Stop Further Exploitation of Workers

“Workers are not beggars to accept what is given”. This roaring declaration of Babu Tarapada is weaning away with a replacement slogan “Accept what is given”. Why this indifferent approach and attitude? Primarily it is aimed to rouse workers anxiety and somehow derive the mileage and thereby to arrest the exodus and erosion. Except BSNL, the Wage Negotiation in all other PSUs is direct by National Trade Union Centers, either jointly or severally. In majority of the PSUs the Wage Negotiation exercise has not even taken off and in some it is just seeing the light. While the fact remain so, some BSNL Unions either directly or indirectly associated with the National Trade Union Centre are out to create labour unrest in the Industry by some means or methods. If the concern is aimed towards workers interest it is understandable. But it is in reverse. The naked game played by vested interests on Interim Relief stay green in everyone’s memory. Now the attempt is an exercise towards wage by exploring all sorts of possibilities to exploit the workers expectations, to resultantly drive them against those engaged in wage negotiation with the management. It is more surprising that those who have not even cared to submit a Wage Memorandum of their own organization play premier role in divisive methods under the guise of someone to somehow blame others. Their game is an act of naming a child for which they have not given the birth. The delay in Wage Negotiation is due to delayed receipt of guidelines from DPE and Administrative Ministry. In addition the delay in Wage Negotiation is a consequence of the decision and

suggestion of CPSTU to commence wage negotiation for non executives, after implementation of revised wages for executives. The spirit behind such a decision was to avoid PSU workers receiving indifferent treatment and facing similar derogatory position as has happened earlier after previous wage negotiation. Today, BSNL is the first major PSU where the negotiation started since January 2009 under successive pressure from United Forum Unions. For decades together the periodicity of 5 Years Wage Revision in PSUs stayed and got changed to 10 years from 1.1.1997 based on Mohan Committee Recommendation. After release of second Pay Panel report, the Government of India and not less than the Prime Minister agreed for 5 years revisions in PSUs. Besides, the recommendations and guidelines are clear to the effect of providing 30% fitment benefit with 68.8% IDA merger (subsequently revised as 78.2%). This recommendation cannot be an exclusive disposal for Executives and hence United Forum reiterates its demand of five years periodicity. BSNL management that was gracious in extending the benefit of 30% to Executives remained silent over periodicity for them. But they insists 10 years periodicity for non executive Employees. A situation to revise the Pay Scales of Executives as and when the management desires by availing the benefit of executive’s Wage revision as and when they feel so”, may crop up. The possibility of denial of such revision for non-executives cannot be ruled out in the event of existence of an agreement for 10

years periodicity due to legal validity of an agreement. Under the process of Collaborative style, that is, though they may not gain a better solution, they are more likely to feel better about their future chances for future understanding and goodwill; some indulge to adopt unethical methods. The management which is against the justified demands placed in Wage Negotiation Committee aims to nullify it by adopting the established role of Divide and Rule. It is the time for workers to understand the negative role of divisive forces and extend full support to the Negotiating Unions without falling into the trap of Management and its emissary. Hope those who express their readiness to accept what is given by management in its true form, will get up from their catnap and stop further exploitation of workers anxiety.

CHQ Letter No : TEPU/CHQ/WR/2009 Dt. 15-7-2009 Respected Sir, Back ground of Issue The Wage Negotiation in BSNL that commenced few months back is now in stalemate due to sharp differences between the Staff Side and Management on the approach over Periodicity. The Staff Side demanded an agreement on 5 Years periodicity on the lines of assurances of Honourable Prime Minister of India in his meeting with National Trade Unions on 28.04.2008 and based on the decision of reaching

