The time is approximately 1242 hours. Speaking is Detective Timothy Hightower of the Louisville Metro Police Homicide Squad. This will be a taped statement in regards to case #08197. Today’s date is Tuesday, September the 9th, 2008. I am currently in the parking lot of PRP High School and in my vehicle. This will be a taped statement given by; first name of Charles, last name Mullennex. Um, Charles, if you would state your full name for the tape?

O.K. And Charles is a white male and how old are you, sir?

O.K. I’m taking this statement in reference to the events that occurred on Wednesday, August the 20th of 2008 that occurred during PRP football practice. If you would, Charles, please describe to me the events on that Wednesday, August the 20th of 2008, from the beginning of football practice to the end of football practice?

Mullennex

I didn’t get to football practice until they were already on the field and had stretched, because I had to make up a test in my uh, Calculus class. I got out to the field around… I got to the locker room while they were walking to the field, so by the time I got changed and everything, they had been done stretching and I joined the warm-ups. I joined like individual period with them.

Hightower

O.K.

Mullennex

And it had had been a normal practice, we got a water break after individuals like always, individuals offense line we just do a bunch of drills and then after the water break we come back, and we run uh, inside period with the Dline and then after our inside period, we get another water break and after the water break we went to team period, which is where we run

all of our plays. And that’s when nobody was getting to the huddle was, and uh Stinson was getting frustrated because he told us if wanted to get back to the huddle, we’d have to run so we ran. So I was back to the huddle, there was only me, the quarterback, and the center were in the huddle, and everybody else was walking back from water. So we said why not and we start running. Hightower

O.K. Now did you…

Mullennex

We’d just had a water break; correct, before we’d started running.

Hightower

Is that right? So how many water breaks were given individually or as a team?

Mullennex

3 water breaks.

Hightower

Was that individually or as a team?

Mullennex

Uh, that’s a team.

Hightower

A team. On Wednesday, August the 20th of 2008, how many water breaks did you take?

Mullennex

How many water breaks did I take?

Hightower

Yes.

Mullennex

3? After the last water break, what did practice consist of?

Mullennex

Running, conditioning.

Hightower

Conditioning?

Yes sir.

Hightower

And why was the team running?

Mullennex

Sprints. Conditioning and uh, we weren’t getting back to the huddles so we needed to kind of like a punishment, but really not really, we needed it anyways.

Hightower

So it’s conditioning and because y’all weren’t getting back to the huddle?

Mullennex

Yeah. People were slacking. He had told us all week we needed to step it up and start running more where we’re going, and people were slacking and walking from place to place, and you’re not supposed to walk on the football field. I agree with that.

Hightower

How many sprints did your group run?

Mullennex

How many sprints did we run? I don’t remember a number, I lost count. I got out after 9 because he’d take certain people out who if he saw ‘em working really, really hard.

Hightower

Okay so were you running as a group or?

Mullennex

We’d run ‘em off or a lineman—one group would run theirs and then everyone else would run theirs.

Hightower

O.K. So you and what group were you in?

Mullennex

Lineman is mine. Yes sir.

Hightower

And you said how many sprints did your lineman run?

Mullennex

They—they ran the whole time.

Hightower

O.K.

Mullennex

We ran until it was opened.

Hightower

You know how many? You don’t remember how many?

Mullennex

I have no clue. Not… I don’t think anyone remembers how many exactly.

Hightower

O.K.

Mullennex

I’ve never heard the total number before.

Hightower

How many sprints did you run before you took off your gear?

Mullennex

Before we took off our gear, I think we ran 6, and then we took our helmets off, and then 2 more and then we took our shoulder pads off, I believe.

Hightower

O.K. So you did 6 and then you took off your helmet, then you did 2 more?

Mullennex

Yes sir, I think so.

Hightower

And then you took off your shoulder pads and how many did you do then?

Mullennex

Uh, that’s when we lost count. After that I think we maybe 4 more, maybe. I don’t know.

Hightower

How long do you think the team was running the sprints?

Mullennex

15—20 minutes… maybe 25 but I don’t… I don’t think that long.

Hightower

Did you or any of your teammates ask for water breaks…?

Mullennex

No.

Hightower

When running sprints?

Mullennex

No sir, which is smart to ask for water breaks.

Hightower

Did anybody try to get any water?

Mullennex

No sir.

Hightower

Did you or any of the teammates become ill while running the sprints?

Mullennex

I didn’t. After I got out I was over under the tree so I didn’t see anyone.

Hightower

O.K.

Mullennex

Except for Galloway and Max apparently.

