COMPLAINT Plaintiff, Fuente Marketing Ltd . ("Fuente"), by its undersigned attorneys, for their complaint against Defendants Garo Habano, Inc ., Garo Habano Fine Cigars

and Garo Bouldoukian (jointly referred to as "Defendants"), allege as follows : NATURE OF THE ACTION AND RELIEF SOUGHT 1 . This is a civil action for trademark infringement in violation of the

trademark laws of the United States, 15 U .S.C . §§ 1114-1117 ; for trademark dilution in violation of Section 43(c) of the Lanham Act, 15 U .S .C. § 1125 (c) ; unfair competition, in violation of Section 43(a) of the Lanham Act, 15 U .S .C. § 1125 (a) ; for violation of the Georgia Dilution Statute, Ga . Code Ann. § 1 0-1-451 ;

for violation of the Georgia Uniform Deceptive Trade Practices Act, Ga . Code Ann . § 10-1-372 et. seq. ; and for unfair competition, deceptive trade practices, and trademark infringement under the common law of the State of Georgia . 2 . Fuente seeks injunctive relief and damages from Defendants' improper and unlawful acts and attorneys' fees and expenses as a result of those willful and intentional acts . THE PART IES 3 . Fuente Marketing Ltd . is a corporation organized and existing under the laws of the British Virgin I slands, with its only place of business located in Road Town, Tortola, British Virgin Islands . 4 . Defendant Garo Habano, Inc. is a California corporation having a place of business at 3200 La Crescents Avenue, Suite A, Glendale, CA 91208, and is conducting business in this district.

5 . The registered agent and so l e officer and/or director of Defendant Garo Habano, Inc . is Mr . Garo Bouldoukian, who lists his address as that of the company at 3200 La Crescents Avenue, Suite A, Glendale, CA 91208 . 6.

Defendant Garo Habano Fine Cigars is a cigar company that offers for

sale and sells cigars via the Internet and by te l ephone and email order, and as such is conducting business in this district . 2

7 . Upon information and belief, Defendant Garo Bouldoukian does business as Garo Habano Fine Cigars . 8.

Upon information and belief, Defendant Garo Bouldoukian is the

owner, sole officer and/or director of Defendants Garo Habano, Inc . and Garo Habano Fine Cigars . As such, Defendant Garo Bouldoukian principally controls and directs the actions of both companies and is personally liable for their tortuous conduct . 9 . Upon information and belief, Defendants Garo Habano, Inc ., Garo Habano Fine Cigars and Garo Bouldoukian operate together to carry out the acts described herein . 10. Defendants conduct business in this district at least by offering for sale and selling cigars in this district.

JURISDICTION 11 .

This Court has original jurisdiction over the subject matter of this

action pursuant to 15 U .S.C. § 1121 and 28 U .S .C. §§ 1331 and 1338, and has supplemental jurisdiction pursuant to 28 U .S .C. § 1367(a) .

12. This Court has personal jurisdiction over Defendants at least because Defendants transact business, solicit sales, and/or sell infringing goods in this district . 3

13 . Venue is proper in this district pursuant to 28 U .S .C. § 1391 .

14 . Fuente Cigar Ltd ., the manufacturer of cigars sold by Fuente Marketing Ltd . in the United States, is one of the largest family-owned and familyrun premium hand-rolled cigar companies in the world . The Fuente family, like many other cigar families, originated in Cuba, but then settled in Tampa, Florida and started selling cigars in the United States in 1912 . Faced with adversity and fires, the company had times of prosperity and struggle, and emerged in the mid1900s as the present day cigar company . Four generations of the Fuente family have labored to produce the finest cigars and to make the company internationally renowned for its cigars . 15 . Since the mid-1900s, the Fuente family has continuously produced and sold throughout the United States high-quality cigars in association with various trademarks to identify the source of its high-quality cigars . In recent years, Fuente's products have enjoyed unprecedented popularity . Independent surveys show that Fuente's brands are both the best-selling and the most sought after cigars in the American market.