agreement on 5 years periodicity subject to the limitation that it should not go below 5 years and as enunciated in the orders of DPE vide their OM: 2(7)/06DPE (WC)-GL dated 1.5.2008. Illogical stand of BSNL Management Though no where the orders DPE recommended a lesser fitment benefit for 5 Year periodicity, the BSNL management came up with a fitment benefit of 10% and refused to agree with 30% fitment. This illogical stand of the BSNL management has driven the BSNL Unions to serve notice of Trade Union Action. Finally, it was agreed to refer the issue to the Ministry and proceeded further after getting the response. Accordingly, reference has been made by BSNL to DOT on the issue, the disposal of which is awaited. Arguments in favour of the demand of 5 year periodicity Until the sixth wage revision, the wages in CPSEs were revised every five years. Thus from 1971 to 1996, in twenty five years, five wage revisions have taken place. But during the sixth wage revision a unilateral decision of Ten years was introduced for non executives. Considering the imbalance, based on the assurances of Honourable Prime Minister, orders were issued by OPE to go in for 5 Year periodicity. No where instructions exist to offer lesser fitment percentage on 5 year revision Instructions are clear to offer 30% fitment with 78.2% IDA benefit No periodicity of Ten year has been prescribed to executives in recent revision of wages.

Our Concern As per recommendations of Justice Rao Committee, the management is free to revise the scales of Executives at any time. There is no such for non-executives and any wage revision is only through negotiation. Management’s insistence for 10 years may deprive non-executives opening a dialogue of negotiation in the intervening period. . Our Plea and proposal As there is no mention over periodicity in the orders on revision of pay scales of executives from 1.1.2007, it is unfair and illogical on the part of the management to impose it for nonexecutives. We propose as under: Fitment : Uniform fitment of 30% plus IDA at 78.2% from 1.1.2007 Period : Five Years effective from 1.1.2007. Next revision after 5 Years be accepted with a proviso for revision of wages on a mutually agreed decision taking into account the financial viability of the company. We request the intervention of the Honourable Minister for suitable instructions to the concerned authorities to settle the issue as proposed above and thus to end with stalemate.

Since this issue involving 60000 employees who are backbone in all the activities of BSNL is pending for the decision for the past few years. I request your personal intervention and direct the concerned authorities to upgrade the pay scales of Senior TOAs at par with TTAs. CHQ Letter No : TEPU-CHQ/ Pay Upgdn /Sr TOA Sir, Sub : Up gradation of Pay Scales of Senior TOAs at par with TTAs. The cadre of Senior TOAs remains for decades together as a back bone in all the activities of the erstwhile Department of Telecommunications and presently with BSNL. The Cadre which was placed in higher basic scale compared to other Group-C cadres earlier was made to gradually slide down, in spite of the fact of revision of entry qualification and major shift in the nature of duties. The erstwhile Department of Telecom as well as BSNL which concentrate in development of Technology has arrived to the conclusion of protecting the Technical Cadres by revision of / up gradation of ignoring the fact there is an equivalent role played by officials in the cadre of Senior TOA who are also performing technical operations with the introduction of modern technological systems. The group-C cadres, namely TTA and Senior TOA were carved out after restructuring of cadres, the entry qualification as per recruitment Rule was respectively Diploma and Degree course. However, when pay scales of the TTAs

were revised with higher start, the same was denied to Senior TOAs. The issue was raised earlier in the Departmental Anomalies Committee during March 1997 and was agreed to resolve the anomaly. This Union’s continued effort to procure equal status for these cadre officials at par with TTA has not received the consideration of the management in spite of the following responsibilities shouldered by them. Data feeding, handling on matters related to customers, employees and management activities in all areas of administrative / technical works. Front of activities including online booking of new lines, broad band-Mobile Connections through CSRs / CSCs Complete activities in all customer centre including complaint resolving, attending to mobile complaints, bill complaints and offering remedy / redress to customers on the spot. Computerized preparation of project estimates, floating of tenders and its further related activities Accounting and forwarding the counter collection through computerized operations and cash handling. Maintenance of Customer / Public Relations at all places of activities of BSNL All the above said activities carried out by Senior TOAs are in consonance to the developed technology and the ever changing technology will drive them to adapt to various types of technological work day after day. Considering the need, necessity and importance of this cadre, to fit into new concepts of operations, the entry qualification has been raised to Graduation with computer application, forgetting the necessity of simultaneous upgradation of their scale.

