This is an action request • see paragraph 6. 3.9 FAM Appendix K concerning the use of visa referral systernslias been updated. The revised notes are now available on the Department's Internet (WWW.FOIA.STATE.GOV/FAM) and Intranet (HTTP://10.4.64.84/FAM/FAM.HTML) sites, and are effective immediately. 4. These changes are partly a result of a Federal court's decision (Ref B), in a case involving a false immigration scheme, to accept written attestations on signed visa referral forms as evidence of the referrer's complicity in the scheme. The court's decision stresses the importance of completing visa referral forms honestly and accurately. Referring officers assume responsibility for the information provided for on the form and must be made aware of the implications of attempting to defraud the government by making false statements on visa referral forms. 5. The major changes include the following:

view telegram! 1] •• Posts must utilize the visa referral forms included as Exhibits I and II in Appendix K for all Class A and B referrals, respectively. •- Chiefs of section or USG agency heads must approve all Class B referrals. •- Posts must establish a tracking system for all visa referrals. •• The original visa referral form must be filed with the approved or refused visa application. •• The chief of the consular section must inform the Chief of Mission (or DCM) and Regional Security Officer in writing of any instances in which a single agency or office is responsible for referring significant numbers of mala fide or unqualified applicants. 6. Action request: Consular managers are requested to review the text of Appendix K on the Intranet or Internet and ensure that their procedures are in compliance with the notes. If posts are unable to access the online versions of the FAM and would like an e-mailed copy of the updated notes, they should contact their post liaison officer in CAfVO/F/P. If posts have questions about referral procedures, they should contact Mark Strege in CAjVOfFfP. 7. Minimize considered. POWELL