16 . Fuente is the owner of many federally registered and common law trademarks for cigars and cigar related products . Among others, Fuente is the owner of numerous trademarks incorporating the mark "OPUS" in association with cigars. Fuente is the owner of the following registrations and applications all of which feature the mark OPUS : a. U.S . Trademark Registration No . 1,989,060 for the mark FUENTE FUENTE OPUS X in International Class 34, b . U.S . Registration 2,495,579 for the mark FUENTE OPUSX in International Class 34 c. U.S . Trademark Registration No . 2,256,200 for the mark FUENTE FUENTE OPUSX Design in International Class 34, d . U.S . Registration 2,364,801 for the mark FUENTE FUENTE OPUSX Design in International Class 34, and e. U.S . Application Serial No . 77/404,800 for the mark FUENTE FUENTE OPUS X Design (Color) in International Class 34 . The above-referenced marks shall individually and collectively be referred to as "the OPUS Marks" . Copies of each of these U .S . Trademark Registrations and Application are attached hereto as Exhibit A . 17 . The above registrations are valid and subsisting, and Registration Nos . 1,989,060, 2,495,579, 2,256,200 and 2,364,801 are incontestable . 18.

Fuente's cigars, including FUENTE FUENTE OPUS X cigars are

among the most important, recognizable and high profile products in the cigar industry. The FUENTE FUENTE OPUS X trademark and each of the associated

OPUS Marks, are some of the most widely known and famous trademarks in the cigar industry . 19. Fuente worked for years to develop the FUENTE FUENTE OPUS X cigar . During the lengthy development of the FUENTE FUENTE OPUS X cigar in the late 1980s and early 1990s, Fuente's top-priority, high-profile development effort was the subject of much publicity and became well known throughout the cigar industry . 20 . The tobacco for the first crop of FUENTE FUENTE OPUS X cigars was harvested in 1992. Once sufficient amounts of premium Dominican tobacco had been grown, harvested, cured and aged the Fuente family hand-picked 30 of Fuente's 900-plus cigar rollers to ensure that FUENTE FUENTE OPUS X cigars would be hand-made by Fuente's most skilled and highly-trained artisans . 21 . The end result of years of Fuente's efforts and multi-million dollar investment is a cigar brand that is extraordinarily sought after among cigar aficionados . The FUENTE FUENTE OPUS X cigar, which was introduced to market in 1 995, was described by Forties magazine as "a 100% Dominican cigar that Castro himself would envy ." It has been consistently ranked in the 90's (on a scale of up to 100) by Cigar Insider and Cigar Aficionado, two prominent cigar publications, and has received the highest rating of any Dominican cigar ever 6

made. In 2005, the FUENTE FUENTE OPUS X cigar was named "The Best Cigar of the Year" by Cigar Aficionado and in 2007 it was ranked second best . As a result, the FUENTE FUENTE OPUS X cigar and associated trademarks have become some of the most famous in the cigar industry . 22 . Fuente is the owner of all rights in the OPUS Marks, and is the exclusive owner of each of the federal registrations and applications therefore . See Exhibit A . 23 . The OPUS Marks are widely recognized as indicating premium handrolled cigars made by Fuente and cigar related products originating from or approved by Fuente . 24. Fuente's cigars bearing the OPUS Marks are marketed and sold, and have been continuously marketed and sold, in interstate commerce throughout the United States since at least as early as 1995 . 25. Fuente's cigars bearing the OPUS Marks have been widely offered for sale and sold throughout the U .S . in cigar stores (often called smoke-shops) and via the Internet . 26 . Fuente's cigars and cigar related products bearing the OPUS Marks have been and are sold to cigar smokers throughout in the U .S .

