(1) – DUTIES (Method) OF THE ISLAMIC GROUP(ITS).

“Let there rise from among you a group calling society to the goodness (Islam), commanding(society) to do what is right and forbidding(society) what is evil, and those are the ones who are successful” [EMQ 3:104] (All English translations give: "To enjoin good and forbid evil", or minor variations to that effect. Let us first remind ourselves that this phrase occurs at least 28 times in the Qur’an, in various forms, which indicates its importance.) . The Divine duties upon Group(s)derived from the verse 3:104 are:1- Da'wah to Al-Khair (i.e Calling society to Islam.) 2- Al-Amr Bil-Ma'rouf (i.e.Commanding Good) and An-Nahier An Al-Munkar (i.e. Forbidding Evil [of Society]). The Method(s) Of Each Duty. First: The Divine Method for Da'wah to Socitey which is Fard as a thought derived from the Verse

”Invite (mankind, O Muhammad SAW) to the Way of your Lord (i.e. Islâm) with wisdom (i.e. with the Divine Inspiration and the Qur'ân) and fair preaching, and argue with them in a way that is better. Truly, your Lord knows best who has gone astray from His Path, and He is the Best Aware of those who are guided.” [16:125] with three points: A. Bil-Hikmah: Carrying Da'wah and addressing the thoughts by Hikmah i.e. Fiqh and Evidences B. Al-Mawo'izzah: Breaching people and touch their emotions by relating the matter to Allah and The Hereafter. C. Al-Jidaal Al-Mamdouh: Debating people and challenge all their thoughts and traditions. Second: The divine Method to command good and forbid evil in society derived from the Verses

BissmiAllah Ar-Rahmaan Ar-Raheem 1. Woe to every slanderer and backbiter.2. Who has gathered wealth and counted it, 3. He thinks that his wealth will make him last forever! 4. Nay! Verily, he will be thrown into the crushing Fire. 5. And what will make you know what the crushing Fire is? 6. The fire of Allâh, kindled, 7. Which leaps up over the hearts, 8. Verily, it shall be closed in on them, 9. In pillars stretched forth (i.e. they will be punished in the Fire with pillars, etc.). 104. Al-Humazah (1-9)

BissmiAllah Ar-Rahmaan Ar-Raheem 1. Have you seen him who denies the Recompense? 2. That is he who repulses the orphan

(harshly),3. And urges not the feeding of AlMiskîn (the poor),4. So woe unto those performers of Salât (prayers) (hypocrites), 5. Who delay their Salât (prayer) from their stated fixed times, 6. Those who do good deeds only to be seen (of men), 7. And refuse Al-Mâ'ûn (small kindnesses e.g. salt, sugar, water, etc.). (107. Al-Mâ'ûn 1-7)

BissmiAllah Ar-Rahmaan Ar-Raheem 1. Perish the two hands of Abû Lahab (an uncle of the Prophet), and perish he! 2. His wealth and his children (etc.) will not benefit him! 3. He will be burnt in a Fire of blazing flames! 4. And his wife too, who carries wood (thorns of Sadan which she used to put on the way of the Prophet (Peace be upon him) , or use to slander him)[] . 5. In her neck is a twisted rope of Masad (palm fibre). (111. Al-Masad 1-5)

BissmiAllah Ar-Rahmaan Ar-Raheem 8. So (O Muhammad SAW) obey not the deniers [(of Islâmic Monotheism those who belie the Verses of Allâh), the Oneness of Allâh, and the Messenger of Allâh (Muhammad SAW), etc.9. They wish that you should compromise (in Deen out of courtesy) with them, so they (too) would compromise with you. 10. And obey not everyone who swears much, and is considered worthless, 11. A slanderer, going about with calumnies, 12. Hinderer of the good, transgressor, sinful, 13. Cruel, after all that BASTARD (of illegitimate birth), 14. (He was so) because he had wealth and children. 15. When Our Verses (of the Qur'ân) are recited to him, he says: "Tales of the men of old!" 16. We shall brand him over the nose! 68.Al-Qalam 8-16 and the Ahadeeth for forbidding Evil by BUKHARI, MUSLIM AND AHMAD with three points: Hudhaifah (May Allah bepleased with him) reported: The Prophet (PBUH) said, "By Him in Whose Hand

