Terms of Service Digital Illusions Design Client Agreement By submitting photographs, videotape, CD’s, Items of importance to be scanned or any other type of media to Digital Illusions Design for inclusion in our DVD Video Album, the client acknowledges and agrees that Digital Illusions Design shall not be liable for any loss or damage to these materials during the shipping process, either to or from our Company. The client understands and agrees to release Digital Illusions Design from all liability resulting from mishandling or loss during shipping, regardless of carrier used or method of transportation. The client certifies that all media submitted to Digital Illusions Design is free of copyright protection, either directly or via a third party, or that the client has obtained written permission from any third-party copyright holder to use the materials as the client wishes. The client also understands and agrees that all copyrighted music submitted for inclusion into the DVD Video Album must be purchased legally or on the original CD. The client also understands, and agrees, that Digital Illusions Design Video Albums are designed and intended for personal, noncommercial use and that no admission fee is to be charged for viewing. Unless otherwise instructed, Digital Illusions Design uses DVD-R media; please ensure that your DVD player is compatible with this media. All final materials produced by Digital Illusions Design are legally copyrighted and may not be duplicated or reproduced for any reason, without express written permission from Digital Illusions Design. The undersigned will hold Digital Illusions Design harmless for any judgment cost, legal fees, or other expenses that might arise by the reason of any infringement of copyright related to this order. The client understands and agrees that Digital Illusions Design must receive payment in full before completed order is shipped. RETAINER **A $50.00 retainer is required to reserve the date. Upon receipt of retainer and signing of agreement, Digital Illusions Desgin will reserve the time and date agreed upon, and will not make other reservations for this time and date. For this reason, all retainers are non-refundable if the event is cancelled for any reason. VIEWING AND DISPLAY RIGHTS The video is strictly produced for the client’s private home use only. Any duplication or broadcast (including internet use) without written consent of Digital Illusions Desgin is strictly prohibited. Digital Illusions Design reserves the right to use portions of the video for promotional or other purposes.