27 . Demand for Fuente's cigars bearing the OPUS Marks far exceeds supply, which is only approximately 600,000 to 700,000 cigars per year . Due to limited supply, Fuente suggests that retailers limit the sale of FUENTE FUENTE OPUS X cigars to two cigars per customer . Because of the popularity of the cigar, it is not uncommon for FUENTE FUENTE OPUS X cigars to sell for much more than the suggested retail price. 28 . Millions of Fuente's cigars bearing the OPUS Marks have been sold in the U .S . since the mid-1990s . 29 . Many millions of dollars worth of cigars bearing the OPUS Marks have been sold in the U .S . since 1995 . 30 . Fuente's cigars and cigar related products bearing the OPUS Marks have been regularly and extensively promoted throughout the U .S . 31 . Over five million dollars have been spent advertising and promoting Fuente's cigars sold in association with the OPUS Marks in the United States since

1 995 . 32. Fuente's cigars bearing the OPUS Marks have been widely advertised and promoted in the U .S . in many forms of media including radio, DVDs, documentary films, all forms of printed publications and the Internet on behalf of Fuente and by many others through unsolicited media coverage . 8

33 . Fuente's cigars bearing the OPUS Marks have been the subject of extensive unsolicited media coverage, including in leading articles in Tobacconist Magazine and Cigar Aficionado, as well as in such general publications as Forties Magazine, The Wall Street Journal, The Robb Report, Black Enterprise, Maxim, The Washington Post, Playboy, Selecta, Wine Spectator, Esquire, American Way

and many other national and local publications . 34. Fuente and its cigars sold in association with the OPUS Marks have become so famous and well-known, even outside of the cigar industry, that they have been the subject of, and the answer to, both a New York Times Sunday crossword puzz le clue and a Jeopardy television game show question . 35 . Fuente's FUENTE FUENTE OPUS X marks and cigars have become so popular and well-known that many in the industry simply refer to the cigars and marks as "OPUS" or "OPUS X ." Examples of references to Fuente's FUENTE FUENTE OPUS X cigars simply as "OPUS" or "OPUS X" are attached as Exhibit B. 36. The shortened nicknames, OPUS and OPUS X, for the famous mark and cigar FUENTE FUENTE OPUS X are recognized by those in the cigar industry as identifying Fuente and its famous FUENTE FUENTE OPUS X cigars .

37 . Fuente's cigars bearing the OPUS Marks have also received extensive attention on the Internet, including interactive discussions on Cigar Aficionado's World Wide Web page. 38 . Fuente's cigars and cigar related products bearing the OPUS Marks have been promoted through cigar industry-wide trade shows and events such as "Big Smokes" . "Big Smokes" are held 6-8 times a year and attract thousands of cigar aficionados and consumers. In addition, because Fuente's cigars bearing the OPUS Marks are so famous and in such high demand, Fuente's cigars bearing the OPUS Marks are the subject of numerous charity events and auctions across the U.S. 39. By reason of the advertisement and promotionn of Fuente's cigars bearing the OPUS Marks, unsolicited media coverage, customer word-of-mouth,

and sales of the cigars, Fuente's OPUS Marks, - since long before Defendants' acts complained of herein - have become some of the most famous and distinctive marks in the cigar industry, and are recognized and relied upon by the trade and the public as identifying Fuente and Fuente's products and as distinguishing them from others and the goods of others . 40 . By reason of the advertisement and . promotion of Fuente's cigars bearing the OPUS Marks, unsolicited media coverage, customer word-of-mouth,

and sales of cigars in association with the OPUS Marks, the purchasing public and the cigar industry recognize that the common characteristic OPUS is indicative of the common origin of Fuente's cigars and cigar related products. 41 . Fuente holds the only United States trademark registrations containing the mark OPUS for cigars or cigars related goods in International Class 34 . 42. Upon information and belief, aside from Defendants, Fuente is the only one that uses the mark OPUS in association with cigars in the United States . 43 . Because Fuente's United States trademark registrations are the only registrations containing the mark OPUS for cigars or other goods in Class 34 , and because Fuente is the only one legitimately using an OPUS mark in association with cigars, Fuente is entitled to a broad scope of protection for its OPUS Marks . 44 . As result of the unsolicited media coverage, customer word-of-mouth, sales, and the advertisement and promotion of its OPUS Marks, Fuente has established tremendous goodwill, selling power and fame in and to its OPUS Marks . 45 . In recent years, the cigar industry has experienced a "mini-boom" as large numbers of young adults have become interested in cigars . These young adults, who are primarily new to the cigar industry, often gather information about cigars and purchase cigars via the Internet . Because these young adults are new to 11

