JUDICIAL AFFIDAVIT OF PAUL M. CRUZ I, PAUL M. CRUZ, of legal age, married, Filipino, with address at Tumaga, Zamboanga City, under oath, depose and state: I am a witness for Petitioner DEXTER L. FERMIN Case No. 0001 for Declaration of Nullity of Marriage based on Article 45 (6) of the Family Code, Dissolution Community Property Regime and with an Application for the Sole Custody of and Support for Sophie and Michael M. Fermin now pending before the RTC, Zamboanga City, Branch 3. The person examining me is Atty. Brenda B. Macapili in hes office at Pilar St., Zamboanga City. This Judicial Affidavit is prepared in English in which I am conversant enough. I am answering the questions asked of me fully conscious that I do so render oath and aware I may face criminal liability for false testimony or perjury.

OFFER OF TESTIMONY The testimony of Paul M. Cruz is being offered to prove that: 1. The petitioner is his friend whom he met during the “Public Safety Officers Basic

Course” in January 2014. 2. He is the second-degree cousin of the respondent 3. He will testify that the respondent has a questionable reputation even before her marriage to the petitioner. 4. He is a witness to the wedding of the petitioner and respondent held in San Agustin Church in Manila. He will identify Exhibit “B”. 5. He was told by his girlfriend, Isabel Santos that the respondent confessed to her that the latter was taking prescriptive drugs to hide her condition of having Genital Herpes. 6. He will also testify on other matters which are germane and relevant to his main testimony.

DIRECT TESTIMONY Q-1: Mister Witness, please state your name, age and other personal circumstances. A-1:

I am Paul M. Cruz, of legal age, single, residing in Tumaga, Zamboanga City.

Q-2: A-1:

Do you know a certain person by the name of Laura Medina-Fermin? Yes, she is my cousin who is married with my friend, Dexter L. Fermin, the petitioner.

Q-3: A-3:

You and the respondent are cousins by what degree? We are second-degree cousins.

Q-4:

As a cousin of the respondent, how well do you know her and her reputation?

A-4: I know her since we were small since we were neighbors in Manila back then. We were also schoolmates from elementary to college. Way back in college, she had a very questionable reputation. She was often seen in night clubs with different men and she was caught in numerous scandals involving married men way back then. Q-5: As to the petitioner, how well do you know him and his reputation? A-5: I know him since January 2014 when we met during training in Manila. He is oldfashioned and a very conservative person. When I was assigned here in Zamboanga City, our colleagues often label him as the “KJ (Kill Joy)” of the group for he does not go with us when we go on drinking spree or when we hung out after work. After working hours, he goes straight to his home. Q-6: Mr. Cruz, please state the name of your girlfriend and the information she disclosed to you. A-6: My girlfriend is Isabel Santos, she is my girlfriend for more than 8 years. She is a close friend of the cousin, the defendant for they were childhood friends. However, Isabel does not agree with the kind of lifestyle that my cousin had way back then. Isabel told me that the respondent confessed to her that she was taking prescriptive drugs to hide her Genital Herpes disease since she was in second year college. This confession was made to her only after the respondent’s marriage with the petitioner. Q-7: A-7:

When did Isabel disclosed this information to you? Only after I told her that Paul was diagnosed with Genital Herpes.
