Penalties for Violations of AE Law In addition to the administrative sanctions imposed under this Act, any person who violates any of the provisions of this Act shall, upon conviction, be penalized by a fine not less than Fifty thousand pesos (P50,000.00) nor more than Two hundred thousand pesos (P200,000.00), or imprisonment of not less than six (6) months nor more than (3) years, or both fine and imprisonment at the discretion of the court. Penalties for Violations on AE Law Penalties for Violation of Section 7, Subparagraph (1) by Heads of Government Agencies or Officers of Private Entities/Institutions - Any head of a government agency or officer(s) of a private firm/institution who violates Section 7, subpar. (1) of this Act (enforcement of professional regulatory laws like the AE Law) shall be punished by imprisonment of not less than six (6) months and one (1) day to not more than six (6) years, or a fine of not less than Fifty thousand pesos (P50,000.00) to not more than Five hundred thousand pesos (P500,000.00) or both at the discretion of the court. Penalties under Anti-Graft and Corrupt Practices Act In addition to acts or omissions of public officers already penalized by existing law, the following shall constitute corrupt practices of any public officer and are hereby declared to be unlawful: xxx (e) Causing any undue injury to any party, including the Government, xxx in the discharge of his official administrative or judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence . This provision shall apply to officers and employees of offices or government corporations charged with the grant of licenses or permits or other concessions. Section 3, R.A. The gross neglect or refusal of the Local Building Officials to implement R.A. No. 8559 in the issuance of building permits for agricultural buildings and structures shall cause injury to the agricultural engineers as they will be denied or barred to practice their profession

Penalties under Anti-Graft and Corrupt Practices Act Any public officer or private person committing any of the unlawful acts or omissions enumerated in Sections 3, 4, 5 and 6 of this Act shall be punished with imprisonment for not less than one year nor more than ten years, perpetual disqualification from public office, and confiscation or forfeiture in favor of the Government of any prohibited interest and unexplained wealth manifestly out of proportion to his salary and other lawful income. BOAE Actions 1) To hear and investigate cases arising from violations of AE Law, its rules and regulations and Codes of Ethics and, for this purpose, may issue summons, subpoena and subpoena duces tecum to alleged violators and/or witnesses to compel their attendance in such investigations or hearings ( Sec. 9c, R.A. No. 8981) 2) Conduct ocular inspection and monitoring on concerned offices and establishment as to compliance with AE Law, the PAES and if employing the required no. of AEs ( Sec. 9c, R.A. No. 8981, BOAE Res. No. 2, series of 2007)

BOAE Actions 3) Call any law enforcement agency to render assistance in enforcing the AE law including the rules and regulations by prosecuting the violators thereof in accordance with law and the rules of court (Sec. 12, R.A. No. 8981) The Department of Justice (DoJ) Central Office and the local prosecution offices (fiscals); The Ombudsman and Sandiganbayan (for cases vs. Government Officials who refuse to implement/ enforce R.A. No. 8981 despite notices/info campaign--- LGUs, Building Officials, DA, etc.;