From the above it can evidently be seen that there is every justification to place Senior TOAs in the scale of Rs-7100/As wage negotiation in BSNL has already commenced, decision over fitment of these cadres in the scale of Rs. 7100/- prior to implementation of the revised scale will be a measure of motivation to thousands of Senior TOAs to further effectively discharge their duties to the advantage of the Industry. We seek your intervention and suitable instructions to concern to render Justice to the deprived cadre, Viz. Senior TOA.

No : TEPU-CHQ / TTA Upgdn / 2009 dt 13.7.2009 Respected Sir, Large number of eligible candidates from the Cadre of TTA was declared successful in the Qualifying screening test held on 23.4.2000, for promotion to the cadre of Junior Telecom Officer. After adjusting to the extent of available vacancies as on 31.8.1999, there remained around 6000 officials those who were successful and eligible for promotion. The issue of promotion of these officials was discussed in various forums and an agreement was reached to absorb these officials in a phased manner. Accordingly, BSNL Board of Directors on 30.3.2001 decided to accommodate wait listed candidates in 35% quota by diverting year after year 500 posts and absorb these officials as JTOs. This process was continuing until recently without any problem and about 3500 officials were absorbed as JTOs, leaving behind about 2200 qualified officials Remaining Qualified Officials were imparted with Phase I Training placed on Officiating arrangement almost in. all the places with a financial benefit under FR-35.As on date the qualified TTAs waiting ,or promotion as JTO (presently officiating as JTO is as under) Kerala Tamilnadu Gujarat Rajasthan Haryana

Pursuant to the decision Honourable High Court of Haryana &

of

Punjab dated 30.5.2008 in CWP 5608/2007, the Management Committee of the BSNL Board in their meeting held on 4.11.2008 decided as under which was communicated to field units in F.No: 3-9/2007- Pers-lV dated 11.11 . 2008. The above decision of the Management has virtually ended with non- absorption of about 2200 officiating JTOs as regular JTOs. Our Union Since inception was demanding personal up gradation of these officials as JTOs to end with claims and counter claims. Our proposal was never considered by the BSNL Management Since all these officials (numbering about 2200) are officiating as JTOs for the last six years, it is unfair on the part of the management to revert them on the plea of non availability of vacancies for their absorption. Hence we submit the following proposal: To upgrade the TTA post presently held by these officials as JTO and absorbs the officials. The above proposal will not only be a permanent remedy to the waiting officials and this proposal will not cause any additional financial burden to the BSNL Management since all these wait listed candidates have reached the basic scale of JTOs and most have crossed beyond that scale. While the BSNL Board has created supernumerary posts to adjust the already promoted Qualified Officials, there can be no problem for them to consider creation of additional supernumerary post or award personal up gradation. As this issue is in doldrums for the last 10 years, we seek your personal intervention and directive to BSNL for immediate absorption of these qualified officials either by way of personal up gradation or by creation of supernumerary posts.

NATIONAL COUNCIL 23.6.2009 The First Meeting of National Council (21s1 Meeting) after 4lh Membership Verification was held on 23.6.2009 under the Chairmanship of Sri. Gopal Das, Director (HRD). S / Sri. R. Venkataraman (Leader Staff Side) and V. Subburaman participated in the Council Meeting. All notified items besides were discussed in detail and agreement reached. The gist of the outcome of the meeting is hereunder: Provision of Mobile Connections and free calls to non-executives : It was agreed to liberalise the term operational need thus to extend the facility to non-executive employees. Reactivating Works Committee : Existing orders will be reiterated with modified guidelines after discussion with Leader and Secretary Staff Side will be issued to ensure proper functioning of the committee. Non-Settlement of Pay Anomalies : The Staff Side is requested to provide some representative cases based on which the issue will further be discussed during 1st week of July and final orders issued. Implementation of Promotion Policy : Clearance from DOT is awaited. Orders will immediately be issued on receipt of file from DOT. The proposal of Staff Side to consult them before issue of orders has been agreed to. (It is learnt that the file from DOT was received BSNL has to issue necessary orders. Conducting of JTO, TTA, Telecom Mechanic Examinations : Agreed to hold the examination and notification will be issued to hold the examinations. Reduction of service condition to appear 35% Quota to JTO : The recommendation to reduce it to 7 years have already been rejected by the

