RELEASE OF BANK GUARANTEE W.P. No. 5322/97 Pakistan Tobacco Company Vs. Zila Council, Multan. Rs. 42.00 Lac.

In continuation of letter No. 74/TO dated 25.1.2001, it is stated that the above titled writ petition was filed by the Pakistan Tobacco Company in the Hon’ble High Court Multan Bench in the year 1997. In that writ petition, the Hon’ble High Court had ordered the writ petition to submit Bank Guarantee. In the compliance of these orders, the writ petitioner furnished his Bank Guarantee of your Bank. The Hon’ble High Court, vide its order dated 26.1.2000 has dismissed the above mentioned writ petition. The Pakistan Tobacco Company has neither appealed nor taken any kind of steps to set aside the order of the Hon’ble High Court dated 27.1.2000. Now the above titled writ petition is not pending in the Hon’ble High Court for adjudication. Therefore, the Hon’ble High Court has not granted any kind of stay order against the release of the bank guarantee and there is no bar in this regard. It is, therefore, requested that the Bank Guarantee amounting to Rs. 42.00 Lac may be released and cheque/draft be handed over to Mr. Syed Muhammad Afaq Shah Advocate who is deputed for the said purpose.