my life is, you either enjoin good and forbid evil, or Allah will certainly soon send His punishment to you. Then you will make supplication and it will not be accepted".[At-Tirmidhi]. Ahmad has narrated about Adas Ibn Umayra, who said ; 'I heard the Prophet (saw) say : Allah will not torture the public because of the bad deeds of a particular people till the public see the Munkr amongst themselves and they are able to deny it but they don't deny it. If they do this, then Allah (swt) will torture the particular people who have been doing wrong and the public as well'.

Al Hakim has reported in the Hadith narrated by Jabir that the Prophet (saw) said ; 'The master of the martyrs is Hamza, and whoever is killed speaking truth in the court of a tyrant ruler'. Abu Dawood has narrated about Abdullah Ibn Masoud who reported that the Prophet (saw) said; 'The first time deficiency entered the sons of Israel was when a man of them used to meet another man and say to him: Observe your duty to Allah, and leave what you do, because it is not allowed for you to do so. Then the next day he will meet him and yet he is not restrained to eat, drink and sit with him, and when they have done so Allah struck the hearts of some of them against the hearts of others'. Then the Prophet (saw) read the four verses; 'Those of the children of Israel who went astray were cursed by the tongue of David, and of Jesus son of Mary. That was because they rebelled and used to transgress." A. Al-Tandeed - by Using a strong and harsh words against the evil of society. B. At-Ta-TTeer - by exposing the Evil of society from all directions e.g. politics, Economics, Social and Foreign Policy etc.. C. Al-Akhezz A'la Al-Yadd - Forbidding forcibly or fiercely.. All the above as Ta-assie i.e. following the Messenger Muhammad(saw) the way he call society of Makkah and the way he command good and forbid Evil for the society of Makkah. NB: The Above has nothing to do with the method to call individual non-Muslim to Islam, Nor by the method to command good and forbid evil for individual Muslim or non-Muslim. The Styles and Means used for each Duty. “Styles and Means” are from the permitted (Mub’ah), and are used as a platform or gateway through which the duties can be undertaken according to their respective methods. First: The Style and Means used for Da'wah to Socitey:Through debates, seminars, study circles and conferences etc… Second: The Styles and Means to command good and forbid evil in Society:The Style of the call must be radical, open, direct, clear, and offensive, without ambiguity or compromise, without reservation or relaxation. The Means have to be public due to the societal nature of the duty, executed through markets, parks, streets, colleges, universities, mosques, community centres and libraries etc…

(2) - THE METHOD TO TAKE AUTHORITY. (Seize Power) Originally, it is a Fard Kifaayah (upon Muslims wherever they are) to take the authority in order to implement Islam. However, now it is a fard Kifaayah Muhattam upon Muslims. NB: Taking authority to implement Islam is Fard upon Muslims. This Fard is a thought (Fikrah) needy for a divine method (Tariqah) The divine Method to take authority is by seeking Nussrah. [17:80]

“And say, ‘My lord, lead me in with the truth and lead me out with the truth, and grant me the authority with support to help me.”Surah Al Israa 17: 80

NB: Seeking Nussrah to take authority in order to implement Islam is a divine method with the same Hukm of taking authority. However, the Hukm of seeking Nussrah is Fard Muhkam and Qatt'ie i.e decisive without abrogation. There are two reasons that Nussrah is sought for:1. To protect the Da’wah. 2. To seize power and establish Shari’ah. The Nussrah discussed here is that of seizing power. Ayah [17:80] was revealed in the 10th year after the Muhammad (saw) was appointed as Messenger. Ibn Hisham reports that until this ayah was revealed, the Messenger of Allah (saw) did not approach the tribes for the purpose of seeking Nussrah to establish the Islamic State. Juristic Definition, Nussrah:- To persuade people of power to give Authority to Muslims enabling them to implement Islam. Regarding assessing the amount of material power required to establish the State. It is sufficient to have enough power to implement Islam internally, and protect the State 80km externally. This is due to the fact that one is only accountable where he resides, if one were to proceed beyond 80km he would be considered a traveler (Mu’safir) and would be considered a resident if he was within the 80km. Nussrah has to be:1. Unconditional. 2. Sought from Muslims only. Evidences of Seeking Nussrah:

