-checkers (Yoel, Gordon, Serena, Alexis, Raj). They will be coming to us for assistance. They will be consolidating the number of footnotes. They will be seeking physical copies of the back-up docs for each footnote. We will need to provide them on their timeline as requested. Appendix. One appendix will have a list of all people interviewed, to facilitate footnoting. • To cover our interviews we need to provide a complete list with: Name (undercover as needed, with special arrangements for a few anonymous), Date, City. • The FO requests a new for MFRs, which are running at about 800 out of 1500. FO recognizes that they will not all be done even during the life of the Commission. They would like us to make a push to get what we can by Tuesday. Any MFR that comes to me before then I will review and forward, and aim to have all of them done that are already on hand by Monday. If we are relying on notes for citations, we are to provide physical copies of these to the cite-checking team. We can provide draft MFRs. Copy editor. Alice Falk starts Tuesday. Deadlines. • Report to pre-pub by July 1, printer by July 15. Commrs will get drafts of 1-4 starting today. (We will be getting 4 back, and of course 2, and I am lobbying for 1 as well.) FO will try to move chapters into pre-pub before July 1 if possible. • Monograph. Deadline is July 1. FO will make judgment as to whether monograph is publishable. Right now they contemplate on by Naftali on the history of the 1C through Bush 1 and T4, also T7 and T5. Comment: the deadlines are overlapping and the requests from the FO will continue to be unexpected and tight, making it difficult for us to do the research and writing we still want to do for the monograph. The attached chart lists names or other identifying information for all CBP officers involved in adjudicating the entries of 9/11 hijackers. The CBP inspectors with the notation "DHS Request No. 11" have already been interviewed, except for Donald Krause, whom the Commission may choose to interview in person at a later date. The remaining inspectors are the subjects of this request. The Commission reserves the right to re-interview these individuals based on the results of the requested interviews and the needs of the Commission.

4,400 were suspected of being fraudulent. As a result of the investigations, 54 individuals were successfully prosecuted. The Government estimates that these individuals received in excess of $4,000,000 in fees for filing the fraudulent "late amnesty" applications. Of special note is the fact that Operation Desert Deception was the first time INS used extensive computer support and rudimentary data mining techniques to identify fraud trends among potentially fraudulent cases. Large scale conspiracies can no longer be investigated solely with traditional investigative techniques. Like a single money laundering transaction, an individual fraudulent application can often easily pass scrutiny, |Only through computer analysis was it determined that hundreds of individuals were simultaneously claiming to be living in the same one bedroom apartment; or that hundreds of others claimed to be living simultaneously at the same, nonexistent addresses. Moreover, alien criminals and terrorists manipulate the benefit application process to facilitate expansion of their illegal activities, such as crimes of violence, narcotics trafficking, terrorism, and entitlement fraud. For example, Mir_ Aimal Kansi, the Pakistani terrorist wanted in connection with the Central Intelligence Agency Headquarters shootings, had been issued two employment authorization documents; one after having applied for political asylum; and, one after having applied for legalization. The nexus between criminal activity and benefit fraud is also evident in the cases of suspected Russian organized crime figures who are the beneficiaries of L-l (Intra-company transferee) petitions filed by non-existent or non-operating businesses.

3. FBI immediate response on immigration and border security. 8. Visa Identification Terrorist Automated Lookout (VITAL). Documents sufficient to describe the origin, mission, and results of the VITAL project, including the number of potential foreign terrorists identified who have attempted to enter or have entered the United States. 9. Visas Condor. Documentation and information discussed in the briefing for the Commission on July 31, 2001 describing the Condor namecheck program, including: a. Mission — the directive establishing the Condor program and the criteria for countries and individuals subject to it; b. Personnel - the names of the lead personnel and those responsible for preparing the Condor Security Advisory Opinions (SAO's) sent to the State Department; c. Statistics — the number of visas Condor SAO's performed by the FBI from its inception in 2001 to the present, by month; a chart graphing the number of Condor SAO's on one axis and the number of days it took to complete the clearance on the other axis; d. Counterrorism results — the categories of reasons cited by the FBI for proposing to the State Department that visas be denied, and the numbers of denials proposed by category; the number of aliens to whom a visa was denied based on FBI's SAO; the number of aliens to whom a visa was granted over the objection of the FBI; the number of SAO's performed by the FBI where the FBI was unable to locate its files pertaining to the individual (where the individual was either a subject or a cross-reference in an FBI investigation) with a breakdown stating whether the missing files were counterterrorism or other files; and e. Current status — the most recent memorandum to the Attorney General or Deputy Attorney General summarizing the status and accomplishments of the Condor program, including any revised criteria; and documents sufficient to describe efforts currently underway to establish a candidate scoring system for visa applicants. 10. Foreign Terrorist Tracking Task Force (FTTTF). Documentation shown or discussed in the briefing for the Commission on August 21, 2001, including: the powerpoint presentation showing FTTTF's mission, methodology, and list of databases; FTTTF's role supporting the Condor, Tiger, Absconder and other counterterrorism initiatives; the number of individuals identified as potential foreign terrorists on existing watchlists whom FTTTF located in the United States; and the most recent memorandum to the FBI Director or his designee reporting on the status of FTTTF, its current staffing, and relation to the national watchlist center. 11. Security Directive List. Documents sufficient to establish the origin, mission, and results of the Security Directive List created and disseminated by the FBI in the immediate aftermath of September 11,2001. 12. Immigration-related detainee program. All electronic communications, investigative inserts, letterhead memoranda, affidavits, and FD 302s, related to those individuals among the illegal immigrants detained and held after September 11,2001 on immigration-related charges who were determined to be affiliated with or associates of the 19 hijackers, al Qaeda, or related groups; and the total number of aliens detained as a counterterrorism measure. 13. Voluntary interviews. Documents sufficient to establish the origin, mission and criteria, organization and results (prosecutorial and preventive) of the voluntary interview program involving interviews of Muslims, Arabs, and others by the FBI or Joint Terrorism Task Forces in response to the attacks on September 11, 2001, including criteria on when and how to detain interview subjects.

14. "S" visas. Documents sufficient to describe the FBI's role in the "S" visas program for individuals who have supplied terrorist-related information to U.S. law enforcement, including the number of individuals to whom "S" visas were issued since September 11, 2001, and whether such persons were associated with immigration-related detainees program, the voluntary interview program, the Absconder Initiative, or another FBI activity. 15. Referrals for prosecution on immigration charges. Documents setting forth the number of individuals who were either the subject of or a cross-reference in an FBI counterterrorism investigation who were referred by the FBI for prosecution on at least one immigration charge during the period (a) from January 1, 1998 through September 11, 2001; and (b) from September 12, 2001, through the present. 16. Alien smuggling along the Southwest border. Documents from January 1,1998 through the present discussing the issue of smuggling of aliens from the Middle East, Pakistan and Afghanistan into the United States across the Southwest border. 17. Links between illegal entry into the US and organized crime. Documents from 1998 to the present discussing in summary form FBI information about linkages between illegal entry by terrorists into the United States and organized crime, weapons traffickers, traffickers hi persons, terrorist financiers, or narcotics traffickers.