management committee. However, after discussion it was agreed to remit it back to Management Committee. Review of guidelines for compassionate ground appointments : The demand of the Staff Side to review the Weightage Point system was agreed to through a small committee. In addition, the Official Side came up with the proposal of providing one time cash package and desired the Staff Side to consider it. TEFU proposed to deploy pending request claimants on daily wages till disposal of the request for appointment. All these issues will be discussed and decision. arrived through the committee. Allotment of 10% Posts of JAOs : The demand to fill up from existing SAs was not agreed. However, the management desired to examine the position after holding of the examination, Increase in Quantum of OTA Rates : The demand will be considered taking into account the existing ruling position from department of Personnel. TTA Examination - Conducting prequalification Test : Agreeing to the demand one more pre-qualifying examination will be conducted in the 40% LDCE for TTA subject to the condition of holding no supplementary examination there upon. Absoprtion of Qualified TTAs as JTOs : TEPU demanded personal upgradation of these officials as JTOs, citing that more number of such officials are officiating as JTOs during the last 4 to 5 years without monetary benefits and the possibility of absorption of these official may cause further delay due to obvious reasons. It was agreed to consider the proposal after seeing legal implications over such decision.

News in Short

It was found by our union that no action was taken by the management against the quota in majority of circles. The issue was taken up and got orders issued directing the circles to fill up such vancancies immediately. In Tamilnadu Circle alone about 86 officials are deriving the benefit against the quota after our intervention. Other Circles are following suit. PSU's Profit Increase A total 160 CPSEs made profit worth Rs. 91083 crores past fiscal against Rs. 89578 crores in 2007-08. But 53 CPSEs incurred losses worth Rs. 11274 crores in 2007-08 against Rs. 8457 crore in previous fiscal DOT Seeks Rs. 3000 crore Support for BSNL The communications ministry has sought an allotment of Rs. 3000 crore from finance ministry for supporting BSNL's wireline networks in absence of DADC support. Wage Revision Committee Chairman Sri. S.R. Kapoor Exe. Director Sri. S.R. Kapoor, Executive Director BSNL has been nominated as Chairman of the wage Revision committee for BSNL non-executive Employees. Promotional Policy-approved by DOT DOT conveyed its decision on promotion policy. BSNL is likely to take decision and issue necessary orders shortly.

Congratulations to the people of India on voting for UPA for a stable government. They have defied the predictions of astrologers, Poll Pandits and politicians. The Indian electrolate has displayed remarkable maturity in delevering its verdict in this election. The UPA's projection of Dr. Manmohan Singh as Prime Minister, in contrast to a number of 'Cooks' aspiring to be 'Chefs' in NDA and in the third front, catabulated the UPA to victory. The positive programmes of UPA such as national rural employment Guarantee scheme, massive farm loan waiver, rural infrastructure development scheme investment in social sector and Popular schemes such as one kilo rice for one rupee free colour TVs, free GAS connections in Tamilnadu benefited the people who in turn voted for UPA. Religion and caste came second and third when everyone expected growth to be biggest issue. But Indian People considered performance and continuity as the first priority. The BJP who wanted to exploit religion sentiments got nuked. Votters have hammered the left front. Its parliamentary tally reduced from 60 to 25. We congratulate UPA for its resounding victory and we hope they will continue to pursue the policies benificial to the common man. Welfare Subject : 8th Metting of BSNL Staff Welfare Board - Regarding decision taken. No. 12-1/209-BSNL (WL) The following decisions have been taken by the BSNL Staff Welfare Board in its meeting held on 15th May, 2009.