the cigar industry and rely largely on the Internet for information and purchasing cigars, rather than purchasing from traditional cigar stores or smoke-shops with experienced proprietors, they are particularly susceptible to confusion as to the source of cigars, especially when cigars are released bearing marks thatt are similar to well established, popular brands . B.

Defendants' Actions

46. Defendants are offering for sale and selling cigars in association with an OPUS mark. Photographs of Defendants' cigars sold in association with the mark OPUS are shown in Exhibit C . 47 . Defendants' cigars sold in association with the mark OPUS have been offered for sale and sold throughout in the United States in cigar stores and via the Internet . Copies of Defendants' advertisements and offers for sale showing cigars in association with the mark OPUS are shown in Exhibit D . 48. Defendants' cigars sold in association with the OPUS mark have been and are sold to cigar smokers throughout the United States . 49 . Upon information and belief, Defendants had actual knowledge of Fuente and its OPUS Marks and the widespread use of Fuente's OPUS Marks prior to their adoption and use of Defendants' OPUS mark for cigars .

50 . Defendants' OPUS mark is similar to Fuente's OPUS Marks and both are used in association with cigars . 51 . Upon information and belief, Defendants' OPUS mark was intentionally adopted and is being used to trade-off Fuente's selling power, goodwill and recognition . 52 . By virtue of the federal trademark registrations for Fuente's OPUS Marks, Fuente put the public, including the Defendants, on notice of its claim to trademark rights in and to each of its OPUS Marks . 53 .

By virtue of the widespread use of Fuente's OPUS Marks, beginning

in 1995, including extensive use in all forms of media, Defendants knew or should have known of Fuente's OPUS Marks, prior to Defendants' adoption and use of the OPUS mark . 54 . Both Fuente's cigars and Defendants' cigars have been offered - for sale and sold throughout the United States, at least in cigar stores and via the Internet . 55 . Both Fuente's cigars and Defendants' cigars have been and are sold to cigar smokers throughout in the U .S .

Fuente's and Defendants' cigars travel in the same channels of trade.

57 . Fuente's and Defendants' cigars aree advertised on the Internet . 13

58 . Defendants are improperly using a confusingly - similar - mark and/or derivative of Fuente's federally protected, famous OPUS Marks on and in connection with the sale of cigars . 59 . Specifically, Defendants are promoting, offering for sale and selling cigars in this district in association with the mark OPUS and are thus, without authority using parts of Fuente's federally registered OPUS Marks in association

withh cigars . 60. Defendants have used the OPUS mark on and in connection with the sale of cigars with full knowledge of Fuente's prior rights in its OPUS Marks with the intent to trade upon the goodwill associated with those marks . bl . Defendants' OPUS mark is confusingly similar to Fuente's OPUS Marks . 62 . Defendants' use of the OPUS mark in association with cigars has lessened the capacity of Fuente's famous and distinctive OPUS Marks to distinguish and identify Fuente's cigars and related products from those of others, thereby diluting the distinctive quality of its famous OPUS Marks . 63 . Defendants' use of the OPUS mark dilutes the strength of Fuente's OPUS Marks to act as unique indicators of the source of Fuente's cigars in that such use allows Defendants to take advantage of the fame and goodwill which are 14

