Shirley Pigott MD 301 Woodway Victoria, Texas 77904 March 23, 2009 The Honorable Eric Holder United States Attorney General US Department of Justice Washington, DC Dear Attorney General Holder, I am a sixty year old physician who has practiced primary care for twenty-five years in Victoria, Texas. The Texas Medical Board (TMB) is retaliating against me because I am openly speaking my belief that they are involved in inter-agency corruption. No formal charges have been made against me, but a board attorney asserts that I have a deteriorating mental state based on the opinions of their appointed experts. They cite my free speech as evidence I am a danger to the public and plan to suspend my medical license on that basis on Tuesday, March 24, 2009. My personal physician and I agree that I am of sound mind, practice medicine with skill and safety, and am an asset to my patients and community. He has taken care of me for seven years and knows me well. Circumstantial evidence suggests Texas Department of Public Safety officers (DPS), Trooper Alfred Ochoa and Sgt Daniel Terronez were hired to intimidate me on the evening of September 29, 2007, while I was on my way to a medical meeting in another state. I was to confront a doctor I believed had illegal influence over a TMB member. The officers were aggressive and alarmed me; I fled the scene in fear of my life when Sgt. Terronez began bashing in my car window. In my rush to escape, I almost collided with a speeding 18-wheeler. I interpreted the incident as an attempt on my life and reported it to DPS Internal Affairs. There was no investigation, rather, accelerated retaliation by both the TMB and DPS. Nine months after the original incident I was indicted for "aggravated assault of a law enforcement officer in the line of duty with a deadly weapon", my Toyota Prius. My car was seized after a warrantless search of my private financial information showed sufficient equity to make the vehicle "worth seizing", according to my former attorney. Officer Alfred Ochoa swore I tried to run him down, although he was nowhere near the trajectory of my car. When I stopped at the next lighted, populated area, I was arrested, incarcerated, and charged. Since then, I and two other witnesses have seen an email exchange between Captain Patrick Mulligan, the officers' supervisor, the nurse of a now resigned TMB member, and the 329th district judge. The judge forwarded the email to the 329th district attorney who is prosecuting me. They all deny it exists and the DA refused to produce it even though the judge ordered him to. My husband committed suicide on January 8, 2008, shortly after telling me, "You are going to lose your medical license, go to prison, and bankrupt our family." My three sons, my patients, and I have all suffered irreparable harm due to the TMB and DPS who I believe are in continuing collusion to harm me. My own investigation of the TMB has yielded evidence that they refuse to discipline bad doctors, but persecute good doctors who cross them. Unless they are restrained or enjoined against their ongoing violation of my civil rights, innocent people will be further traumatized. The TMB will continue to imperil the lives of Texans. Please act urgently to prevent this from happening.