1. Scholarship : (a) It has been decided that all the Medical / Technical / Professional Graduate Degree Courses (4 years & above duration) be given scholarship @ Rs. 600/- P.M. and all Technical diploma courses (3 years duration) in Engineering/Architecture etc. be given scholarship @ Rs.360/- per month provided these institutions / Course are recognized by University / AICTE / MCI / UGC / State Govt. / Central Govt. etc. The terms & conditions for grant of Scholarship for all other Courses will remains the same. (b) It has also been decided that the scholarship for all the post-graduate integrated degree Courses be given @ Rs. 600/- or Rs. 360/- per month as applicable upto the duration of basic level of graduation degree of that particular course. For example : (a) If the Course is M.Tech (BioTech)/B.Tech Hons. MBA of more than 5 years duration, the scholarship be allowed upto 4th Year of that course @ Rs. 600/- P.M. (b) If the Course is M.Sc. (Hons) / (Bio) of more than 4 years duration, the scholarship be allowed upto 3rd year of that course @ Rs. 360/- P.M.

3. Grant of Honorarium to Treasurers of SSA's : It has been decided that henceforth the Treasurers of SSA's be given honorarium @ Rs.1500/- per annum. 4. Financial Assistance in case of death : It has been decided that the immediate finacial assistance of Rs. 15,000/- in case of death of employee be paid immediately to the family of deceased employee from the administrative fund, if the welfare fund is not available. It can be recouped later from the Welfare fund. These orders will come into force with immediate effect.

LDCE for TTA 40% No. 250-27/2008-Pers-III Dt. 30.6.2009 Sub : Limited department Competitive Examination for TTA cadre under 40% quota for the Recruitment year 2008 Approval thereof. I am directed to convey the approval of the Competant Authority for holding of Limited Departmental Competitive Examination (LDCE) for Telecom Technical Assistance (TTAs) under 40% quota for the Recruitment year 2008 as per provisions laid in the recruitment Rules of TTA circulated vide letter no. 250-41/2001-Pers-III dated 27.7.2001 (including further amendments in RRs) and as per revised scheme of LDCE for TTA under 40% quota circulated vide letter

No. 250-76/2001-Pers-III dated 4.12.2008. Instructions for filling up of 10% Absorption quota vacancies have already been issued vide letter No.

250-5/2009-III dated 18.5.2009. Unfilled vacancies under 10% absorption quota shall be diverted to 40% LDCE quota as per provisions laid in the RR of TTA-2001. Circles should ensure that the vancancies under 40% quota for each SSA are notified keeping in view the vacancies and the rosters of the concerned SSA. The cut off date for determining the eligibility of an official shall be 1st July 2008. The LDCE for TTA under 40% quota for the Recruitment Year 2008 may be conducted in all the Circles excepting those Circle. Where either court cases are pending or process of Supplementary LDCE for the Recruiment yera 2004 has not been completed. The said LDCE shall be conducted with statutory announcement that the examination/ results are subject to the outcome of SLP No. 24750-24752/2008 which is pending before the Hon'ble Supreme Court. Further directions for holding of the LDCE shall be issued by the DE branch separately. All Heads of the Circles are requested to complete the process of hodling of LDCE for TTA under 40% quota for the Recruitment Year 2008 within six months.

10% Absorption in TTA (No. 250-5/2009-Pers-III dated 18.5.2009) Sub : Filling up of vacancies against 10% Absorption quota in TTA cadre for the recruitment years 2007 & 2008 Approval thereof. I am directed to convey the approval of the Competent Authority for filling up of

rules of TTA-2001. Head of the Circles are requested to take necessary action to call for application from eligible officials and convene DPC so as to fill up the posts under 10% quota by 15.7.2009 positively. 2. The eligibility list will be drawn from amongst the applicants by arranging them strictly in the order of grades i.e. applicants belonging to higher grades will be placed en-bloc above the applicants of lower grade and the length of service within the grade shall be the criterion for arranging applicants belonging to a particular grade. The selection will be made from amongst the officials of this eligibility list keeping in view the vacancies under 10% quota, applicable roster and fitness (To be assessed by DPC). 3. The details of vacancies filled / unfilled against 10% Absorption quota may be furnished to this office for information latest by 15.8.2009. In the event of nonavailability of eligible candidates in any Circle, Nil report may be furnished to this office. In case there is not any vacancy in any SSA, the process of promotion through 10% quota may not be resorted to. It is also clarified that the No. of vacancies remaining unfilled, after the process of promotion through 10% absorption quota may be diverted to LDCE quota of the same recruitment year.