associated with Fuente's OPUS Marks, enables others to pass off Defendants' cigars as those of Fuente and takes the hard -earned reputation and goodwill associated with Fuente's OPUS Marks out of Fuente's control and makes it instead, subject to the quality standards of Defendants, thereby damaging Fuente . 64. Defendants adopted and are using the OPUS mark in bad faith with intent to trade upon the goodwill and recognition of Fuente and its OPUS Marks . 65. Defendants acted in bad faith, with intent to profit from the use of the OPUS mark in association with the sale of cigars . 66. Defendants' use of the OPUS mark in association with thee promotion and sale of cigars is likely to cause confusion among consumerss and to cause irreparable damage and injury to Fuente . 67. This is not the first time that Defendants have infringed Fuente's trademarks . 68. In 2005, Defendants adopted and used an X mark in association with cigars that infringed upon a number of Fuente's federally registered X Marks . 69. The parties were able to resolve that matter whereby Defendants agreed to cease use of the infringing X mark . 70. Defendants' continued acts of infringement of Fuente's trademarks constitutes a pattern of deliberate and willful infringement of Fuente's trademarks . 15

COUNT 1: Federal Trademark Infringement (15 U .S.C. § 1114) 71 . Fuente repeats the allegations in paragraphs 1 through 70 above as if fully set forthh herein .

72. Fuente's U.S . Registration 1,989,060 for the mark FUENTE FUENTE OPUS X in International Class 34, is prima facie evidence of the validity of that registration, of Fuente's ownership of that mark, and of Fuente's exclusive right to use the mark in interstate commerce in association with cigars . 73 . Fuente's U .S . Registration 2,495,579 for the FUENTE OPUSX in International Class 34, is prima facie evidence of the validity of that registration, of Fuente's ownership of that mark, and of Fuente's exclusive right to use the mark in interstate commerce in association with cigars . 74. Fuente's U .S. Registration 2,256,200 for the FUENTE FUENTE OPUSX Design in International Class 34, is prima facie evidence of the validity of that registration, of Fuente's ownership of that mark, and of Fuente's exc lusive right to use the mark in interstate commerce in association with cigars . 75 . Fuente's U .S . Trademark Registration No . 2,364,801 for the mark FUENTE FUENTE OPUSX Design in International Class 34, is prima facie evidence of the validity of that registration, of Fuente's ownership of that mark,

and of Fuente's exclusive right to use the mark in interstate commerce in association with cigars . 76 .

With knowledge of Fuente's senior, superior rights to its OPUS

Marks, Defendants adopted and are using an OPUS mark in connection with the sale, offering for sale, promotion and marketing of cigars in a manner likely to cause confusion in the marketp lace and infringe Fuente's rights in its registered trademarks . 77 . Defendants' OPUS mark is confusingly similar to and infringes Fuente's federally registered OPUS Marks . 78 . Defendants' use of the OPUS mark is likely to continue to cause confusion or mistake or to deceive customers as to the affiliation, connection or association of Defendants with Fuente or as to the origin, sponsorship or approval of Defendants' products by Fuente, thus causing confusion or a likelihood of confusion. 79. Defendants' use of the OPUS mark has been committed with the knowledge that the use of such mark would cause confusion or mistake and to deceive the public .

Defendants' conduct of adopting and using marks that infringe

Fuente's federally registered marks evidences bad faith and an intention to trade

off the goodwill of Fuente's trademarks for its own commercial gain . 81 . Defendants' use of the OPUS mark constitutes deliberate and willful infringement of Fuente's trademarks. 82. As a result of Defendants' use of the OPUS mark, Fuente has and will continue to suffer irreparable damage to its business, reputation, and valuable goodwill in its OPUS Marks . 83 .

Defendants' intend to continue the acts that have caused Fuente harm

and unless restrained and enjoined, will continue to cause Fuente irreparable damage . 84. Fuente is without adequate remedy at law to compensate it for the actual and threatened injuries caused as a result of Defendants' acts .