“And say, ‘My lord, lead me in with the truth and lead me out with the truth, and grant me the authority with support to help me.”Surah Al Israa 17: 80

And remember when you were few in number and were regarded weak in the land, and were fearful should the people seize you, but he gave you refuge and strengthened you with his help. (.Surah Al Anfaal 8: 26)

And if they intend to deceive you, then surely Allah is sufficient for you. Allah is the one who has strengthened you with his victory, and with the believers.(Surah Al Anfaal 8: 62)

And those who believe, and have emigrated and have striven in the cause of Allah and those who gave refuge to the emigrants and helped them, those are the true believers, for them there is forgiveness and a most generous provision( Surah Al Anfaal 8: 74)

If you do not help the messenger, Allah has already helped him, when the unbelievers expelled him, he and another, when the two of them were in the cave, he said to his companions “be not distressed, indeed Allah is with us”, and Allah sent down on him his serenity and strengthened him with unseen forces, and abassed the word of the unbelievers, and the word of Allah is supreme, Allah is almighty, all wise. Surah Al Tauba 9: 40

And the first to embrace Islâm of the Muhâjirûn (those who migrated from Makkah to Al-Madinah) and the Ansâr (the citizens of Al-Madinah who helped and gave aid to the Muhâjirûn) and also those who followed them exactly (in Faith). Allâh is well-pleased with them as they are well-pleased with Him. He has prepared for them Gardens under which rivers flow (Paradise), to dwell therein forever. That is the supreme success. (Surah Al Tauba 9: 100)

Allâh has forgiven the Prophet (SAW), the Muhajirûn (Muslim emigrants who left their homes and came to Al-Madinah) and the Ansar (Muslims of Al-Madinah) who followed him (Muhammad SAW) in the time of distress (Tabûk expedition, etc.), after the hearts of a party of them had nearly deviated (from the Right Path), but He accepted their repentance. Certainly, He is unto them full of Kindness, Most Merciful., (Surah Al Tauba 9:117) Hadith – Muttawatir in Meaning. 1. Banu Thaqeef 2. Banu Waa-ill 3. Banu Kindah 4. Banu Sa’ssa’ah 5. Tribe of Hamdaan 6. Tribe of Daus 7. Tribes of Aous & Khasraj 8. Hadith regarding the Bayah of Nussrah Also the Nussrah can only be sought by a group based upon the three evidences: 1) Principal: If the thought is collective than the method must be collective 2) From the life of Prophet(saw), where it was only duty on him to take authority, even than he did it as a collective body which is mentioned in the hadith: “Give authority to me and my companions” 3) Using the Rational principal “Whatever leads to wajib is intelf a wajib” The Nussrah has to be requested by a group as indivdually it will not be rationally possible to take the authority or be given the authority. 4) The Nussrah is a Ma’rouf in the Ayah [3:104]. Hence it is the duty solely of the group. N.B: The seeking of Nussrah is Qati,(based on decisive text and decisive meaning) but the group to seek it is still Ijtihad, as it is not based upon indecisive evidences. Styles and means used to facilitate Nussrah. This is through rebelling against the regime and its systems via demonstrations, marches, strikes, rallies and civil disobedience… In order to instigate instability, which will create a political, economic or even military – vacuums, so that authority can be established which will fill the vacuum and restore stability, law and order.

