NOVAK.of the United/States Attorneys Office (USAO), Eastern District of Virginia (EDVAV. lhas been employed by the USCS for nine (9.V'years' as/ah inspector; the last six years as a senior inspectoral O'Hare Internationar Airport.! . Jduties-lcfclode the enforcement of United States Customs laws involving duties, taxes,-narcotics, curreficy, etc; of in.diyiduais entering the ^United 'States. Approximately four (4) to five (5) million.individuals enter.the United StateVyeaely through O'Hare International Airport and approximately one (1). percent are stopped by USCS and nioyed to a secondaryiarea for\further inspection. This secondary inspection is based on either observations by the inspector on ^information supplied by the traveler on the USCS Declaration form. .'/ / ; H i '*• [was shown photo copies of a USCS Declaration form for ZACARIAS MOUSSAOUI dated February , 2000, tor entry into the United States on United Airlines/flight # 929 arriving from London, England. MnilSRAnu-l declared $45,000 on the declaration form/and was moved to sdcoridary for further inspection. ^vas shown a USCS Form # 4790 Report of International Transportation of Currency nr Monetary Instruments! [stated that this form whicr/was prepared bvt ^land initialed by[ ^ias MOUSSAOUI declaring $35,000 not $45.000:1 / ~^has no independent recollection of the secondary stop concerning MOUSSAOUI but does rarogniz'^ th'e US'CS Form # 4790 as being in his handwriting and initialed by him. Upon reviewing the USCS forms"!/'/ i Istated that the form number 4790 reflected that MOUSSAOUi spent approximately five (5) minutes in the secondary area and no further action was taken concerning the stop.