COUNT IL• Federal Trademark Dilution (15 U.S.C. § 1125(c)) 85 . Fuente repeats the allegations of paragraphs 1 through 84 above as if fully set forth herein. 86. By virtue of the widespread use of Fuente's OPUS Marks, the extensive advertisement and promotion of the Fuente's OPUS branded products, unsolicited media coverage, customer word-of-mouth, and substantial sales of the 18

cigar in association with Fuente's OPUS Marks, Fuente has established tremendous goodwill, value, and selling power in and to the Fuente OPUS marks, and those marks have become famous and distinctive . 87 . Defendants adopted and, began using the OPUS mark after the Fuente OPUS Marks, had become famous and distinctive . 88. Defendants' use of the OPUS mark is commercial in nature as

Defendants are using the mark to sell their products in commerce . 89. Defendants' use of the OPUS mark is likely to dilute, tarnish and/or blur the value and goodwill in the famous Fuente OPUS Marks in violation of Section 43(c) of the Lanham Act, 15 U .S .C . § 1125(c) . 90 . As a result of Defendants' acts, Fuente will suffer irreparable damage to its business, reputation, and valuable goodwill . 91 . Defendants intend to continue the acts that have caused Fuente harm and unless restrained and enjoined, will continue to cause Fuente irreparable damage . 92. Fuente is without adequate remedy at law to compensate it for the actual and threatened injuries caused as a result of Defendants' acts . COUNT III : Federal Unfair Competition and False Designation Origin Under the Lanham Act (15 U .S.C. § 1125(a))

93 . Fuente repeats the allegations in paragraphs 1 through 92 above as if fully set forth herein. 94. Fuente is the owner of the federally registered OPUS Marks . 95 . With knowledge of Fuente's senior, superior rights to its federally registered OPUS Marks, Defendants adopted and are using confusingly similar marks in connection with the offer for sale, sale, distribution and promotion of cigars . 96. Defendants have offered for sale, sold, distributed and promoted in interstate commerce, cigars in association with the OPUS mark which is confusingly similar to Fuente's OPUS Marks . 97 . Defendants' acts constitute false designation of origin and are likely to cause confusion, cause mistake and to deceive as to affiliation, connection or association of Defendants with Fuente and as to the origin, sponsorship or approval of Defendants' products by Fuente, all in violation of 15 U .S .C. § 1125(a) . 98. As a result of Defendants' acts, Fuente has and will continue to suffer irreparable damage to its business, reputation and goodwill . 99. Defendants will continue the acts that have caused Fuente harm and unless restrained and enjoined, will continue to cause irreparable damage to Fuente. 20

100 . Fuente is without adequate remedy of law to compensate it for the injuries and continued threatened injuries caused by Defendants' acts . COUNT IV : Dilution Under Georgia Dilution Statute, Ga . Code Ann. §10-1-451 101 . Fuente repeats the allegations in paragraphs 1 through 100 above as if fully set forth herein . 102 . The acts of Defendants are likely to injure the business reputation of Fuente and are likely to dilute the distinctive quality of the Fuente OPUS marks . 103 . The acts of Defendants constitute, dilution and detract from the distinctiveness of Fuente's famous OPUS Marks, with consequent damage to Fuente and the business and goodwill symbolized by Fuente's trademarks, under the Georgia Dilution Statute, Ga . Code Ann . § 10-1-451 .

COUNT V : Unfair Competition Under State Common Law 104 . Fuente repeats the allegations of paragraphs 1 through 103 above as if fully set forth herein . 105 . Defendants' acts constitute false designation of origin and are likely to cause confusion, cause mistake and to deceive as to affiliation, connection or association of Defendants with Fuente and as to the origin, sponsorship or approval of Defendants' products by Fuente .