(3) - THE METHOD TO IMPLEMENT SHARI’AH. (Establish Khilafah) Originally, it is a Fard Kifaayah (upon Muslims wherever they are) to implement the Shari'ah i.e. to establish the Khilafah. However, now it is a fard Kifaayah Muhattam upon Muslims wherever they are. NB: to implement the Shari'ah is Fard upon Muslims. This Fard is a thought (Fikrah) needy for a divine method (Tariqah) The method to implement the Shari’ah. The divine Method to implement the Shari'ah i.e. to establish the Islamic State is an Ijtihad matter. The method is composed following duties:

A- Da'wah: Calling Society to Islam (i.e. Culturing Socitey). Also referred to as “Intellectual Struggle” or the “Starting Point”. B- Public Profile: Commanding good and forbidding Evil of Society (Adpoting the interests of people and Expose Manmade Law). Also referred to as the “Launching Point” and “Interaction Stage” where public opinion for Islam is created, engaging in this directly at the ruling system especially the ruler himself is referred to as “Political Struggle” and also to create a profile for the group to assist the Nussrah. C- Implementation of Shari'ah: (by Bay'ah to a Khalifah to implement Islam). Also referred to as the “Support Point”. Implementation requires Authority and this equates to Nussrah. Nussrah has to be sought to take Authority NB: In order to be able to implement Islam we must take the authority (using the principal: Introduction to the wajib is inteslf a wajib) as a divine prerequisite for the implementation of Islam.

Explanation of the Method to Establish the Khilafah The relationship between the hukm to take authority and the hukm to implement the Shari’ah The implementation of Shari'ah it cannot be fulfil without taking an Authority (i.e. Sultaan). Therefore Nussrah is a Divine prerequisite because it is an introduction to the Wajib i.e. the implementation of the Shari'ah for the General principle: (The Introduction to the Obligatory is Obligatory)... NB2: It is incorrect (on the above example) to use the other principle i.e. [Whatever leads to Wajib is Wajib] as a link between Nussrah and the Method to establish the Islamic State because the second principle is a Rational Prerequisite can be used in different place. For example: Salat is Fard but its (Introduction)i.e. Divine Prerequisite is Wadu... Whereas from where to get pure water for Wadu from river or sea is a Rational Prerequisite for the principle: What leads to wajib is Wajib.... Political term to explain the above concept: Taking Authority Structural term to explain the above concept: Support point Juristic term to explain the above concept: Seeking Nussrah. The relationship between the hukm to take authority and the Need to create Public profile as part of the method to establish the Shari’ah From the reality when one undertakes to seek Nusraah it will require the assistance of the masses to rebel against the existing system in order to create a vacuum to facilitate the Nussrah. Thus using the principal (What ever lead to the wajib is in itsef a wajib). It would require to create a public profile for the call and the caller. Which will assist the taking over the authority, i.e. Nussraah. More details on the leaflet of creating Public profile. The relationship between the Need to create Public Profile and the Need to Culture Society as part of the method to establish the Shari’ah

Now when one undertakes to create a profile for the call and the caller, it would require the assistance of the masses to undertsand the call inorder to carry it and to rebel against the existing system. Hence using the principal (What ever lead to the wajib is in itself a wajib) would require the group to culture the masses (society) about Islam as a belief and political system. Political term to explain the above concept: Cututing Society Structural term to explain the above concept: Starting Point Juristic term to explain the above concept: Calling Society to Islam. The relationship between the Culturing Society and to rise a group as part of the method to implement the Shari’ah The Culturing Society (to assist the Public profile which will assist the Nussrah) requires a divine pre-requiste (Introdcution to the wajib is inteslf a wajib) based upon the Ayah where Allah says: “Let there rise from among you a group calling society to the goodness (Islam), commanding(society) to do what is right and forbidding(society) what is evil, and those are the ones who are successful” [EMQ 3:104]

Thus we see that the duties of the group based uopn the above ayah, the method to take authority are interlinked in the method to eastblish the Khilafah. This is the Ijtihad of Shiekh Taqi and explained by Shiekh Omar.

Points to remember: 1) if the thought is fard than the method takes the same rule 2) The thought and the method must share the same value (thought=ibadat method =ibadat, thought=muamalaat method=muamalaat) If the thought is about a certain tangible value the method must have the same tangible value. 3) If the thought is collective than the method must be collective. 4) Divine Pre-requisite (textual in composition and textual in application): Introduction to the wajib is in itself a wajib, also referred to as Shart. 5) Rational Pre-requisite (rational in application, but textual in composition): What ever lead to the wajib is in itself a wajib.