Order for dis-continuance of City Compensatory Allowance w.e.f 27.02.2009 was issued on 20.05.2009 in respect of Non-executive employees while granting them revised rates of HRA w.e.f 27.02.2009. It has resulted in drop in

emoluments of the Non-executives due to discontinuance of CCA in erstwhile A-1 Cities viz Delhi, Mumbai, Kolkata, Chennai, Hyderabad, Bangalore. 2. It has been decided with the approval of the competent authority that the amount on account of City Compensatory Allowance may continue to be paid to the Non-executives employees as a special case in above cities only to protect their emoluments drawn earlier by them till their pay revision, or till further orders whichever is earlier, in partial modification of this Office Order of even number dated 20.05.2009. 3. However, the amount so paid w.e.f 27.02.2009 will be adjusted against payment due on revision of pay. 4. In respect of such of the Nonexecutives who super-annuate/ take voluntary retirement-cease to be in service due to death/ resignation etc. prior to revision of pay, amount so paid w.e.f 27.02 2009 will be adjusted against future payment due subsequently.

LDCE for TM No. 250-8/2009-Pers-III dt. 6.7.2009 Sub : Holding of Limited Departmental Competitive Examination for promotion to the cadre of Telecom Mechanic for the Recruitment year 2008 - Approval thereof. The matter regarding holding of Limited Departmental Competitive Examination for

promotion to the cadre of Telecom Mechanic has been under consideration of the Management for quite some time. Accordingly, approval of the Competent Authority is hereby conveyed for holding of LDCE for Telecom Mechanic for the Recruitment year 2008 in accordance with the provisions laid in the Column-12

(B) of the Recruitment Rules of Telecom Mechanic-2002 issued vide letter No. 250-74/2001-Pers-III dated 20.2.2002 and subsequent amendment issued vide this office letter of even No. dated 18.7.2002. The said LDCE for Telecom Mechanic shall be conducted in accordance with the scheme and syllabus prescribed vide this office letter No. 250-20/2008-Pers-III dated 4.9.2008. 2. Before initiating the above process, the Circles are requested to ensure that all the eligible officials ‘as mentioned under column 12 (a) (i) & (ii) of the Recruitment Rules stand promoted/absorbed in the light of the provisions of the Recruitment Rules. 3. All Heads of the Telecom Recruiting Circles are requested to initiate the process of holding LDCE for TM immediately. The total vacancies in the Rr.ido of TM as on 31.3.2009 may be calculated and then 50% of the vacancies may be earmarked for the LDCE, 2008 after taking into account of the transfers of officials, who could not be promoted as TM for want of vacancies, from/to other SSAs for promotion as Telecom Mechanic. The crucial date for reckoning the eligibility of a candidate shall be 1.7.2008. It may be noted that the LDCE of TM may be held in those SSAs (i) where there Is clear vacancy and no qualified and trained official is waiting for his/her absorption in TM cadre for want of vacancies and also

(ii) there is no court case pending in connection with the LDCE for TM. The vacancies of the non-recruiting Circles may also be taken into account while notifying the vacancies of the particular SSA/Circle. The DE branch shall issue further instructions with regard to holding of examination separately.

4. Necessary action may be taken and compliance reported to this office.

Donation to CHQ It is needless to point out that thousands of Rupees have been received by Members by way of Interim relief (Salary Advance for 6 months). Request was made by the CHQ for a donation of Rs. 200/- per member. The response from Branches are not encouraging except full payment from Berhampur (Ganjam) Orissa, partly from Tamil Nadu and Kerala Circle Reiterating earlier request, the CHQ expects collection of a donation of Rs.200/- from each member and to forthwith remit it to the Treasurer, CHQ.