106 . The acts of Defendants as described above constitute unfair competition under state common law . 107. As a result of Defendants' acts, Fuente has and will continue to suffer irreparable damage to its business, reputation, and valuable goodwill . 108 . Defendants intend to continue the acts that have caused Fuente harm and unless restrained and enjoined, will continue to cause Fuente irreparable damage . 109. Fuente is without adequate remedy at law to compensate it for the actual and threatened injuries caused as a result of Defendants' acts . COUNT VI : Trademark Infringement Under State Common Law 110. Fuente repeats the allegations of paragraphs 1 through 109 above as if fully set forth herein . 111 . With knowledge of Fuente's senior, superior rights to the OPUS Marks, Defendants adopted and are using the OPUS mark in connection with the sale, offering for sale, promotion and marketing of cigars in a manner likely to cause confusion in the marketplace and infringes Fuente's rights in its trademarks . 112 . Defendants' OPUS mark is confusingly similar to and infringes Fuente's OPUS Marks.

113 . Defendants' use of the OPUS mark is likely to cause confusion or mistake or to deceive customers as to the affiliation, connection or association of Defendants with Fuente or as to the origin, sponsorship or approval of Defendants' products by Fuente, thus causing confusion or a likelihood of confusion . 114. Defendants' use of the OPUS mark has been committed with the knowledge that the use of such marks would cause confusion or mistake and to deceive the public. 115. Defendants' conduct of adopting and using a mark that infringes Fuente's marks evidences bad faith and an intention to trade off the goodwill of Fuente's trademarks for its own commercial gain. 116: Defendants' use of the OPUS mark constitutes deliberate and willful infringement of Fuente's various trademarks . 117 . As a result of Defendants ' use of the OPUS mark, Fuente ' will continue to suffer irreparable damage to its business, reputation, and va luable goodwill in its marks . 118 . Defendants' intend to continue the acts that have caused Fuente harm

and unless restrained and enjoined, will continue to cause Fuente irreparable damage .

119 . Fuente is without adequate remedy at law to compensate it for the actual and threatened injuries caused as a result of Defendants' acts. 120. The acts of Defendant as described above constitute trademark infringement under state common law . DEMAND FOR JURY TRIAL Plaintiff Fuente demands trial by jury on all claims so triable . PRAYER FOR RELIEF WHEREFORE, Fuente prays that this Court order, adjudge and decree that : 1 . Defendants' use of the OPUS mark constitutes federal trademark infringement, dilution under federal and state law, unfair competition under federal and state law, and trademark infringement under Georgia law. 2. Defendants and their officers, directors, agents, servants, employees, representatives, attorneys, related companies, successors and assigns, andd all other in active concert or part icipation with them, including but not limited - to manufacturers, printers, suppliers, importers, wholesales, distributors, and retailers of Defendants' products, be preliminarily and permanently enjoined and restrained from:

(a) Using on or in connection with the manufacture, distribution, sale, offer for sale, advertisement, and/or promotion of cigars (i) the OPUS 24

mark; and (ii) any colorable imitation of Fuente's OPUS Marks and any mark confusingly similar thereto or likely to cause confusion or dilution of the distinctiveness of Fuente's trademarks or to injure Fuente's business reputation;

(b)

From representing by any means whatsoever, directly or

indirectly, that cigars sold by Defendants are in any way authorized,

affiliated, or sponsored by Fuente or from otherwise taking any action likely to cause confusion, mistake or deception on the part of purchasers or consumers as to the origin or sponsorship of such products ; and (c) From doing any other acts or things calculated or likely to cause confusion or mistake in the mind of the public or to lead purchasers or consumers into the belief that Defendants' cigars, or any products or portions thereof, are manufactured or supplied by Fuente or otherwise unfairly competing with Fuente . 3 . Pursuant to 15 U .S .C. § 1118, Defendants deliver for destruction all infringing products, packaging, labels, advertisements and associated materials bearing the OPUS mark . 4. Defendants be required to report to the Court the manner in which it has complied with this injunction . 25

Defendants account to Fuente for their sales and profits arising from

the foregoing acts of trademark infringement, dilution, and unfair competition,. and in accordance with such accounting that Fuente be awarded damages for Defendants' intentional and willful acts of infringement, dilution and unfair competition, and judgment for three times such profits pursuant to 15 U .S.C. § 1117 (a). 6. Fuente be awarded its costs and disbursements, including attorneys' fees, pursuant to 15 U .S.C. § 1117 and Ga . It's quite tricky to get one here but fortunately I happen to have some nice friends who recently had a trip to the Dominican Republic . . . and I just had to ask them for a few sticks (Manisha and Robinson - thank you!) . So here we go with this review of the Arturo Fuente Opus X Robusto 1992 Rare Estate Reserve . Let me just say that it exceeded my expectations . Read on .

