Washington, D.C. 20036 RE: Commission's Request for Documents Dear Mr. Marcus: This letter responds to your request for an update on the litmus test items addressed in your memo of August 26, 2003 and my previous letter to you dated September 5, 2003. As a general update, since September 5,2003, the Federal Bureau of Investigation (FBI) has continued to make extraordinary efforts to facilitate the Commission's inquiry. Most significantly, a process is now in place to allow four Commission staff members to query the FBI's ACS database through FBI personnel at FBIHQ. While not listed as a litmus test issue, this access was deemed critical by the Commission. The process has been in place now for several weeks and we understand from your staff that it has been of great assistance to their work. In particular, the ACS queries facilitated your staff's recent trip to the FBI's Los Angeles Field Office, where they conducted 23 follow-up interviews with FBI and JTTF personnel. We are currently working with your staff to set up similar interviews this week at our Washington Field Office and in San Diego in the very near future. These visits have also been aided by expedited access for your staff to documents responsive to Document Request #10. To speed access to the Commission, the FBI has allowed selected staff to review unredacted documents responsive to Document Request #10 before they are put through the normal processing. Once again, we have received positive feedback from your staff on this process. Since September 5, the Commission has also continued to enjoy extensive access to FBI personnel. In addition to the interviews mentioned above, the FBI, with the CIA, provided two separate day-long briefings for the Commission staff on the history and leadership of Al Qaeda and to discuss various individuals and their possible roles or participation in the 9/11 plot. Commission staff also received a briefing on the FBI's approach to working counterterrorism cases through the use of two case studies. The Commission has also continued

to have extensive access to FBI personnel in the field. Since September 5, 2003, the Commission completed its visit to the New York Field Office and completed a separate visit to the Miami Field Office. In total, your staff conducted a total of 50 interviews in New York and 35 more in Miami. This is in addition to four interviews of Headquarters personnel during this period as well as an interview of the FBI's Legal Attache in Ottawa and the visit to the LA Field Office mentioned above. To date, the FBI has provided approximately 162 interviews and 21 briefings to the Commission since the Commission began its work. In the coming weeks, we expect to facilitate additional field office visits to Phoenix and San Diego. We are also receiving requests for additional interviews at FBMQ, which we are scheduling as they are received. Senior officials of the FBI have also worked cooperatively with your Executive Director to accommodate your desire to gain access to FBI and other personnel overseas and appropriately address the sensitive issues raised by such an endeavor. Finally, with respect to the specific litmus test items identified in your memo of August 26, 2003, the FBI can report the following:

1) Document Request #1, Items 8(e) and 8(f) - production complete; 2) Document request #5 items 2, 4, 5, 7, 8, 9 and 12 - as stated in my previous letter of September 5, the production is substantially complete. Additional responsive documents have been produced since September 5, including the Al-Barakaat serials discussed with your staff. The FBI also continues to respond to follow-up requests. As for item 9, your staff has begun interviews with relevant FBI personnel on the subjects addressed by that item. We expect that there may be follow-up requests based upon those interviews to which we will be happy to respond; 3) Document Request #9 -- Commission staff has reviewed samples of materials from former Director Freeh's calendars and have determined that they do not need additional access to those materials at this time. The FBI has completed review of the remaining archive materials. Additional responsive documents were found and the rolling production of those documents will begin this week and will likely be complete by the end of next week (given the urgency of processing the documents from your ACS queries to support your upcoming interviews and travel- which this week totaled approximately 2,000 pages - we are making those items top priority).