Hightower

O.K. Did you see Galloway get ill?

Mullennex

I saw him coming off of the field.

Hightower

Okay, you saw him coming off the field?

Mullennex

Breathing heavily.

Hightower

Breathing heavily? O.K. Where did he go after…?

Mullennex

To the bench and they put ice on him and brought water to him.

Brought water to him?

Mullennex

Yes sir.

Hightower

Now what about Max, you said Max? What happened with Max?

Mullennex

Max, I didn’t see Max until after the running was totally over, and then I saw him and he was on two people like he had a arm over each person’s shoulder, and they’re helping him walk, and then he just fell and I ran over to him and tried to help him get up and then Stinson and all the coaches came over and took it— took over. They told us to go and stand with the rest of the team.

Hightower

O.K. So you were over under the tree?

Mullennex

Yes sir.

Hightower

You had already finished from what you’re saying; then you saw, saw Max come off the field?

Mullennex

Yes sir.

Hightower

Now did you see him come off the field on his own or was he…?

Mullennex

He had people helping him.

Hightower

Okay so when you saw him he had two people...?

Mullennex

Whenever I first saw Max after the running, he already had people helping him.

Hightower

O.K. So you saw he had two uh, other teammates helping him?

Mullennex

Yes sir.

Hightower

And where did they bring him to?

Mullennex

They were taking him off of the field and he didn’t make it off the field like they couldn’t hold him anymore, so they laid him down.

Hightower

O.K.

Mullennex

And then I went over to try to help them pick him up.

Hightower

O.K.

Mullennex

And Stinson told us to get away because you’re not really suppose to touch people when they’re like that. You don’t know what could happen especially 16 year olds, too, and you don’t have any medical experience.

Hightower

O.K. So that’s it okay.

Mullennex

And then we went and got him, we made sure he got water and ice.

Hightower

Water and ice, okay sir. So Galloway is one that got ill during the running or was it after?

Mullennex

It was during.

Hightower

During?

Mullennex

Yes. He got off because he was running harder than we’ve ever seen him run before. So he got off and while he was he off, he was

breathing heavely and that’s why he went to the hospital I guess. But they, I saw… I was sought when he was getting water after the running was over. Hightower

Um…

Mullennex

I was next to him while they were taking him to the water and making sure he was getting some. He was saying that he was fine.

Hightower

O.K. And Max, he also uh… it happened during the sprints that he got?

Mullennex

I don’t know because like I said I was—I was over under the tree…

Hightower

O.K.

Mullennex

… with a few others that had been told to sit out because we were running harder, and he said or like they were done with the sprints and they were all walking back, and then that’s when I saw Max.

Hightower

O.K.

Mullennex

When they were walking back.

Hightower

So you’re not sure when he… uh, when Max (inaudible)?

Mullennex

I’m not sure when.

Hightower

O.K.

Mullennex

Because I wasn’t next to him.

Hightower

O.K.

Because we take up the whole side line so we run till this whole broad area, where people could be.

Hightower

And what are gasers?

Mullennex

Gasers?

Hightower

Gasers.

Mullennex

Gaseres are say this is the long way of the field; this is the short way of the field. We’ll lineup on the sidelines and then run to the short side of the field, the short width of the field, they’re back in their bank.

Hightower

O.K. What is one gasers?

Mullennex

Till they’re back there and back is one gasers.

Hightower

So that’s what… how many times is that?

Mullennex

Uh, 4… 4 time total for one.

Hightower

4, okay, 4 times total of one for gaser on that.

Mullennex

Around 200 yards I believe.

Hightower

During any practice this year, have you personally seen or heard any teammate being injured?

Mullennex

Other than that practice?

Hightower

Yes, any practice this year.

Mullennex

No sir.

What about anybody quitting the team?

Mullennex

Yes sir.

Hightower

Okay, who that you know quit the team?

Mullennex

On that day, David Engler quit the team but he came back the next Monday. And last year someone quit but he came back on, but I don’t… I’m trying to think, I don’t know when he quit other than people who just don’t show up because they’re slackers. Like Freshman who aren’t capable, I think, just quit the team.

Hightower

O.K. So David is one that you know and you said any other body that you know by their name that quit?

Mullennex

No sir. But he came right back. Yeah, I knew he would come back. He’s like that… he’s— he’s done it before.

Hightower

So he came back?

Mullennex

Yes sir. He’s back on the team.

Hightower

O.K. Has anyone influenced you in any way to withhold information or change any of the facts that actually occurred during that practice on Wednesday?

Mullennex

No sir, no sir.

Hightower