Appearance : Rating : First of all, the tin . As you can see it 's beautiful and impressive (so is the band) . I hope their designer s are well-paid because they definitely deserve a nice salary . The torcedores have made a very good job just as well :. the stick is tightly rolled and the wrapper i s smooth and oily .

Construction :Rating. - T i q The construction is high quality as well ; the draw was perfect, and the burn regular . This Opus X has the longest ash I've ever seen - must be close to 2 inches (!) ; firm and not flaky at all .

Flavor : Rating : - 4 = -r :; -~

The beginning is as powerful as I expected . The first third boasts a very complex bouquet of flavors, composed of precious wood , roasted arabica and , of course , spice . The bouquet is equal (if not superior) to the best Cuban specimens . This fir s t third is very macho, powerful , not blended to be elegant . The smoke i s soft and delicious (did I ment i on that the amounts of produced smoke are more than respectable?) . The second third is mostly woody, a little bit les s complex that the 1 /3 probably to the absence of coffee notes . Half-way through, I feel a mix of woody flavors (which come first), followed by some sugary notes . The taste stays very long on the palate, it 's ama z ing . In the last third , there is a bit less smoke but the flavors considerably gain in depth and inten s ity .

This tin is one of the best gifts I've ever received . The price tag on these ones is set quite high, all right, but it clearly looks more like a gift item . So, make sure your wife/girlfriend reads this review :)

Overall Rating : Overall Rating : ` 1 i :, i I couldn't find any downside to this cigar, however hard I tried . Just one thing - make sure you don't pair it up with alcohol, especially wine - I am confident that the combination won't be great . A glass of water will do . Happy smoking! Today, thank s to the generosity of my friends at CgarsDrect , c..o.. m. I am smoking one of the elus ive Opus X from the Fuente Family. The Opus X line of cigars has garnered a lot o f accolades since it's introduction in 1995 . Opus X cigars routinely score in the 90's in C igar Aficiando and Cigar Insider . That combined with some aggressive mark eting and limited supply has led to a whol e lot of hype surrounding this scarce stogie . They sport a Dominican grown, reddish brown, Rosado wrapper which in the case of the petit lancero is a little veiny and lumpy . The wrapper for these Dominican Puros are grown on the Chateau de la Fuente Estate i n the DR and are reported to be cured in rum barrels . Once the cigars are rolled , they are aged for a year before being sent to market .

This parti cular cigar is a short and slender lancero with a tapered head . I love lanceros . I think they are a connoi sseur ' s size and if done right make for some of the most complex smokes you can get . It's small ring gauge that leaves no room for error though as there isn't enough room in them to hide substandard tobacco . The Opu s X Petit Lancero starts off a little peppery but settles down quickly. It's smooth with lots of caramel, and earth with a leathery finish . It is very complex medium to full bodied smoke . I expected it to pack a stronger punch than it did though . The buzz factor was nice but not the reputed knock you to your seat strength I heard and read from oth e rs . The flavors are very well defined making for an amazing smoking experience . The construct i on is excellent, with a perfect draw and a razor straight bum . Those two things are not easy to accomplish when making such a small ring gauge, and i t is a testament to the skill of the rollers the Fuentes have making these cigars . The a sh was so well formed, it looked like a little piece of concrete hanging off the end of the cigar . Even though I was a little disappointed with it's power, this is the best of all the Opus X vitolas I hav e tried so far . I am afraid its price tag relegates it to a spec i al occasion smoke though .
