LEGALLY REQUIRED BENEFITS IN CONTEXT OF PAKISTAN  INDUSTRIAL AND COMMERCIAL EMPLOYMENT (STANDING ORDERS) ORDINANCE 1968  EMPLOYEE SOCIAL SECURITY ORDINANCE  THE EMPLOYEE OLD AGE BENEFITS ACT 1976  THE PAYMENT OF WAGES ACT 1936  THE WORKMEN’S COMPENSATION ACT 1923  FACTORIES ACT 1934

SOME REQUIREMENT BY LAW  Terms and conditions of service to be given in writing. e.g. contract period, probation period, salary structure etc.  Publication of working time, holidays and pay days. working time: notice giving the period and hours of work for all classes of workman each shift should be displayed on notice board.

Holidays And Leaves with Pay 14 days annual holiday ( consecutive) after one year of continuous service. carry forward 14 days leave Encashment of un-availed leaves is possible at quitting job. Festival holidays declared by Government. e.g. Eid holidays 10 casual leaves 16 sick leaves Other holidays in accordance with law, contract, custom and usage.

WORKING HOURS

PAYMENT OF WAGES

Payment of wages on a working day before the expiry of the 7th day after the last day of wage period. Unclaimed Wages pay day. After the termination of employment of the person, the wages earned shall be paid before the expiry of the second working day on which his employment is terminated. No wage period can exceed 1 month

 Payment of 10-c Bonus e.g. Giving 1 month salary at year end if organization is making profit

Cont..  For permanent workman, one month notice is required before termination of employment. (other than misconduct)  Probation workers or contractual workers do not require any notice.  Gratuity is not required when provident fund is there. Gratuity= (One month salary)×(No. of years of service)

BENEFITS

 Sickness benefits 365 days in case of TB or Cancer. 121 days in case of any other disease.  Maternity leaves allowed to women for a period of 12 weeks with full pay

 Death grant In case of death of secured person entitled for injury, sickness or medical care benefit. Ideal Benefits

Old Age Benefits An employer is required to submit his and employee’s contribution to a bank designated by EOBI before 15th of every month. An employer has to pay contribution equal to 5% of the minimum wage while an employee has to pay that contribution at the rate of 1% of minimum wage.
